SUBJECT: Maintain a Ban on Cannabis Businesses in Los Gatos and Consider a Ballot
Measure to Tax Cannabis Businesses
REMARKS:
Since the initial publication of the report, staff has learned that Revenue and Taxation Code
Section 34011(f) currently precludes cities from taxing medicinal marijuana sales when a
customer provides a valid state-issued Medical Cannabis Identification Card and government-
issued identification. Staff will continue to monitor the law in this area.
This means that if Senate Bill 1186 passes, the Town would not be able to tax medical cannabis
delivery businesses. With this additional information, it may not be worthwhile to pursue a
ballot measure for a tax on cannabis businesses.
