'6 SUBJECT: NORTH LOS GATOS STREET SURFACING PROJECT ADOPT RESOLUTION AUTHORIZING STAFF TO FILE AN APPLICATION FOR FEDERAL SURFACE TRANSPORTATION (STP) PROGRAM FUNDING ;, \. ,./RECOMMENDATION: Adopt resolution authorizing staff to file an application for Federal Surface Transportation (STP) Program Funding. 'BACKGROUND: The Town of Los Gatos received a call-for-projects for grant funding oflocal streets and roads for FY 2005-06 and 2006-07. The total funding limit in Santa Clara County is $16,074,000. From this total funding iimit, the amount allocated for Los Gatos for each year is $138,752. Grant applications were due to VTA on July 13,2004 and by early September 2004 the VTA board willapprove the projects list for various agencies. The minimum acceptable grant is $150,000, so Los Gatos worked with the City of Campbell, and together thejurisdictions crafted a project that was over $150,000 that would enhance both agencies. This project would provide repaving of a number of residential streets around Pollard Road and Knowles Drive in both municipalities. DISCUSSION: We were informed by Metropolitan Transportation Commission (M'tC), who is in charge of this grant, that funds can only be applied for collector and arterial 􀁲􀁯􀁡􀁤􀁳􀁾 not local residential streets. MTCalso agreed that The Town of Las Gatos can use our total allocated grant funds for both years in one project. This would make our project funding limit to be $277,504.00 and would not require combining work with the City of Campbell. (' We are proposing to have the grant funds used for repairs and resurfacing ofLos Gatos-Almaden Road, Lester Lane, National Avenue, and Camino del Cerro. These meet the criteria for resurfacing set by MTC and as validated by the Town's pavement index system. CONCLUSION: Staff recommends that Council approve the Resolution authorizing staff to file an 􀁾􀁰􀁰􀁬􀁩􀁣􀁡􀁴􀁩􀁯􀁮 for Federal Surface Transportation (STP) Program funding. ENVIRONMENTAL ASSESSMENTS: Is not a project defined under CEQA, and no further action is required. FISCAL IMPACT: ForFY 2005-06, $40,000 will need to be budgeted by the Townin the proposed FY200511 0 Capital Improvement Plan as the local match for this project. RESOLUTION RESOLUTION OF THE TOWN COUNCIL OF THETOWN OF LOS GATOS AUTHORIZING THE FILING OF AN APPLICATION FOR FEDERAL SURFACE TRANSPORTATION FUNDING FOR THE NORTH LOS GATOS STREET RESURFACING PROJECT AND COMMITTING THE NECESSARY NON-FEDERAL MATCH FOR THE PROJECT(S) AND STATING THE ASSURANCEOF THE TOWN OF LOS GATOS. TO COMPLETE THE PROJECT WHEREAS, the Transportation Equity Act for the 2151 Century (TEA 21) (public Law 105178, June 9, 1998) and the TEA 21 Restoration Act (Public Law 105-206, July 22, 1998) continue the Surface Transportation Program (23 U.S.c. -133); and WHEREAS, the TEA-21 legislation will guide the Surface Transportation Program until the TEA-21 Reauthorization bill is authorized; and WHEREAS, pursuant to TEA21, and the regulations promulgated thereunder, 􀁥􀁬􀁩􀁾􀁢􀁬􀁥 proj ect sponsors wishing to receive Surface Transportation Program grants for a project shall submit an application first with the appropriate metropolitan transportation planning organization (MPO) for review and consideration in the MPO's Transportation Improvement Program (TIP); and WHEREAS, the Metropolitan Transportation Commission is theMPO for the San 􀁆􀁲􀁡􀁮􀁾􀁩􀁳􀁣􀁯 Bay region; and WHEREAS, the Town of Los Gatos IS an eligible project sponsor for the Surface Transportation Program; and WHEREAS, the Town ofLos Gatos wishes to submit an application to MTC for funds from the SUrface Transportation Program in fiscal year 2005-06 and 2006-07 for the following project: NORTH LOS GATOS STREET RESURFACING PROJECT WHEREAS, MTC requires a resolution stating the following: 1) the commitment oflocal matching funds of at least 11.47%; and 2) that the sponsor understands that the Surface Tr'!IlSportation Program funding is fixed at the programnied amount, and therefore any cost increase cannot be expected to be funded with Surface Transportation Program funds; and 3) the assurance ofthe sponsor to complete the proj ect as described in the application, and if approved, as programmed in MTC's TIP; and 4) that the sponsor understands that funds must be obligated by June 30 of the year that the project is programmed for in the TIP, or the project may be removed from the program; and -5) that the sponsor has a MTC certified pavement management system (PMS). NOW,THEREFORE,'BEIN RESOLVED. by the Town Council 􀁴􀁨􀁾􀁴 the Town of Los Gatos is authorized to execute and file an 􀁡􀁰􀁰􀁬􀁾􀁣􀁡􀁴􀁩􀁯􀁮 for funding under the Surface Transportation Program TEA -21 Reathorization in the amount of ($277,504) for the North Los Gatos Street Resurfacing Project; and BE IT FURTHER'RESOLVED that the Town Council by adopting this resolution hereby states that: 1) the Town ofLos Gatos will provide ($40;000) in local matching funds; and 2) the Town ofLos Gatos understands that the Surface Transportation Program funding for the project is fixed at{$277,504) and that any cost increases must.be funded by the Town ofLos Gatos from local matching funds, and that the.Town ofLos Gatos does not expect any cost increases to beJunded with Surface Transportation Program funds; and 3) the North Los Gatos Street Resurfacing Project will be built as described in this resolution and a submitted application, and if approved for the amount shown in the MetropolitanTransportation Commission(MTC) TransportationImprovementProg ram (TIP) with obligation occurring within the time frame established below; and ,-4) The program funds are expected to be obligated by June 30 of the year the project is programmed for the TIP.
