FIGONE, TOWN MANAGER RENOTICING THE PUBLIC HEARING CONCERNING THE REORGANIZATION OF UNINHABITED TERRITORY TO THE TOWN OF LOS GATOS KNOWN AS BLOSSOM-HILL MANOR NO. 11 Due to another error in the publication of the notice of public hearing for the annexation, the public hearing needs to be renoticed. Per Section 56154 of the California Government Code, publication of the public hearing must take place at least 21 days prior to the public hearing. That date is crucial because CGC Section 57051 states, "Each written protest shall show the date that each signature was, affixed to the protest. All signatures without a date or bearing a date prior to the date of publication of the notice shall be disregarded for purposes of ascertaining the value of any written protests." Because of the expeditious handling of the annexation, the public hearing date could be changed without re-introducing the proceedings. A notice cancelling the public hearing for tonight was mailed to property owners and registered voters on January 8, 2004. The correct notice will be published in the San Jose Mercury-News on January 24, 2004. That still meets the 21 day noticing requirements for the February 17`' hearing. Since publication of the notice HAS NOT taken place, the Town Clerk CANNOT accept any protests that are turned in at this meeting. PREPARED BY: JOHN E.
