THE FINAL MAP FOR TRACT NO. 9620 (LOS GATOS GATEWAY) AND ACCEPTING THE DEDICATIONS RECOMMENDATION: Adopt resolution approving the Final Map for Tract No. 9620 (Los Gatos Gateway) and
accepting the dedications. BACKGROUND: The developer, Sobrato Development Companies, requested approval of a planned development subdivision on the northeast comer ofWinchester Boulevard
and Highway 85. On May 3,2004, the Town Council approved the PlannedDevelopment Ordinance (Ordinance 2130). The TentativeMap (M-04-008) was approved by the Development Review Committee
on May 25,2004. DISCUSSION: Tract No. 9620 will create 4 lots for commercial use and 290 condominium dwellings on approximately 12.2 acres of land located on the northeast comer of Winchester
Boulevard and Highway 85. Subsequent condominium maps will be required to create the air space subdivision of the commercial and residential parcels. The developer has provided all necessary
maps. The developer has paid the appropriate fees to fully comply with the previously-imposed development conditions and Town ordinances, as listed on Page 2 of this report. PREPARED

where the entrance will be the fourth leg ofthe Winchester/Highway 85 on-ramp signal and offof"A" Street. However, since the signal improvements will be handled by Caltrans, the railroad
crossing handled by the Valley Transportation Authority and the sidewalk onA Street is in an off-site easement, there are no public improvements that require an improvement agreement
and the posting ofimprovement securities. The developer will be dedicating a public service easement (PSE) over driveways within the subdivision. The dedications are included on the
fInal map. ENVIRONMENTAL ASSESSMENT: An Environmental Impact Report (EIR) was prepared for the project and was certifIed by the Town Council onFebruary 4,2002. AnAddendumto the ERlwas
subsequentlyprepared and was accepted by Council on April 23, 2004. No additional environmental review is required for the tentative or fInal maps. FISCAL IMPACT: The developer, Sobrato
Development Companies, have paid the following fees: 1. Tract Map Checking fee $2,900.00 (paid) 2. Computer Service fee $116.00 (paid) Additionally, at the time ofbuilding permit issuance,
traffIc impact mitigation fees will be due for the commercial portion ofthe proj ect. For the residential portions, traffIc impact mitigation fees will be due prior to occupancy. Attachments:

RESOLUTION RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS APPROVING FINAL MAP OF TRACT NO. 9620 AND ACCEPTING THE DEDICATIONS WHEREAS, on May 25, 2004, the Planning Commission
of the Town of Los Gatos approved the Tentative Map Application M-04-008, with conditions; and WHEREAS, the Owner or Subdivider has complied with the conditions of Tentative Map ApplicationM
-04-008. NOW, THEREFORE, IT IS RESOLVED that the certain Final Map of Tract No. 9620 in the Town ofLos Gatos, dated September 2004, and prepared by Kier & Wright, for approval by the
Town Engineer ofthe Town ofLos Gatos, is hereby approved; and all offers ofland for public use therein made on said Map are hereby accepted. PASSED AND ADOPTED at a regular meeting of
