BACKGROUND: Transportation Development Act (TDA) Article 3 funds are a percentage of gas tax collected and were established to fund local pedestrian and bicycle projects. The Metropolitan Transportation Commission (MTC) is the regional transportation planning agency responsible for the allocation of these funds. The basic objectives of the TDA Article 3 Grant projects are to increase the safety, security, and efficiency ofbicycle and pedestrian travel. Each community is "guaranteed" a specific amountbased onits population. Bicycle projects require an established Bicycle Advisory Committee (BAC) and an adopted comprehensive bicycle plan, whereas this requirement does not apply to pedestrian projects. The amount guaranteed to the Town ofLes Gatos is approximately $35,000. The current year grant application deadline is April 16, 2004. DISCUSSION: Staff has identified that the repair and restoration of the creek trail at La Rinconada Park is an eligible project for the funds. The creek bank by the trail is failing due to the recent winter storm. Staffis prepared to complete the project in a timely manner during the appropriate construction season. CONCLUSION: Staff recommends that the Council/Redevelopment Agency adopt Resolution to apply for TDA Grant funding. ENVIRONMENTAL ASSESSMENT: Is a project as defined under CEQA. A Notice ofExemption has been filed. FISCAL IMPACT: The TDA Article 3 funds total approximately $35,000. The estimated cost for the restoration ofthe trail is $35,000. These costs and associated revenues have been incorporated into the Town's proposed FY 2004-09 CIP being submitted to Town Council for adoption in June 2004. Attachments: 1. TDA Article 3 Application/Resolution/Map RESOLUTION RESOLUTION OF THE TOWN COUNCILIREDEVELOPMENT AGENCY OF THE TOWN OF LOS GATOS AUTHORIZING TOWN MANAGERJEXECUTIVE DIRECTOR TO APPLY FOR TRANSPORTATION DEVELOPMENT ACT (TDA) ARTICLE 3 FUNDING WHEREAS, Article 3 ofthe TransportationDevelopment Act (TDA), Public Utilities Code (PUC) Section 99200 et seq., authorizes the submission of claims to a regional transportation planning agency for the funding ofprojects exclusively for the benefit and/or use ofpedestrians and bicyclists; and WHEREAS, the Metropolitan Transportation Commission (MTC), as the regional transportation planning agency for the San Francisco Bayregion, has adoptedMTC Resolution No. 875, Revised, entitled "Transportation Development Act, Article 3, Pedestrian/Bicycle Projects," which delineates procedures and criteria for submission of requests for the allocation of "TDA Article 3" funding; and WHEREAS, MTC Resolution No. 875, Revised requires that requests for the allocation 9f TDA Article 3 funding be submitted as part of a single, countywide coordinated claim from each county in the San Francisco Bay region; and WHEREAS, the Town ofLos Gatos desires to submit a request to MTC for the allocation ofTDA Article 3 funds to support the projects described in Attachment B to this resolution, which are for the exclusive benefit and/or use ofpedestrians and/or bicyclists; now, therefore, be it. RESOLYED, that The Town OfLos Gatos declares it is eligible to request an allocation of TDA Article 3 funds pursuant to Section 99234 ofthe Public Utilities Code, and furthermore, be it. RESOLYED, thatthere is no pending or threatened litigation that might adversely affect the proj ect or projects described in Attachment B to this resolution, or that might impair the ability of the Town ofLos Gatos to carry out the project; and furthermore, be it. RESOLYED, that the Town of Los Gatos attests to the accuracy of and approves the statements in Attachment A to this resolution; and furthermore, be it. RESOLYED, that a certified copy of this resolution and its its attachments, and any accompanying supporting materials shall be forwarded to the congestion management agency, countywide transportation planning agency, or county association ofgovernments, as the case may be, ofthe Santa Clara County Valley Transportation Authority for submission to MTC as part ofthe countywide coordinated TDA Article 3 claim.
