SUBJECT: Adopt an Ordinance Amending Chapter 18, Article III, Entitled Minors and
Related to Social Host Liability for Parties at Which Underage Drinking and
Drug Use Occurs
RECOMMENDATION:
Adopt an Ordinance that was introduced at the Town Council meeting of April 19, 2022
amending Chapter 18, Article III, Entitled Minors and Related to Social Host Liability for Parties
at Which Underage Drinking and Drug Use Occurs.
DISCUSSION:
At its April 19, 2022 meeting, the Town Council voted 5-0 to approve amending the Los Gatos
Town Code Chapter 18, Article III, Entitled Minors and Related to Social Host Liability for Parties
at Which Underage Drinking and Drug Use Occurs.
Staff recommends that Council adopt an Ordinance amending the Los Gatos Town Code to
expand and hold adults responsible for underage use of intoxicants (alcohol, controlled
substances and/or cannabis) in their households whether or not the adults are present.

This report was coordinated with the Town Attorney’s Office and the Town Manager’s Office.

FISCAL IMPACT:
As with any Ordinance change, the Town does incur costs with Municode to incorporate the
modifications to the online and hardcopy versions of the Code. These expected expenditures
are budgeted annually.
ENVIRONMENTAL ASSESSMENT:
This is not a project defined under CEQA, and no further action is required.
