TO ADVERTISE THE PROJECT FOR BIDS RECOMMENDATION: Adopt Resolution approving plans and specifications for Curb, Gutter and Sidewalk Replacement and authorizing staff to advertise the
project for bids. BACKGROUND: The adopted Capital Improvement Program designates funding for the Curb, Gutter, and Sidewalk Repl':lcement Program and is consistent with the Town's goals
to improve public safety. DISCUSSION: This project funds the annual repair and replacement of deficient curbs, gutters, and sidewalks throughout Town. Location for repairs and replacement
work are identified throughout the yearby Parks and Public Works Department staff. The primary cause of damage to curbs, gutters, and sidewalks is tree root growth. This Curb, Gutter,
and Sidewalk Replacement project is expected to start in April and be completed by July. Plans and Specifications for Project No. 03-49 are complete and are available for review at the
Town Clerk's Office. As has been the case in the past, this approach assumes full (100%) Town funding for the sidewalk replacement isevaluating a cost-sharing

for this program. Staffwill bring this alternative to the Town Council for discussion during the review of the FY 2004 -2009 Capital Improvement Program. CONCLUSION: It is recommended
that the Council adopt the attached Resolution approving plans and specifications for the Curb, Gutter, and SidewalkReplacement Program and authorize staffto advertise the project for
bids, If the Council acts as recommended, the project will be advertised and a construction contract will be presented tor Council award on AprilS, 2004 . ENVIRONMENTAL ASSESSMENT: This
is a project as defined under CEQA but is Categorically Exempt (Section 15301@). A Notice of Exemption will not be filed. FISCAL IMPACT: The estimated construction cost for this project
is $310,000. There are sufficient funds in Project 400-0349 to fund this project, per the approved FY2003-04 Capital Improvement Program as demonstrated below: Curb, Gutter and Sidewalk'400-0349

RESOL,UTION RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS APPROVING THE PLANS AND SPECIFICATIONS FOR CAPITAL PROJECT 03-49 CURB, GUTTER, AND SIDEWALK REPAIR AND REPLACEMENT
FOR FOR FISCAL YEAR 2003-04 AND AUTHORIZING STAFF TO ADVERTISE THE PROJECT FOR BIDS WHEREAS, plans and specifications for the Curb, Gutter, and Sidewalk Repair and Replacement proj ect
have been prepared by the Town Engineer and duly filed with the Town Clerk; and WHEREAS, the Town Council of the Town of Lqs Gatos has reviewed said plans and specifications. NOW, THEREFORE,
BE IT RESOLVED THAT the Town Council hereby approves the plans and specifications for the Curb, Gutter, and Sidewalk Repair and Replacement Project. BE IT FURTHER RESOLVED THAT the Town
Clerk is hereby authorized and directed to advertise the Curb, Gutter, and Sidewalk Repair and Replacement project for bids in the manner prescribed by the Town Municipal Code. PASSED
