Preliminary Comments from HCD 2 Has been in the Housing Accountability Act (HAA) since 1990. Pertains to a residential development that has at least 20 percent low-income units or 100 percent moderate income units. The HAA indicates that a jurisdiction cannot use its Zoning or General Plan standards to disapprove any housing project that meets the affordability requirements. No applications under the Builder’s Remedy have come forward during the two previous Housing Element cycles when the Town missed the statutory deadline for adoption of the Housing Element.
