On September 24, 2014, September 30, 2014, and October 6, 2014, the Planning Commission
held public hearings and considered a request to modify a Conditional Use Permit (CUP) to
increase school enrollment, modify operations of an existing private school (Hillbrook School),
and certification of a Final Environmental Impact Report (EIR). On October 6, 2014, the
Planning Commission certified the EIR and approved the CUP modification.
Both the applicant, Hill brook School/Mark Silver and Patti Elliot et. al. filed an appeal of the
decision of the Planning Commission. The Town Council heard testimony and documentary
evidence from the appellants and all interested persons on the following dates: January 13, 2015,
February 17,2015, and March 17,2015. On March 17,2015, the Town Council adopted
Resolution 2015-018 denying the appeals of the decision of the Planning Commission and
approving a request to modify a CUP to increase school enrollment and modify operations of an
existing private school (Hillbrook School) subject to modified conditions of approval
(Attachment 3).
On November 3, 2015, the Town Council held a public hearing for a six month review of the
CUP to determine whether there was merit to increase the number of students based on Hillbrook
School 's compliance with the maximum number of daily trips . The Town Council approved the
request to increase the school enrollment by 33 students for the 2016-2017 school year.

On August 31 , 2016 , Hill brook School vested their CUP by increasing the number of students by
23 for the 2016-2017 school year (Condition #2, Exhibit 3). Hillbrook School is now subject to
the conditions of approval attached as Exhibit 3.
An annual review ofthe CUP is required by Condition #25 of Exhibit 3, which states "the
Planning Commission shall conduct an annual review to determine if the school is in compliance
with this Conditional Use Permit. If, at any reviews, the Planning Commission finds that the
school is in violation of this Conditional Use Permit or that new or more effective data collection
methods are available to compute traffic counts, then the Conditional Use Permit may be
modified and /or revoked as allowed under the Town Code. Compliance review shall be
completed at the school's expense."
PROJECT DESCRIPTION:
A. Location and Surrounding Neighborhood
The project is located at 300 Marchmont Drive, at the east end ofMarchmont Drive, south
of Shannon Road and east of Los Gatos Boulevard.
B. Zoning Compliance
The zoning designation, Hillside Residential (HR), allows a school pursuant to the
approved Conditional Use Permit.
C . Conditional Use Permit
The applicant is requesting approval for an additional33 students for the 2017-2018 school
year as permitted by Condition #15 (Exhibit 3). The applicant provided a letter of
justification (Exhibit 5) describing their compliance with their CUP which is outlined
below:
• Posted a list of the school's exception days and evening events on their publicly
accessible website (Condition #27 , Exhibit 3); and
• Re-organized the school's athletic program so that athletic competitions are held on
campus only three days per week and two days per week outside (Condition #5,
Exhibit 3); and
• Maintained a mandatory Traffic Demand Management Plan (TOM) (Condition #18,
Exhibit 3); and
• Installed and monitored the traffic count monitoring system (Condition #19 , Exhibit
3); and
• Enrolled no more than 348 students for the 2016-2017 school year. As of August
31,2016 there were 338 students enrolled (Condition #15 , Exhibit 3).

ANALYSIS:
A. Traffic
The Town's traffic consultant, W-Trans, completed a video review of the traffic count for
the fall2016 semester on October 4, October 5 , and October 6, 2016 as required by
Condition #19 ofExhibit 3. A report was prepared by W-Trans comparing the video count
data with the Sensys data which is provided in Exhibit 4. As detailed in the report, on these
three days vehicle trips did not exceed the maximum of 880 daily vehicle trips. The
average number of daily vehicle trips for the period of three days was 659.
For the day of October 5th, the manual count exceeded the Sensys data by more than five
percent (Condition #19, Exhibit 3); however, the manual count did not exceed Hillbrook's
maximum allowable vehicle trips of 880 . The average difference between the manual count
and Sensys data for the three day period was 2 .68 percent. As mentioned in the report by
W-Trans, the average difference between the Sensys data and the manual count did not
exceed five percent for the two other traffic count days. W-Trans also stated that the
average difference, overall, was less than five percent and is considered acceptable within
the margin of error for traffic counts (Exhibit 4).
Hill brook School may designate 1 0 days per year that can be removed from the maximum
number of daily vehicle trips and are referred to as "exception days" (Condition #17 a,
Exhibit 3). Exception days shall not exceed 960 maximum daily vehicle trips (Condition
#17 b, Exhibit 3). As discussed in the report by W-Trans, September 9, 2016 and
September 15 , 2016 of the fall2016 semester had been identified as exception days on
Hillbrook's school calendar. September 9, 2016 had 812 vehicle trips and September 15,
2016 had 756 vehicle trips, both days were under both the number of maximum daily
vehicle trips for an exception day and the maximum daily vehicle trips for a non-exception
day.
By increasing the number of students above 315, Hillbrook School vested the CUP and was
also required to install tube counters as a backup to the existing embedded counters
(Condition #19, Exhibit 3). The tube counters are located in both the entrance and exit
lanes just outside H ill brook School's gate. The tube counters count the total number of
trips , both entrance and exit trips. On September 21, 2016 W-Trans completed a site visit
to Hill brook School to review both the Sensys system and the backup tube counter. W-
Trans was able to see the two traffic count monitoring systems working in real time and
determined that both were functioning properly (Exhibit 4).
B. Environmental Review
An Environmental Impact Report (EIR) was certified by the Planning Commission on
October 6 , 2014 and no further environmental review is required.

PUBLIC COMMENTS:
Written notice was sent to property owners and tenants within 300 feet of the property. Staffhas
received emails from residents who have concerns regarding the annual review process and
request to increase student enrollment.
SUMMARY AND RECOMMENDATION:
A. Summary
Staff recommends that the Planning Commission take the actions in the recommendation
section below to grant the request for an additional 33 students for the 2017-2018 school
year as Hillbrook School is in compliance with their CUP.
B. Recommendation
Based on the analysis above, staff recommends approval ofthe request. Ifthe Planning
Commission finds merit with the request, it should:
1. Find that no further environmental analysis is required (Exhibit 2); and
2. Find that Hillbrook School is in compliance with their CUP (Exhibit 2).
ALTERNATIVES:
Alternatively, if the Commission has concerns with the request, it can:
1. Continue the matter to a date certain with specific direction; or
2. Deny the request.

It has been determined that this matter may have a significant impact on the environment
and an Environmental Impact Report (EIR) has been prepared as required by the
California Environmental Quality Act (CEQA). APNs 532-10-001 and 532-11-011.

TO THE SATISFACTION OF THE DIRECTOR OF COMMUNITY DEVELOPMENT:
Planning Division
1. APPROVAL: This application shall be completed in accordance with a11 of the conditions
of approval listed below.
2. EXPIRATION: The Master Plan approved May 7, 2001 (Resolution 2011-048) is vested.
The Conditional Use Permit modification will expire two years from the approval date
pursuant to Section 29.20.320 of the Town Code, unless the approval has been vested .
Pursuant to Town Code Section 29.20.335 an approval is vested when the activity approved
is commenced in a substantial, as distinguished from tentative or token, manner. For this
Conditional Use Permit, substantial shall mean · any increase in student enrollment abovCJ
315.
3. USE: The approved use is a junior kindergarten (JK) through eighth (8th) grade educational
institution/private school, with ancillary after school activities, after school care, and after
school sports.
a. HOURS: STUDENTS and their families may be on campus Monday through Friday,
7:30 a.m. to 6:00 p.m., during the academic calendar year (mid-August through mid-
June).
b. EXTENDED HOURS : Up to 10 times per year, hours may be extended past 6:00p.m.
up to 9:30p.m. The school's management and maintenance staff do not count towards
the 10 times per year for extended hours.
4. AFTER SCHOOL ACTIVITIES: Enrichment programs including but not limited to arts,
mechanics, engineering , and language for the school's students are permitted, up to 6:00
p.m., Monday through Friday, mid-August through mid-June.
5. AFTER SCHOOL SPORTS AND COMPETITIONS: Any sports, competitive or not, and
other competitions with at least one participating team from this approved school are
permitted up to 6:00 p.m ., Monday through Friday, mid-August through mid-June. These
competitions are permitted to occur a maximum 3 days per week, up to 2 days per week
outdoors .
6. AFTER SCHOOL CARE: Childcare for the school's students is permitted up to 6:00p.m.,
Monday through Friday, mid-August through mid-June.
7. VOLLEYBALL AND BASKETBALL TOURNAMENTS: A tournament is a series of
contests/matches/games between two or more schools/teams one of which must be the
approved school. Tournament hours are 7:30 a.m. to 3:30 p.m. Monday through Friday ,

and Saturday. Vehicles must be off campus by 4 :00p.m. on Saturdays. These tournaments ·
may occur up to 2 Saturdays, mid-August through mid-June.
8. EVENING/NIGHTTIME AND WEEKEND EVENTS: Evening/nighttime events are
events that occur between 6:00p.m . and 9:00p.m. Evening/nighttime and weekend events
are permitted up to I 0 times per academic year, mid-August through mid-June. These
events must be listed by August I 51 on a publicly accessible online School Calendar.
9 . OPEN HOUSE: One weekend Open House per calendar year is permitted 7:30a.m. to 3:30
p.m . (vehicles off campus by 4:00 p.m .), Saturday only (not Sunday), mid-August through
mid-June . This event does not count as one of the I 0 exception days from the maximum
number of daily vehicle trips.
10. DELIVERY HOURS: Deliveries shall only occur between 7:00 a.m. and 7:00 p .m .,
Monday through Friday.
11. SUMMER SESSION: A summer program is permitted between mid-June Wld mid-August
for six contiguous weeks. Summer hours are limited to 8:30 a.m. to 1:00 p.m., Monday
through Friday.
12. PROFESSIONAL DEVELOPMENT/CONFERENCES : Training for the parents of
enrolled students Wldlor the school 's faculty only is permitted from 7:30 am. to 6:00p.m.,
unless designated as a nighttime exception, Monday through Friday, mid-August through
mid-June. No other conferences are permitted.
13. THIRD PARTY USE/RENTAULEASE: Third party use is allowed . A third party use is
defined as a school program .run by an entity that is under a contractual partnership
agreement with the school, payments for participation in the activjty are .paid. directly to the
school, and the school has control of the operations of the activity. Any such third party
use will be subject to all of the conditions contained in this Conditional Use Permit.
14. ADDITIONAL ACTIVITIES : Any activity that is not expressly identified in this Permit is
prohibited.
15. NUMBER OF STUDENTS : The maximum number of students shall be limited to 414
students over the life of the Conditional Use Permit with an increase over 315 students of
up to 33 in year 2016-2017, up to an additional 33 in year 2017-20I 8, and up to an
additional 33 in year 2018-2019. The right to add any additional students is contingent on
the school's compliance with the traffic count requirements. The maximum number of
students during the summer session is 150.
16. INITIAL REVIEW: Six months after the date of this approval, the Town Council shall
review the school's compliance with the maximum number of daily vehicle trips. At a
publicly noticed hearing, Town Council will consider whether there is merit to increase the
number of students from 3 I 5 based on compliance with the maximum number of daily
vehicle trips. This review shall be completed at the school's expense.
17 . MAXIMUM NUMBER OF DAILY VEHICLE TRIPS: The maximum number of daily
vehicle trips shall not exceed 880 pursuant to the following:
a. The school may designate I 0 days per year that can be removed from the maximum
calculation, which shall be referred to as "exception days."
b. Exception days shall not exceed 960 maximum daily vehicle trips.
c. Exception days must be identified on a publicly accessible online School Calendar by

d . The maximum number of daily vehicle trips shall not exceed 300 during the summer
session as defined in condition 11 .

18. MANDATORY TRAFFIC DEMAND MANAGEMENT PLAN: The school shall
implement, at its expense, a Mandatory Traffic Demand Management Plan consisting of
any of the following means to limit daily vehicle trips: carpools, busing, shuttle buses,
traditional school buses, bicycling, walking management plans, or other methods submitted
by the school. The school must inform persons and entities, co vered by the plan, that
pickup and drop-offs are prohibited on public streets in the immediate vicinity of the
school. The school is solely responsible for enforcement of and compliance with a
Mandatory Traffic Demand Management Plan.
19 . TRAFFIC COUNT MONITORING: The school shall monitor its compliance using the
existing embedded counter and by installing tube counters as a backup. The data from the
counters will be used to determine whether the school has complied with the traffic
requirements contained in condition 17. The Town shall conduct ongoing traffic data
validation by contracting for a random manual traffic count for three days, each semester.
The data shall be compared with Sensys data (i.e, the embedded counter data) and results
provided to the Town Traffic Engineer. If the Town Traffic Engineer finds the school out
of compliance, the Town shall contract for additional data collection, with a one week
mechanical (hose) traffic count to verify the counts. The school shall be considered out of
compliance if any mechanical readings exceed the Sensys counts by more than five percent
and where the readings are above the maximum number of daily vehicle trips. If the
Sensys data continues to demonstrate ongoing non-compliance, the discrepancy shall
trigger the compliance proceedings portion of the CUP . The school is required to
reimburse the Town for all staff and contract services associated with this condition.
20. BUS STOPS: The school may continue to use bus stop locations negotiated with private
businesses. Any existing or new bus stop must be approved by the Los Gatos Parks and
Public Works Department as a suitable and safe place for a bus stop.
21 . P ARK.TNG : All parking shall be accommodated onsite.
22 . PICK-UP AND DROP-OFF AREA: A pick-up and drop-off area shall be maintained on
school grounds.
23. EMERGENCY ACCESS ROAD : The emergency access road to Ann Arbor Drive shall
not be opened up at any time to public or school use. The road may be opened for
construction access only if it is part of an approved construction plan for an Architecture
and Site application.
24. CURFEW AND NOISE: The school shall comply with the Town Code governing curfew
and noise levels with the exception of one amplified DJ event, mid-August through mid-
June (not summer).
25. ONGOING COMPLIANCE REVIEW: Upon completion of the six-month initial review
set forth in condition 16 , the Planning Commission shall conduct an annual review to
determine if the school is in compliance with this Conditional Use Permit. If, at any
reviews, the Planning Commission finds that the school i s in violation of this Conditional
Use Permit or that new or more effective data collection methods are available to compute
traffic counts, then the Conditional Use Permit may be modified and/or revoked as allowed
under the Town Code. Compliance review shall be completed at the school 's expense.
26. PENALTIES FOR EXCEEDANCES OF THE MAXIMUM DAILY TRIP CAP :
a . If the Town's Traffic Consultant 's review of the trip cap monthly monitoring reports
reveals that the number of trips exceeds the maximum dail y trip cap , the applicant shall
pay a penalty of $1,000 per d ay and $I 00 per excess trip.

b. If the Town 's Traffic Consultant's review of the trip cap monthly monitoring reports
reveals that the number of trips exceeds the maximum daily trip cap for a second
consecutive monitoring period, the applicant shall pay a penalty of $2,500 per day and
$250 per excess trip.
c . If the Town 's Traffic Consultant's review of the trip cap monthly monitoring reports
reveals that the number of trips exceeds the maximum daily trip cap for a third
consecutive monitoring period, the applicant shall pay a penalty of $5,000 per day and
$500 per excess trip.
d. Penalty money shall be paid to the Town and used towards neighborhood
traffic/pedestrian improvements as approved by the Town's Parks and Public Works
Director.
e. The school is not subject to fines in the first six months after the date of this approval.
27. NEIGHBORHOOD COORDINATION: The school shall post a schedule of events on a
website accessible to the public at the beginning of every academic calendar year.
28. GYMNASIUM DOORS AND WINDOWS: The loading doors on the Ann Arbor side shall
be closed at all times whenever activities are being held inside the gymnasium. The other
doors and windows in the gymnasium shall be allowed to remain open during activities .
29. SQUARE FOOTAGE: The maximum structural square footage is 55,715 square feet as
approved by the Master Plan on May 7, 2001 (Resolution 2011-048). The existing campus
is currently 52,683 square feet and an additional 3,032 square feet is pennitted in the
library and cafeteria/art classrooms with an approved Architecture and Site application .
30. BUILDING FOOTPRINTS: The footprints of the future buildings may be required to be
modified during the Architecture and Site approval process to reduce tree impacts.
31. TOWN INDEMNITY: Applicants are notified that Town Code Section 1.10.115 requires
that any applicant who receives a pennit or entitlement from the Town shall defend,
indemnify, and hold hannless the Town and its officials in any action brought by a third
party to overturn, set aside, or void the pennit or entitlement. This requirement is a
condition of approval of all such pennits and entitlements whether or not expressly set
forth in the approval, and may be secured to the satisfaction of the Town Attorney.

Subject: Hillbrook School2016 Monitoring -Fall2016
W-Trans ha s initiated the 2016-17 traffic monitoring of Hillbrook School in Los Gatos . We have verified the
functionality of the Sensys system and ensured that the backup pneumatic tube counters are functioning
properly. In addition to verifying the Sensys system, W-Trans has recently conducted three-day video counts (12
hours per count), manually counted from the video recording, at the location of the Sensys counters on October
4'h, S'h, and 61h, 2016from 7:00a.m. to 7:00p.m .. The purpose of this memo is to summarize the results of the three-
day counts and compare the data to Sensys data for the sa me time period. Overall, the Sensys counts are lower
than the video counts, but the average difference is les s than five percent.
Existing Condit ions
The Hill brook School is located at 300 March mont Drive in the Town of Los Gatos . According to Condition 17 of
the School's Conditio nal Use Permit, "the ma x imum number of daily vehicle trips shall not exceed 880 ." Th e Sc hool
has identified 10 exception days where they are permitted to excee d the maximum number of daily trips, however,
the total number of trips on these exce ption days shall not exceed 960. The sc hool m aintains two Se nsys
magnetomet er traffic co unters e mbedded in the pavem ent of the ex it lane outside the sc hool's gate,
approximately 10 feet apart. These magnetometers (Sen sys counters) are calibrated to d etect the presence of
vehicles and motorcycles but not bicycles or other non-motorized means of transportation. Hill brook School has
only one vehicular access point, and because of this it is assumed that all exi t trips also made an entrance trip
through this loca tion. Fo r reporting purposes, the maximum of either Exit A or Exit 8 is used to determine the
number of daily trips.
A permanent backup pneumatic tube counter, a MetroCount MC56000 Vehicle Classifier Sy st em, is locat ed In both
the entrance and exit lanes just outside of the School 's g at e . Pneumatic tube sys tems utilize rubber tubes pla ced
across traffic lanes in specific configurations. When a vehicle travels over the tube the air pressure in the tube is
co mpresse d and this com press ion triggers an event recording . Th e system i s programed to cla ss ify vehicl es based
on the dista nce between the front and rea r axle. The School 's MetroCount system counts the total number oftrips,
both e ntrance and exit trips.
During a site visit on September 21, 2016, Hill brook School staff provided W-Trans staff with a walk through of the
installatio n of the Sensys system and the M etroCount backup sys t e m. We were able to see, in real time, the system
counting vehicles with the data reporting online. While the Sensys system can be accessed remote ly online, the
MetroCo unt sy stem is local to the Sc hoo l's network. The Sc hool has ag reed t o actively provide W-Tran s with
backup d at a directly from the MetroCount system when necessary.

12-hour Manual Counts and Observations
Traffic counts were obtained on Marchmont Drive October4, 5, and 6 2016, from 7:00a .m. to 7:00p.m. These days
represent typical school days, there were no large school events or fieldtrips scheduled during the counts . The
manual counts were then compared to the Sensys data for the same time period in Table 1.

The video counts conducted by W-Trans were manually counted and reviewed to ensure accuracy. The video
counts were higher than the Sensys counts, and on one day there was a d ifference larger than five percent. The
average difference, overall, was less than five percent and should be cons idered acceptable within the ma rgi n of
error.
The video counts represent entrance and exit trips from 7:00 a.m. to 7:00 p.m., broken down into 15 minute
intervals. The Sensys counts represent the exit trips 7:00 a.m . to 7:00 p.m. In o rder to convert exit trips to both
entrance and exit trips, the ma ximum count from either Exit A or Ex it B was determined and then doubled
(assuming one trip in equal one trip out). Since the counts were for a defined time period, ending at 7:00 p .m. a
vehicle could be counted in the video counts as an entrance trip, but may have remained on campu s beyond the
end of the count period. The Sensys counts rely on ex it trips to calculate total trips and a vehicle remaining on
campus beyond the end of the count period would not be counted by the Sensys system.
Conclusions
• The video counts and the Sensys counts, on average, were within five percent of one another.
• The Sensys system and MetroCount backup system are functioning properly.
• During the first month and a half ofthe fall semester Hill brook School has not exceeded the maximum number
of daily trips (880) even on two exception days. Attached, in Table 2, is the daily summary of Sensys counts
through October 7, 2016.
• There has been one instance w here the Sensys counters did not register counts, on September 2, 2016 from
3:00 p.m. to 5:00p.m .; the School provided backup counts in one hour intervals di rectly from the MetroCount
system, in Excel format, attached for reference.
• Excluding weekends, there has been one instances where the difference between Sensor A and Senor B was
greater than five percent (5 %). However, since the number of daily trips is small, a change in one trip w ould
bring the difference under five percent.

• The largest daily difference between Sensor A and Sensor B was 18 trips on September 8, 2016. The average
daily difference for September was approximately si x trips.

We respectfully request that the Planning Commission confirm Hillbrook School 's right to enroll the
second tranche of 33 students as defined in our CUP . As the Planning Commission is aware, the Town
Council approved a new CUP for the school in March 2015 and approved our right to add the first
tranche of 33 students for the 2016-17 school year at a Town Council meeting on November 3, 2015.
We will vest the CUP as of August 31, 2016 by increasing our enrollment above 315 students.
We feel Hillbrook is fully in compliance with the new CUP. In particular, the school has :
e posted the exception days and a list of the evening events for the 2016-17 school year
on our publicly accessible neighborhood section of our website as of August 1, 2016.

e reorganized our athletic program so that we only have athletic contests on campus
three days a week and only two days outside
e maintained a robust and mandatory Traffic Demand Management plan (TOM plan).

e Installed and continued to monitor the traffic count monitoring system as approved
by the Town of Los Gatos.
e Worked with the Los Gatos Parks & Public Works department to ensure approval of
any new bus stops as explained in the CUP .
e enrolled no more than the 348 maximum number of students for the 2016-17 school
year (as of August 31, 2016, we expect to have 338 students enrolled).
We would also note that starting during summer 2017, we will reduce our summer programs to be in
compliance with the requirements described in the CUP .
During the 2015-16 school year, we continued to implement measures to manage our traffic and to
ensure we will be in compliance with the new CUP when it vests . We have an extensive Traffic
Demand Management Plan (TDM plan), that includes:
e A clear expectation of all families that they bike, walk, shuttle, or carpool to school each day.
e A Transportation Coordinator who oversees our TOM and ensures that families understand
the expectations and are given support in meeting the requirements .
e Three shuttles that bring students to and from school each day. For the 2015-16 school year,
we averaged 101 students taking the shuttle in the morning, and 93 students taking the
shuttle in the afternoon, which represents about 30 percent of our total student population.
e An active carpooling program, that includes online maps that help families identify carpool
buddies. The Transportation Coordinator supports families looking for carpool matches.
e Marching Mondays where large groups of students and parents walk to school together from
Blossom Hill Park . This weekly event encourages walking and has led to more regular walkers
and bikers to school.

e A traffic and safety monitor who provides a daily presence in the neighborhood as well as
extensive signage that reminds people to drive slowly through the neighborhood (25 mph on
Lower Marchmont and 15 mph on Upper Marchmont).
e Active participation in Safe Routes to School. Hillbrook is the only private school in Los Gatos
that is an active member of this important organization.
e Various measures to encourage employee carpooling and alternative transportation options,
including financial incentives for using alternative forms of transportation. We are also
piloting a set of Hillbrook bicycles for the 2016 -17 school year which will be available for
employee u sage .
During this past summer, we repaved and restriped our parking lot to allow us to improve the flow of
traffic onsite . The improvements will allow us to have shuttles line up alongside our JK-2 playground
area , an improvement in both safety and efficiency, and will also give us the option to add additional
shuttles in the future as appropriate.

up to 480 cars exiting campus):

The Planning Commission will see when it reviews our traffic from the 2015-16 school year that we
have continued to improve our counts and that we are successfully meeting the expectation of the
daily cap of 880 cars (or 440 cars exiting campus). In fact, for the 2015-16 school year, we had only
four days where we e xceeded the 440 car cap well within our exception day limit of 10 days (October
22-444, February 4 -447, February 25-445, and May 6-456).
We feel confident that the measures we have implemented these pa st few years will ensure we
remain in compliance with the traffic condition s as we increase our enrollment this year.
We look forward to the annual compliance review meeting conducted by the Planning Commis sion as
described in the CUP. We would respectfully request that this meeting take place in September so
that we are able to adequately prepare for the admission cycle for the 2017-18 school year.
We have worked hard to prepare for the successful implementation of this new CUP, and we continue
to make a concerted effort to be a positive member of the greater Marchmont neighborhood and the
Los Gatos community. We appreciate your time and consideration .

My friend and I were travelling East on Shannon road on Wednesday Sept .14,2016 around the end of school drop off
approx. 3pm. We left my street Hilow, it was Dead stopped with cars between the two stop signs of Cherry Blossom &
Shady View Rd.
I watched as a Hill brook School Bus just stopped briefly and EJECTED Students at the PUBLIC STOP SIGN ON TO THE
STREET RIGHT AT THE STOP SIGN AT SHADY VIEW DR .
No one from the bus got out to see students off the Bus . I did not observe any Safety or Crossing Representative from
the HILLBROOK for the students ..
There were PARENTS ON BOTH SIDES OF SHANNON RD . AND STUDENTS WERE RUNNING to the parking lot at Blossom
Hill Park, ALSO A PUBLIC PARKING LOT.
The parents cars were completely filling and parked on both sides of the full length of Shady View Dr. The problem and
Safety issue has just been moved over from Marchmont to Shady View.
Is it appropriate to be using a Public Stop Sign as a Bus Stop for a private school?
Aren't there liabilities for the Town of Los Gatos to allow that activity or is the Town not aware that this i s happen ing?
Hill brook should make arrangements with a private parking lot & provide insurance to that private property for the
transport of their Students.
Very sadly one of their Hillbrook Students wa s killed in a neighborhood car accident relating to school pick up & drop off
in The Mitty School neighborhood a short while ago ..
No one would want that to happen here.
Is it Greed that would want to make Hillbrook seek to increase their enrollment again while not provid i ng adequate
sa fety and concern for current student?
This has also been brought to my attention. It appears that the above described situation would fall into this category.
20. BUS STOPS : The school may continue to use bus stop locations negotiated with private businesses . Any existing or
new bus stop must be approved by the Los Gatos Parks and Public Works Department as a suitable and safe place for a

RELEVANT CUP CONDITIONS
15. NUMBER OF STUDENTS: The maximum number of students shall be limited to 414 students over
the life of the Conditional Use Permit with an increase over 315 students of up to 33 in year 2016 -
2017, up to an additional 33 in year 2017-2018, and up to an additional 33 in year 2018 -2019. The
right to add any additional students is contingent on the school's compliance with the traffic count
requirements. The maximum number of students during the summer session is 150. {emphasis
added)
25. ONGOING COMPLIANCE REVIEW : Upon completion of the six -month initial review set forth in
condition 16, the Planning Commission shall conduct an annual review to determine if the school is
in compliance with this Conditional Use Permit. If, at any reviews, the Planning Commission finds
that the school is in violation of this Conditional Use Permit or that new or more effective data
collection methods are available to compute traffic counts, then the Conditional Use Permit may be
modified and /or revoked as allowed under the Town Code . Compliance review shall be completed at
the school 's expense. {emphasis added)
Here's my question: If a CUP has been in effect for only a month, should that CUP be evaluated as if it
has been in effect for a year?
I've put two conditions from the Hillbrook CUP on the overhead because I believe they show that
Hillbrook should NOT be allowed an enrollment increase for 2017-2018 at this time.
Hillbrook's CUP took effect on August 31, 2016. Now, less than a month later, you are asked to do an
annual review to evaluate whether Hillbrook has complied with this CUP. That gives you 28 days-worth
of data on which to base your "annual" review ... and this data is not actually even available until
October. I hope you will agree that less than a month's worth of data is not enough for an "annual"
review.
Hill brook increased its student body by 24 students in August for this academic year. At th is point, we
have 28 days-worth of data on the impact of that increase . This is not enough data to see whether
Hillbrook can comply with its traffic limit of 880 daily trips with an increased enrollment.
Condition 25 in the just-vested CUP says the following: "The Planning Commission shall conduct an
annual review to determine if the school is in compliance with this Conditional Use Permit." Since the
annual review is meant to check on compliance with the new CUP , it should be conducted annually-not
one month after the CUP has been accepted.
Furthermore, Condition 15 about the number of students allowed at the school says the following: "The
right to any additional students is contingent on the school's compliance with the traffic count
requirements ."
The intent of this condition was to see if Hillbrook could keep its traffic below 880 car trips per day when
it increased its enrollment. During its campaign for an enrollment increase, Hillbrook claimed it could
increase its student body without increasing traffic. Condition 15 was meant to be a check on whether
Hill brook could meet its claim . And figuring out whether Hillbrook CAN meet its claim with the
additional 24 students requires more than 28 days -worth of data .
Condition 15 does include an expectation that an enrollment increase will be permitted for the 2017-
2018 school year. However, the school must prove it ca n control its traffic with an enrollment increase
before it is allowed to have another increase. Again, one month's worth of data is not enough proof.
The intent of the annual review was to see how Hill brook behaved and whether it met traffic
expectations a year after the CUP went into effect. In this situation, just one month will have passed
before the so-called annual review would take place.
WHY DIDN'T HILLBROOK ACCEPT THE NEW CUP SOONER? Since the new CUP was approved in March
2015, a year and a half ago, a good question to ask is why the CUP didn't go into effect until just this
past August. If Hillbrook had accepted the CUP when it was approved, an annual review at this time
would make a little bit more sense . It appears that Hillbrook didn't want to comply-and in fact did NOT
comply-with all the elements of the new CUP . For example, even though the new CUP requires
Hillbrook to end summer programs by 1 PM , Hill brook ran its summer programs to at least 4:30 PM
during the two past summers.
SO HOW IS TRAFFIC NOWADAYS? I believe traffic on Marchmont Drive has improved. Neighbors tell me
that some Hill brook parents continue to either park clo se by on Cardinal and Stonybrook and have their
kids walk the last small distance to school or drop their kids at Hilow and have them walk from there.
The idea behind the CUP was that Hill brook would reduce its traffic throughout the neighborhood---not
ju st on Marchmont and at the gate where car t r ips are counted--through carpooling and busing . The
shuttle buses that stop on Shannon near Hilow and on Kennedy at Englewood also seem to be
con t inuing to cau se seriou s traffic backups at key commute times. They also seem to be creating a
certain amount of mayhem as many parents park in non-permitted spaces and in the Blossom Hill
parking lot and as children dash across the street.
However, the issue today is NOT traffic. I am just here to ask that Hill brook be required to adhere to the
new CUP and have its compliance with the new CUP evaluated after a reasonable period of time, not
after just a month .
Please Think About the Potential Impact of 24 New Students . Hill brook did, indeed, exceed its 880
traffic limit a couple of times last year before the new students were added . On other occasions the
school came very close to the 880 limit. Keep in mind that in a worst case scenario, if each of the new
students were transported individually in a car (as is quite common with Hillbrook because carpooling
has not really taken hold), there would be 96 additional trips (24 entering in the morning, 24 exiting in
the morning, 24 entering in the afternoon, 24 exiting in the afternoon). That's why it's impo rtant to wait
and see how Hillbrook does with its increa sed en r ollment before allowing for another increase .
This review and the second review are the only safeguards the neighborhood has against dramatic
traffic increases that can come with enrollment increases. We hope you will agree that permitting
Hillbrook to increase its enrollment using an annual review based on one month's data makes no sense
and does not fulfil the requirements of the CUP .

I was informed today by Mr. Paulson that Hillbrook's compliance with its new CUP is up
for its "annual" review before the Planning Commission on September 28th.
In a June 2 , 2016 email from you , you stated, "The CUP vests when the actual
attendance at the school exceeds 315 students . The Town understand that Hillbrook is
moving forward to enroll more students for the fall. However, enrollment on its own does
not vest the CUP. On the first day of school when we have an actual student count, we
will know if the CUP has vested ."
According to Mark Silver's September "Neighborhood Newsletter, " as of the first day of
school, August 31 5 t. Hillbrook now has 339 students enrolled . By your assessment, the
new CUP vested on August 31 , 2016. How can there be an annual assessment for
compliance and a potential additional enrollment increase , based on less than 20 days
of school?
The initial weeks of school are not typical in that the sports programs and other after
school activities, which account for a large part of the daily traffic, take a while to begin .
Indeed, before September 28th there is only one home sporting event on one day
(September 20). That is not typical, as is evident by the Hillbrook calendar:

Hillbrook waited until the end of the 2015-16 school year to indicate that it would accept
the new CUP. The fact that it delayed its decision does not entitle it to a review of its
annual compliance less than one month into the vesting of the CUP . That is not what
was intended by the dates contained in the CUP . This review should not occur until after
a full year under the new CUP.
There are numerous measures in the CUP of Conditions that are to be evaluated, that
should not legitimately be based on less than one month under the new CUP.
Moreover, as indicated by the fact that Hill brook did not enroll the full 33 additional
students there were granted (only enrolling 24), Hillbrook does not need a further
permission to increase enrollment at the time .
Please clarify what it is that is scheduled to take place on September 28th.

Hillbrook School Bus Concern
Just a quick note to mention that drivers are not stopping for the (3) Hillbrook school busses on Kennedy
Road in the morning. I was on the opposite side of the road and stopped today, but cars behind honked
at me to proceed. The cars were backed up all the way past Englewood through the Stop sign . I don't
think people are fully aware of the driving laws surrounding school busses and concerned that by abiding
so I am creating more traffic. This issue needs to be-addressed.

Hillbrook meeting, Oct. 17 -regarding traffic on Shannon
I'd like to add my observation to the traffic on Shannon Road that is impacted by the bus stop in front of Blossom Hill
Park.
We walk to school at Blossom Hill around 7:50am along Shannon Road and the Hillbrook bus is usually there
between 7:45 and 7:50am. It stops at the stop sign in front of the park while the Hillbrook students embark. Of
course , cars are not allowed to pass a bus during a stop because it's not safe , so it causes quite a back-up, often to
almost Short Road. Just as the traffic starts to lighten from this stop, the car traffic heading to Blossom Hill School
starts to increase for the 8:07 start time.
If it's legal , it seems like it'd be great if the Hill brook bus could stop inside the parking lot of the park , since the cars
in the lot at that hour are primarily parked there for the bus and could leave after the bus pick-up is done. This way
the car traffic could continue to move along on Shannon Road .
Also, I know this is a bit further past Hilow Road but the crossing guard by the fire station on Shannon stops traffic
for every pedestrian or bicyclist. Observing other intersections, it seems the more traffic-efficient way to keep cars
moving is to have pedestrians and bikes gather in a group and once several groups are waiting, then have cars stop
and wait for them to cross. I think this is also causing a big back-up along Shannon Road.

SUBJECT: BACKGROUND INFORMATION ON THE HILLBROOK ISSUE
Dear Planning Commissioners:
On September 20, I submitted a letter about the Hillbrook annual review. Below is additional
information I hope you will consider as you rev iew the issue .
Hillbrook's Mandatory Traffic Mitigation Program. The CUP requires Hill brook to have a traffic
mitigation program, and Hillbrook does have such a program. The program provides buses and shuttles
and asks parents to use carpooling, busing, walking, and biking . However, participation in Hillbrook's
traffic program is completely voluntary. Parents are not requi r ed to take part in busing, shuttl ing,
carpooling, walking, or bik ing . Hillbrook, I believe, asks parents at the beginning of the year to tell the
school how they will be transporting their children to school . However, there is no commitment. Parents
don't have to use the transportation method they claim they will be using. Many private schools require
parents to commit to a traffic reduction method at the beginn ing of the school year and have methods
for checking on whether parents are following through on their commitment. Because Hillbrook does
not require parents to commit to any form of traffic mitigation, we still see large numbers of cars
transporting just one student to and from Hillbrook. In addition, because Hillbrook doesn't know how
parents will be getting their children to school, it can't ever predict how much traffic it will generate on
any given day.
When Hillbrook Traffic Is Heaviest. The on ly month for which you will have traffic data following the
vesting of the new CUP and following the addition of 24 new students (both occurred on August 31,
2016) is September 2016. However, September is not a good month on which to base an evaluation.
Hillbrook traffic is heaviest when it i s cold and/or rainy. September has quite mild, dry weather, so
walking and biking to school are easier and more common than at other times. In addition, Hillbrook has
its heav i est traffic in January and February when Hillbrook hosts its largest number of afterschool
interschool sports events on campus. There were only 3 afternoons with afterschool interschool events
in September, another reason why September is a bad month to use in judging Hillbrook traffic. In
January and February, Hillbrook generally has about 12 -15 days on which it hosts two to three sports
events. These events draw parents from other schools as well as Hillbrook parents. (The sports calendar
for this academic year has not yet been publicly posted .)
Problems w i th the Shuttle. Several people have reported problems w ith the large shuttle bus that parks
at the stop sign on Shannon across from Shady View. Hillbrook parents use this shuttle bus to take their
ch ild r en the last small distance to the school. In both the morning and afternoon, the parents park in the
neighborhood and wait for the bus.
Unfortunately, this large bu s causes serious traffic backups at key comm ute times. Thi s stop also seems
to create a certain amount of mayhem as many pa r ents park in non-permitted spa ces on Shan n on, on
Shady View, and in the Blossom Hill parking lot at drop-off and pick-up times and as children dash across
the street.
Please note that there is no parking allowed on Shannon. Residents worked for many years to get the
Town to agree not to allow parking all along Shannon , and there are "no parking" signs all along the
street.
The original intention, at least based on the hearings, was that the shuttles would be used by children
who were walking to school; the children would use the shuttles for the last stretch to school. However,
things have turned out quite differently. The traffic engineers who worked with Hillbrook to develop a
traffic mitigation program recommended the idea of a remote parking lot. The school and parents seem
to be using the Shannon shuttle location as the suggested remote parking lot.
I believe Hillbrook also continues to have a shuttle that parks at the corner of Kennedy and Englewood.
In the past, this shuttle also caused serious traffic backups at key travel times.
Afternoon Shuttles. In order to alleviate afterschool traffic generated by afterschool activities, Hill brook
provides small shuttle buses that run every 15 minutes. These buses pick up children at school and drop
them off at the Shir Hadash parking lot, where parents are allowed to wait. We wonder why the Shir
Hadash parking lot could not be used for the Shannon shuttle as well . The Shir Hadash parking lot would
be an actual parking lot and would remove the large shuttle bus from the heavy traffic that occurs on
Shannon, particularly at drop-off and pick-up times.
Approval for Shuttles. The CUP requires that bus stop locations be approved by the Los Gatos Parks and
Public Works Department. Here is the condition .
Condition 20. BUS STOPS : The school may continue to use bus stop locations negotiated
with private businesses. Any existing or new bus stop must be approved by the Los Gatos
Parks and Public Works Department as a suitable and safe place for a bus stop.
I talked with Matt Morley about the Shannon stop around September 20 . He said that the stop
had been checked in early September by one of the traffic engineers but that the engineer had
not had time to write a report because he had to be out of the country for a family emergency .
Mr. Morley said that the engineer had found the stop to be safe, but Mr. Morley did not know
the date or time of day of the inspection. I asked Mr. Morley to let me know when the report
became available; I haven't heard from him yet.
I wonder if a more formal approval process could be requested since there have been a
significant number of complaints about the location of this stop. It seems that public input on
this location would be appropriate as part of any approval process.

Hillbrook Bus on Shannon Road
I am not sure who to direct this too, but I have been made aware of a review of traffic issues r egarding Hillbrook.
I am not officially "complaining" about Hill brook traffic in general as I do not live in the neighborhood of the school. I Do
however, live up Shannon Road and need to drive my children down to middle and high school daily in los Gatos. I have
noticed a bus that stops just past the intersection where Shannon is passing Blossom Hill Park . The bus, stops, loads
kids, and then continues on to take a left turn on Englewood .
The problem is that, when the bus stops, either all traffic must stop and wait, and this is a VERY busy commute time
down Shannon . Traffic gets backed up pretty quickly waiting for that bus. OR, WORSE, I have seen some drivers ignore
the bus stop sign and flashing lights and go ahead and pass the bus anyway (very dangerous for loading kiddos and also
not legal).
My hope would be that the bus could load in a less busy and dangerous area. I am not sure where that would be. I do
appreciate that Hillbrook is trying to keep the traffic down in the neighborhood by using the bus, but they have managed
to impact traffic on Shannon negatively.

The entire basis for the step increases in Hillbrook's enrollment over three years was to insure
that Hillbrook would consistently control its traffic and comply with all other CUP provisions
throughout the school year and summer,-even with increases in its enrollment. There was to be
annual confinnation of compliance with the 2015 CUP provisions before additional
enrollment increases would be permitted
Although the Town enacted the 2015 CUP on March 17, 2015, Hillbrook made the strategic
decision to delay acceptance of the new CUP until August 31 , 2016. Hillbrook did not comply
with the 2015 Summer Se~ion CUP provisions throughout the summer of 2016. Hillbrook
did increase its enrollment as of August 31, 2016, and now has the right to admit up to 348
students (up from 315).
Provision #25 in the 2015 CUP states that: ''the Planning Commission shall conduct an
annual review to determine if the school is in compliance with this Conditional Use
Permit." Hillbrook's decision to delay accepting the March 2015 CUP until August 31,2016,
means that the "annual review'' it now seeks· is based on only one month of experience under
the 2015 CUP.
Allowing another increase now is premature and entirely negates the incremental process of
"annual review" established in the 2015 CUP. The first "annual review'' should be conducted
in September 2017, after a full year of experience under the 2015 CUP.
Please do not conduct any evaluation of a further enrollment increase for Hillbrook until
September 2017, when a full annu31 review ·ean take place.

Dear Planning Commissioners:

Please, let's abide by the terms of the CUP and do not conduct any evaluation of a further enrollment increase
