MINUTES OF THE SPECIAL PLANNING COMMISSION MEETING
OCTOBER 6, 2014
The Planning Commission of the Town of Los Gatos conducted a Special Meeting on Monday, October 6,
2014, at 7:00 PM.
MEETING CALLED TO ORDER
Chair Smith called the meeting to order at 7:00 pm.
ROLL CALL
Present: Chair Margaret Smith, Vice Chair Kendra Burch, Commissioner Mary Badame,
Commissioner Charles Erekson, Commissioner Tom O’Donnell, Commissioner Marico
Sayoc, and Commissioner Joanne Talesfore
Absent: None.
PLEDGE OF ALLEGIANCE
Commissioner O’Donnell led the Pledge of Allegiance. The audience was invited to participate.

Property Owner/Applicant: Hillbrook School/Mark Silver
Project Planner: Jennifer Savage
Requesting approval to modify a Conditional Use Permit to increase school enrollment and
modify operations of an existing private school (Hillbrook School) on property zoned HR -1. It
has been determined that this matter may have a significant impact on the environment and
an Environmental Impact Report (EIR) has been prepared as required by the California
Environmental Quality Act (CEQA).
Chair Smith opened the public hearing.
Jennifer Savage, Senior Planner, presented a staff report.

Commission members asked questions of Town Traffic Engineer Jessy Pu.
Commission members asked questions of Town Engineer Lisa Petersen.

Commission members asked questions of Planning staff.
Commission members discussed the matter.
MOTION: Motion by Vice Chair Burch to continue the hearing past 11:30 p.m.
Seconded by Commissioner Badame.
VOTE: Motion passed 7-0.
MOTION: Motion by Commissioner O’Donnell to certify Environmental Impact Report
EIR-13-001 as being in compliance with the California Environmental Quality Act.
Seconded by Commissioner Erekson.
VOTE: Motion passed 7-0.
MOTION: Motion by Chair Smith to approve Conditional Use Permit U-12-002, subject to
the conditions of approval as noted in Exhibit 7 of the staff report dated
September 24, 2014, as revised by the Commission at this meeting. The required
findings were made as noted in Exhibit 6 of the staff report dated September 24,
2014.
Seconded by Commissioner Erekson.
(INTERMISSION)
Commission members discussed the matter.
VOTE: Motion failed 3-4 with Commissioners Badame, Erekson, O’Donnell and
Talesfore opposing.
Commission members discussed the matter.
MOTION: Motion by Chair Smith to reconsider the motion as reported previously.
Seconded by Vice Chair Burch.
VOTE: Motion passed 4-3 with Commissioners Badame, Erekson and Talesfore
opposing.
MOTION: Motion by Chair Smith to adopt the previous motion.
Seconded by Vice Chair Burch.
VOTE: Motion passed 4-3 with Commissioners Badame, Erekson and Talesfore
opposing.
Planning Manager Joel Paulson cited the appeal rights.
