Adopt the resolution continuing certain department fees, rates and charges, and amending certain fees, rates and charges. 􀁂􀁁􀁃􀁋􀁇􀁒􀁏􀁕􀁎􀁄􀁾 The Town's Financial Policies require that "fees are maintained to provide for cost recovery based on the cost of the Town providing the services." In order to comply with this mandate, the Town periodically reviews its cost ofproviding services and recommends appropriate increases in fees as supported by updated cost data. Town Council approved comprehensive fee increases last May 2003, effective July2003. The California Government Code requires, for development-related fees, a 60-day period between approva16fthe Resolution Resolution and implementation of the fee. Because the Town's Fee Schedule contains a number ofdevelopment-related fees, staffrecommends an effective date ofJuly 1, 2004 (73 days) for all fees contained within the FY 2004/05 Fee Schedule. In February, 2004, theTowncontractedwithPublic Resource Management Group (PRM) to perform an update to the detailed cost ofservice data using current Town costs on applicable fees and charges imposed by the Town for these services. This year's update concentrated mostly on parks and public works and development-related fee services. The primary goals ofthe review were to update last year's cost data, review and update stafftime estimates on labor hours associated with providing fee related services concentrating on developmentrelated 􀁳􀁥􀁲􀁶􀁩􀁣􀁾􀁳􀀬 to adjust costsfor departmental staffmg changes atld re-organizations, and to update the Town's Cost Allocation Plan to provide proper allocation ofTown overhead across all line departments. The attached Fee ScheduleRecommended Changes-(Attachment 1) presents staffrecommendations for identified areas ofservice wherein fee increases are proposed by staff Fee Schedule ofSelected City Comparisons (Attachment 2) is a sample of selected proposed fees compared to other local jurisdictions. Where possible, significant differences in terms of level of service are provided as additional detail. The Comprehensive Fee Schedule Incorporating Changes (Exhibit A to Attachment 3) is also provided. This schedule encompasses all recommended fee changes described in Attachment 1 and all other fees that did not change and remain at FY 2003/04 approved levels. DISCUSSION: PRM Group has completed its detailed review and update of last year's cost data, incorporating current costs and comparing them with their associated fees and charges imposed by the Town. Again this year, the Finance staffrecommended that 􀁐􀁾􀁣􀁯􀁮􀁣􀁥􀁮􀁴􀁲􀁡􀁴􀁥most ofits efforts in the "fee for services" category, especially development related services to ensure the costs ofthis service is borne to the greatest extent practical by the user of these services. The Towil's fee for service category is primarily for development related services. The departments where most ofthese services are provided are the CommunityDevelopment and the Parks and Public Works departments. General government fee charges (examples ofwhich are those imposed by the Town Clerk and Library) and any suggested changes are based on current known costs or fees provided by statute. The cost analysis began with an update ofthe budget and staffing information to reflect the .current fiscal yeaJ;. PRMalso took into account changes to staffing or any departmental reorganizations that affected service delivery associated with the fees imposed. pRM then' updated last year's review with assistance from staff, concentrating on the prior year's assumptions relative to stafflabor hours required to provide services. PRM al'so had Town staff provide any revisions that would better reflect changes in service levels, service responsibilities, etc. Updated fiscal information was then matched to updated service level information to produce the direct costs ofproviding fee-for-service activities. In addition to updating the direct costs, PRM updated the Town's Indirect Cost Allocation Plan. The Indirect Cost Allocation Plan identifies administrative and management overhead support and allocates it on an equitable basis to departments providing direct line public service. The cost plan allocates an appropriate amount ofthis Town-wide indirect overhead cost to all Town departments providing direct services to the community such as the Police, Community Development, Parks and Public Works, Library, and Community Services. This indirect component is added to the direct costs in order to provide a complete picture of all costs ofproviding fee-for-service activities. Finally, the full cost ofproviding services was then compared to the current fees and revenues collected, and a subsidy (or over-charge) was identified. This provides the Town wIth the basic cost information that it needs to determine appropriate cost recovery levels, and corresponding subsidy levels, and to generate estimates for increased revenue into the General Fund. Although the user fee study is a significant factor in determining the level offees to charge, it must be balanced with a number ofother factors including existing Council policies regarding provision ofcertain services, elasticity ofdemand, and affordability and paritywith surrounding jurisdictions. AlthoughPRM had a fee survey of area cities available for comparison purposes, PRM again confirmed to staff that it is very difficult to compare fees between the Town and other local governments. Typical differences in fees charged between local governments are: (1) cost recovery goals for the local government, (2) the date the last cost analysis was performed by the local government, (3) and marked differences in communities--each local government's level of service reflected in a given fee. As part ofits review, PRM compared Town stafftime dedicated to deliver services in a number of activities associated with development activity with the average staff time and level of service required by other communities for similar services. PRM determined that in many service areas related to development, this community's demands surpass those of other local jurisdictions. The level of service required by our community does have a financial cost associated with that activity that must be accounted for and either charged as a fee, subsidized by the Town as a "community benefit" or charged indirectly by adjusting policies and community expectations regarding staff services associated with private development activity. Upon completion ofthe updateofthe Town's current cost ofservice to fees charged, the PRM study reveals that the Town's current fee structure is not completely recapturing the current costs of providing services. In the case of developmental review activity, as a whole, the fees charged are recovering an average among all fees charged in the program of approximately 87.71% offull cost. In the Engineering and Capital Projects activities supporting private development such as encroachment permits and grading inspections, current fees are recovering on average 78.94% of total costs for this service activity. This means that the users ofthese services are not paying the full cost of the serVices provided to them. Due to the disparity between cost of service and current fees charged, staff is proposing various levels offee recovery with the goal of achieving as close to full cost recovery as possible. Departmental Fee 􀁃􀁨􀁡􀁬􀀱􀁾􀁥 􀁈􀁩􀀲􀁨􀁬􀁩􀁾􀁨􀁴􀁳 Highlights by department ofthe proposed changes to fees and charges are as follows: A. Community Development The Town Council previously approved on March 1, 2004 the new building permit valuation multiplier of2.32 per square foot. The new multiplier will be implemented on April 30, 2004 and is intended to establish a fee schedule that will provide appropriate cost recovery for building and planning services. Currently, the Townprocesses sign programs for shopping centers, residential fence height exception requests and zoning research letters to appraisers and real estate agencies without charging a fee. Three new fees are proposed as part of the Comprehensive Fee Schedule in accordance with the Town's policyto have cost recovery user fees. Town staffdetermined that fees sho)lld be established for these services. Additionally, staff verified that other jurisdictions currently charge or intend to charge for these services. The proposed cost recovery fees are as follows: Sign Program -$1,195.00 (formerly, service delivered at no charge to shopping center); Fence Height Exception -$150.00 (formerly delivered at no charge to applicant); Zoning Research Letters -$150.00 for basic letter, $350.00 for verification of legal nonconforming status (formerly delivered at no charge to appraiser or agency) The Community Development fee schedule has also been reorganized so that it is more user friendly for both applicants and staff. staff. All Community Development fees, except the proposed new fees as discussed above, are recommended to be increased by the Consumer Price Index (February 2004 -1.4 per cent) per Council action dated May, 20, 2002. Community Services For FY 2004/05 the Neighborhood Center staff with unanimous approval from the Community Services Commission is recommending certain fee increases as follows: Neighborhood Community Center-Discounts-Currently in effect are discounts of 35% and 15%, respectively, off Regular Resident ;Non-Profit rates for rental of meeting rooms in the Neighborhood Center, a policy adopted by Council in 1991 for two long term renters, Alcoholics Anonymous and Narcotics Anonymous. FortheFY 2003/04 Fee Schedule, the Community Services Commission recommended, and" Council approved, that the discount rate be set at 15% for both groups for FY 2003/04, and be eliminated in FY 2004/05. The Commission's recommendation stated that providing a discount to just two facility users did not create parity with other users ofthe facility. The phased elimination the discount was planned to allow both groups to plan their future use ofthe facility. Staffrecommends that the second phase of reducing the discount from the FY 03/04 amount of 15% to zero in FY 2004/05 be adopted in the FY 2004/05 Fee Schedule. Neighborhood Community Center-Discounts-A Building Attendant must be paid for by users of the Neighborhood Center if alcohol is to be served at the event, or ifmore than 50 people are to be in attendance. The Building Attendant's time is charged at a rate of $15 per hour. Staffrecommends that this rate continue to be charged for the first 8 hours oftime, and that an overtime rate of $22.50 be charged for any time over 8 hours. C. Parks and Public Works Engineerine and Capital Projects-Development Activities Parks and Public Works staffexamined their current and future anticipated fee schedule in relation to the cost analysis performed by PRM. On average, private development activity fees during "FY 2003/04 are recovering approximately 78% of full cost. The 78% is an average of all fees collected for private development activity versus the cost of providing that service. Staff reviewed these findings withPRM andmade appropriate increases to these fees. Cost analysis details supporting cost versus fee determinations were available for the department's use in determining recommended changes to the fee schedule. PAGE6 ". April 19,2004 Notable changes recommended by staff are: Annexation Fees. To cover the cost ofmanaging annexing properties to the Town, the annexation fees are now proposed to be calculated on tiers, whereby multiple lot fees are discounted to share the cost savings achieved by the Townwhen administering the annexation process for Inultiple lots. EncroachmentFees. Fees have been updated to reflect further clarification ofservices 􀁰􀁾􀁲􀁦􀁯􀁲􀁭􀁥􀁤 by staff. Also, increases and decreases were made to fees to collect the appropriate fees for work in the public right-of-way or for dumpster permits, storage unit permits, andNPDES (National Pollutant Discharge EliminatiQn System) permits. Traffic Related Fees. These fees were also further clarified to include predevelopment review analysis bythe·Town's Traffic Engineer that is currentlyprovided but not charged, and providing recovery for additional traffic analysis reviews by staff and!or consultants. The NPDES Implementation Fee. This fee is changed to reflect the two levels of implementation processing: (1) A flat fee of $50 is proposed to be charged to all Building, Encroachment and some storage permit fees when grading permits do not apply, and (2) a fee to be charged to projects based upon square footage ofimpervious surface impacted. Impact/Storm Drain Fees. The fee changes include a revision ofthe Road Impact Fees and StormDrainage Fees which have remained unchanged for manyyears and did not reflect appropriate cost-recovery. New Fees For Service. New fees for services that are added to the schedule include the Geotechnical PeerReview Fee, Digital Topography and PhotographyFee (provide a CD with aerial photographs and topography of property) and printing charges for maps, plans, and other engineering related documents printed on plotter and printers. Parks and Forestry One significant fee is recommended to offset current subsidies: Organized Recreational Activity Use Permit Fee for Multiple Date Use. This fee is proposed for activities such as classes that are held once or twice a week for several weeks. Historically, these activities were charged a one-day use pennit for the entire class session. The new fee is less than charging individual pennits for each day's use, ($45 per day) but is a reasonable fee to introduce at this time. All Parks and Public Works fees, except the proposed new fees as discussed above, are recommended to be increased by the Consumer Price Index (February 2004 -1.4 per cent) per Council action dated May, 20, 2002. D. Library· 􀁾 Library Department Activities Library staffrecommends that several small charges for replacing book covers, book pockets, etc., be eliminated as they are the effect ofnormal wear and tear. Ifdamage is determined to be caused by the user and is so extensive that an item cannot circulate, current replacement fees will apply. The library also recommends establishing an internet printing charge. The first initial ten pages are free and thereafter, $.1 O/per page will be charged. E. Police Police Department Activities The Police Department staff examined their current and future anticipated fee schedule in relation to the cost analysis performed by PRM. The recommended increases include vehicle releases, tow truck service and driver permits, citizen clearance letters, special event (non-profit), and motion picture (profit/non-profit). These increases will more closely achieve cost-recovery for these servIces. 􀁐􀁡􀁲􀁫􀁩􀁮􀁾 􀁐􀁲􀁯􀁾􀁲􀁡􀁭 No changes are recommended for the standard parking overtime violation fine of $35 dollars per day. However, recommendations for selected parking fine increases are made as a result of a comparison study with other parking jurisdictions. The increase would also provide consistency in fine amounts with other similar parking violations. A new fee recommendation is for Construction Parking permits. Issuance ofthese permits is not a new service but currently there is no fee for the permit process. Construction vehicles generally need to park in street or permit parking spaces while completing completing their work. Some need a one day permit but many need the permit for multiple days. Staffproposes a charge of $10.00 for a one day permit and $2.00 for each additional day for the same vehicle. F. General Administration Certain fees and charges for General Administration were adjusted. The Business License program is proposing a new $25.00 administrative processing fee for non-profit/exempt organizations (formerly this service was provided at no charge). These organizations will keep their "tax exempt" status for business licenses. The Town's business license staff process approximately 30 non-profit/exempt business license applications annually. G. Future Fee Change Considerations Staffis exploring the possibility ofcertain new fees explored as part ofits organizational cost analysis initiatives. One fee ofnote that staffis analyzing is a 911 service fee, The fee is intended to recover some level ofthe Town's cost ofproviding emergencyresponse communications support (PD dispatch center) and equipment. The structure and proposed amount ofthe fee are still being evaluated by staff in concert with other Santa Clara County governments that are in some development stage of considering or actually adopting a similar fee. It is expectedthat any 911 fee proposal will be brought forward as a separate agenda item in a future period for Town Council consideration. The other item brought forward as part of the FY 2004/05 budget study session in February 2004 was the recommendation to eliminate the resident exemption for the parking fee at Oak Meadow Park. Due to other Town-wide efficiencies and savings, staffis recommending that the exemption continue for at least another fiscal year. The exemption policy will continue to he examined in light ofthe current subsidy occurring in the Town's park use program. CONCLUSION: Staffrecommends that Town Council approve the attached adjustments to the Town Fee Schedule to be effective July 1, 2004. ENVIRONMENTAL ASSESSMENT: The Town's fee resolution is not a project project subject to CEQA. FISCAL IMPACT: The Town's financial policies require that fees be maintained to provide for cost recovery for fee related services. Overall additional "new" revenue to the Town based on FY 2003/04 activity is expected to be approximately $20,000 to $75,000 annually (exclusive of building permit fees previously approved by Town Council) in General Fund revenues and a reduction of$45,000 in Non Point Source Fund revenues due to decreased volume of activity estimates in this program based on the Town's FY 2003/04 experience. The increased fees collected will aid in decreasing Town-wide subsidies ofprivate activity in adherence to the Town's financial policies. It should be noted that the actual amount ofrevenue or revenue realized beginning in FY 2004/05 is subject to fluctuation due to changes in actual activity volume for development projects.
