Adopt resolution accepting work of Duran and Venables, Inc. and authorizing the Town Manager/Executive Director to execute Certificate of Acceptance and Notice of Completion for recording
by Town Clerk/Secretary of the Redevelopment Agency. BACKGROUND: Staff prepared plans and specifications for these improvements and used the informal bidding process to solicit bids
from contractors. On February 17, 2004 the Town Council awarde<i the contract for this work to Duran and Venables, Inc. as the lowest responsible bidder. On March 30, 2004 the project
was substantially completed. The execution and recording of the Certificate of Acceptance is now required to finalize the Town's acceptance of the project. PREPARED BY: JOHNE.CURTIS

DISCUSSION: is available for miscellaneous improvements to Parking Lots 1,2,3, and 6 to bring these lots to ADAcompliance. Improvements included the installation ofADA
whee1chairramps, repairs to the pavement, and striping of the area around the new ramps. The contracted work has been completed by Duran and Venables, Inc. and is accepted by the Parks
and Public Works Department. Ten percent ofthe faithful performance bond will remain in effect for a period of two years to guarantee any needed repair and/or replacement caused by defective
materials and workmanship. Staff recommends that the Certificate of Acceptance and Notice of Completion be executed and recorded. ENVIRONMENTAL ASSESSMENT: This project is defined under
CEQA but is Categorically Exempt (Section 15301@). A Notice of Exemption will not be filed. FISCAL IMPACT: The original contract approved by Council was for $42,750.00 with a contingencybudget
of$l 0,000. The project was completed for $49,393.00, which is under the total project approved budget. Sufficient funds are available in the 930-0336 -Downtown Parking Management Plan.
The project contingency amount is used to cover unforseen issues that come up during the course ofconstruction \ or changes that are made to the project due to actual field conditions

the plans and specifications pursuant to Council/Agency approval; and WHEREAS, ten percent of the performance bond provided by Duran and Venables, Inc. shall remain in place for two
years until May 3,2006 to guarantee the work; and WHEREAS, the work on Proj ect 04-09B -Parking Lots -1, 2, 3, and 6, is hereby accepted as complete pursuant to the plans and specifications
for the project. NOW T'HEREFORE BE IT RESOLVED, that the Town Manager/Executive Director is authorized and directed to execute the Certificate ofAcceptance and Notice ofCompletion attached
as (Exhibit A) hereto. BE IT FURTHERRESOLVED, that the Town Clerk/Secretary is directed to transmit this Certificate of Acceptance and Notice of Completion to the Recorder of Santa Clara
County for recording.
