SUBJECT: ADOPT A RESOLUTION AUTHORIZING TOWN MANAGER TO EXECUTE AMENDMENT TO AGREEMENT WITH ALL CITY MANAGEMENT SERVICES, INC., TO PROVIDE SCHOOL CROSSING GUARD SERVICES RECOMMENDATION: Adopt a resolution authorizing Town Manager to execute Amendment to 􀁁􀁧􀁲􀁥􀁥􀁭􀁾􀁮􀁴 with All City Management Services, Inc., to provide school crossing guard services (Attachment 1). BACKGROUND: The Town currently contracts with All City Management Services, Inc. to provide crossing guards at selected school crossing locations within Los Gatos. Costs are variably shared or borne by the Town and individual school districts depending upon the location. The Town and Los Gatos Unified School District desire to amend the existing contract with All City Management Services, Inc. to add an afternoon crossing guard at the location of Los Gatos Boulevard and Shannon Road for the remainder of the current school year and for future years. DISCUSSION: Town staffhave coordinated with Los Gatos Unified·School District staff to study safety concerns related to the afternoon crossing of Fisher Middle School students at the intersection of Los Gatos Boulevard and Shannon Road. Upon evaluation ofstudent crossing behaviors, the complexity ofthe intersection and the viability ofengineering changes to improve safety, both Townand school district staff agree that the placement of a crossing guard at the intersection in the afternoon will enhance the safe crossing of students. While most school crossing intersections have crossing guards both for morning and afternoon crossings, this intersection is most significantly impacted in the afternoon when students are leaving school all at one time. For this reason, no morning crossing guard placement is recommended. All City Management Services, Inc., the contract provider of school crossing services, normally requires a three-hour 􀁭􀁩􀁮􀁩􀁭􀁵􀁭􀁦􀁥􀁾 to provide crossing guard services. The company has indicated that they will attempt to provide a crossing guard at this locationfor just the afternoon and will waive the three-hour minimum. If the company is unable to, the Town would-be required to pay for full three hour coverage and would therefore have both morning and afternoon coverage at the intersection. Three-hour 􀁣􀁯􀁶􀁾􀁲􀁡􀁧􀁥 for an intersection has an annualized cost of$7,284.60. The estimated cost for this position for the remainder ofthe current school year is $3,035.25. This amendment will increase the contract with All City Management Services, Inc. to $ 61,312.05. If the Town is able to secure afternoon only coverage, the cost would be one-halfofthis amount annually, $3,642.30, or $1 ,51 7.63 for the remainder of the school year. Los Gatos Unified School District has verbally agreed to share one-halfofthis cost with the Town, consistent with how costs are shared for other crossing locations under the current contract. CONCLUSION: Staff recommends Council approval of the amendment to the contract. Upon approval, staff will direct All City Management Services, Inc. to immediately schedule the crossing guard. Staff will work with Los Gatos Unified School District to share the costs ofthis amendment. A new agreement will be negotiated with All City Management Services, Inc. for the next school year. ENVIRONMENTAL ASSESSMENT: The recommended action is not a project defined under CEQA, and no further action is required. FISCAL IMPACT: This amendment will increase the current contract with All City Management Services, Inc. by an amount not to exceed $3,035.25 annually. The cost to the Town will be one-half of this amount, $1,517.63, with the other halfbeing paid by the Los Gatos Unified School District. Funding for this increase in cost is contained in cost center 4050-61160 and there are sufficient funds in the current budget to support this increase. For Crossing Guard Services, dated August 2, 1999, and denoted Agreement 99.139, is amended as follows: 1. Section I, Scope of Services, is amended to add the following: All City Management Services, Inc. shall provide crossing guard 􀁳􀁥􀁲􀁶􀁩􀁣􀁾 at the intersection of Shannon Road and Los Gatos Boulevard, beginning March 2, 2004 and continuing through the end of the 2003/04 school year. Such service shall be provided at, and billed at the rate of, one and one-half (l.5) hours per day, in the after-school period only, contingent on the availability of All City Management Services Inc. personnel to perform such service. Should All City Management Services Inc. be unable to obtain personnel to perform service for one and one-half (l.5) hours per day, All City Management Services Inc. shall provide service at, and bill at the rate of, three (3) hours per day. 2. The first paragraph of Section 6, Compensation, is amended to read as follows: The Town agrees to pay the Contractor for the services rendered pursuant to this Agreement the sum of Thirteen Dollars and Forty-nine Cents ($13.49) per hour of crossing guard services provided. It is understood and agreed that no more than Four Thousand Five Hundred Forty-five (4,545) hours of service shall be provided, for an amount not to exceed Sixty-one Thousand Three Hundred Twelve Dollars and Five Cents ($61,312.05).
