NOTICE OF RESCHEDULING THE PUBLIC HEARING CONCERNING THE
REORGANIZATION OF.L; NINHABITED TERRITORY TO THE TOWN OF
LOS GATOS KNOWN AS BLOSSOM HILL MANOR NO. 11
RECOMMENDATION:
Inform those present that the public hearing concerning the reorganization (annexation) of
uninhabited territory to the Town of Los Gatos know as Blossom Hill Manor No. 11 has been
rescheduled to Tuesday, February 17, 2004.
DISCUSSION:
Due to an error in the publication of the notice of public hearing for the annexation, the public
hearing had to be rescheduled. Per Section 56154 of the California Government Code, publication
of the public hearing must take place at least 21 days prior to the public hearing. That date is crucial
because CGC Section 57051 states, "Each written protest shall show the date that each signature was
affixed to the protest. All signatures without a date or bearing a date prior to the date of publication
of the-notice shall be disregarded for purposes of ascertaining the value of any written protests."
Because of the expeditious handling of the annexation, the public hearing date could be changed
without re-introducing the proceedings. A notice cancelling the public hearing for tonight was
mailed to property owners and registered voters on January 8, 2004. The correct notice was
published in the Los Gatos Weekly-Times on January 14, 2004.
Since publication of the notice has taken place, the Town Clerk can accept any protests that are
turned in at this meeting.
