The proposed project would occupy a vacant space in an existing commercial shopping center.
The subject space is one of 17 commercial spaces located on the property. An eighteenth space
is located on a separate parcel on the comer ofUnion Avenue and Los Gatos-Almaden Road.
PROJECT DESCRIPTION:
A. Conditional Use Permit
The applicant is requesting approval to operate a coffee shop with prepared food items and
outdoor seating (Starbucks) in a 2 ,300-square foot tenant space previously occupied by
Bella Casa Consignment and Barefoot Coffee (current tenant space was formerly two
tenant spaces). Town policy considers the use to be a restaurant, since the business
includes seating and offers food and/or drinks items that are not pre-packaged. A
Conditional Use Permit (CUP) is required for operation of this type of business.
The maximum hours of operation would be 4 :30 a.m. to 11 :00 p .m. seven days a week.
The applicant provided a description of the business and letter of justification (Exhibit 4)
describing the proposal.
When reviewing a CUP, the deciding body should consider the information in the
applicant's business plan; however, the key consideration should be the explicit proposed
use since the business plan can change from owner to owner. The explicit use may be, and
is often, defined in the recommended conditions of approval as a "use" condition. The

CUP runs with the land, and the deciding body should review applications based on the
explicit use as opposed to the applicant or the applicant's business plan.
B. Location and Surrounding Neighborhood
The project site is located on the southeast corner of Union A venue and Los Gatos-
Almaden Road in the southeast corner of the property (Exhibit 1). Commercial uses border
the property to the north and east; residential and commercial uses border the property to
the south; and residential uses border the property to the west.
C . Zoning Compliance
The zoning designation allows re staurants, subject to the approval of a CUP.
ANALYSIS:
A . Project Summary
The project would occupy a 2 ,300-square foot commercial space within an existing
commercial shopping center for a coffee shop with outdoor seating (Starbucks). Starbucks
would serve coffee and tea beverages along with prepared food items. The food items are
prepared in an off-site commissary and heated in a convection oven on-site for customers.
No commercial cooking facilities or equipment are proposed for the application. The
project would not result in an increase of average daily trips (ADT) or peak hour trips. The
applicant is proposing to operate during the following hours:
Monday-Sunday I 4 :30a.m.-11 :00 p.m.
The applicant is proposing a maximum of 64 seats, 54 indoor and 1 0 outdoor. The
applicant provided a project description and letter of justification (Exhibit 4) describing the
proposal.
B. Parking
The commercial shopping center has 352 parking spaces (342 plus 10 ADA spaces). The
proposed use requires 21.3 parking spaces. As shown in the table on page 4 of the staff
report, the proposed use and the exi sting uses would meet the parking requirements.

C. Conditional Use Permit Findings
In order to grant approval of a Conditional Use Permit, the deciding body must make the
following findings:
(1) The proposed use of the property is essential or d es irable to the public convenience or
welfare; and
(2) The proposed use would not impair the integrity and character of the zone; and
(3) The proposed use would not be detrimental to public health, safety or general welfare;
and
(4) The proposed use of the property is in harmony with the vari ous elements or
objectives of the General Plan and the purposes of the Town Code.
In regards to the first finding , the proposed use is desirable to the public convenience
because it provides a place of gathering for the co mmunity. As required by finding two ,
the proposed use would not impair the integrity of the zone, because the proposed use is a
commercial use and would be located in a commercial zo ne. In regard s to the third finding,
the use would not be detrimental to public health, safety or general welfare, and the
conditions regarding the operating hours and maximum number of seats placed on the

penn it would maintain the welfare of the community. In regards to the final finding, the
proposed use is in harmony with the General Plan and Town Code.
D. General Plan
The goals and policies of the 2020 General Plan applicable to this project include but are
not limited to:
• Policy LU-2 .1 -Minimize vehicle miles traveled for goods and services by allowing
and encouraging stores that provide these goods within walking distance of
neighborhoods in Los Gatos.
• Policy LU-9.2 -Maintain a variety of commercial uses , including a strong Downtown
commercial area combined with Los Gatos Boulevard and strong neighborhood
commercial centers to meet the shopping needs of residents and preserve the small-
town atmosphere.
• Policy LU-9.6-Encourage development that maintains and expands resident-oriented
services and/or creates emp loyment opportunities for local residents consistent with
overall land use policies of the Town.
E. Environmental Review
The project is Categorically Exempt pursuant to the adopted Guidelines for the
Implementation of California Environmental Quality Act, Section 15301 : Existing
Facilities. No significant effect on the environment will occur since the project uses an
existing structure with no increase in floor area.
PUBLIC COMMENTS:
At this time, the Town has not received any public comment.
CONCLUSION AND RECOMMENDATION:
A. Conclusion
Staff has recommended conditions of approval regarding the maximum number seats and
operating hours . The site has adequate parking to accommodate the proposed use. The
proposed use would close by 11 :00 p.m . each day. The proposed use is in conformance
with Town Code and is consistent with the General P lan.

B. Recommendation
Staff recommends approval of the proposed project. If the deciding body concurs with
staff's recommendation, it should:
1. Find that the proposed project is categorically exempt, pursuant to Section 15301 of
the California Environmental Quality Act as adopted by the Town (Exhibit 2); and
2. Make the required findings as required by Section 29.20.190 of the Town Code for
granting approval of a Conditional Use Permit (Exhibit 2); and
3. Approve Conditional Use Permit application U-15-012 with the conditions contained
in Exhibit 3.
If the Commission has concerns with the proposed use, it can:
1. Approve the application with additional and/or modified conditions of approval; or
2. Continue the application with direction to a specific hearing date; or
3. Deny the application.

TO THE SATISFACTION OF THE DIRECTOR OF COMMUNITY DEVELOPMENT:
Planning Division
1. APPROVAL: This application shall be completed in accordance with all of the conditions
of approval listed below and in substantial compliance with the plans approved and noted
as received by the Town on February 5, 2016. Any changes or modifications to the
approved plans shall be approved by the Community Development Director, the
Development Review Committee, the Planning Commission, or Town Council, depending
on the scope of the changes.
2. EXPIRATION: The approval will expire two years from the approval date pursuant to
Section 29.20.320 of the Town Code, unless the approval has been vested.
3. USE: The approved use is for a restaurant (Starbucks) with outdoor seating. No
commercial cooking facilities or equipment shall be permitted.
4. SEATS: The maximum number of seats (inside and outside) shall not exceed 64.
5. HOURS OF OPERATION: Maximum hours of operation are 4:30a.m. to 11:00 p.m.,
seven days a week.
6. ENTERTAINMENT: Live entertainment is not allowed.
7. DELIVERIES: Deliveries shall occur between 7:00 a.m. and 10:00 p.m.
8. TAKE-OUT CONTAINERS: Any take-out food shall be served in recyclable containers.
9. ENVIRONMENTAL HEALTH APPROVAL: The applicant shall submit plans to the
County of Santa Clara Department of Environmental Health for review prior to
commencement of use. The applicant shall provide a copy of the approval from the County
of Santa Clara Department of Environmental Health prior to commencement of use and /or
issuance of building permits.
10. SIGN PERMIT: A Sign Permit from the Los Gatos Community Development Department
must be obtained prior to any changes to existing signs or installation of new signs.
11. CERTIFICATE OF USE AND OCCUPANCY: A Certificate ofUse and Occupancy from
the Los Gatos Community Development Department must be obtained prior to
commencement of use.
12. BUSINESS LICENSE: A business license from the Town of Los Gatos Finance
Department must be obtained prior to the commencement of any new or change of use.
13. TOWN INDEMNITY: Applicants are notified that Town Code Section 1.10.115 requires
that any applicant who receives a permit or entitlement from the Town shall defend,
indemnify, and hold harmless the Town and its officials in any action brought by a third
party to overturn, set aside , or void the permit or entitlement. This requirement is a

condition of approval of all such permits and entitlements whether or not expressly set
forth in the approval, and may be secured to the satisfaction of the Town Attorney.
14. COMPLIANCE MEMORANDUM : A memorandum shall be prepared and submitted with
the building plans detailing how the Conditions of Approval will be addressed.
Building Division
15. PERMITS REQUIRED: A Tenant Improvement Building Permit shall be required for the
alteration to the existing commercial building. Separate permits are required for electrical,
mechanical, and plumbing work as necessary.
16. CONDITIONS OF APPROVAL: The Conditions of Approval must be blue-lined in full on
the cover sheet of the construction plans. A Compliance Memorandum shall be prepared
and submitted with the Building Permit application detailing how the Conditions of
Approval will be addressed.
17. SIZE OF PLANS: Four sets of construction plans, minimum size 24" x 36", maximum
size 30" x 42".
18. TITLE 24 ENERGY COMPLIANCE: All required California Title 24 Energy Compliance
Forms must be blue-lined (i.e. sticky backed) onto the plans including lighting compliance
and mandatory measures.
19. TITLE 24 ACCESSIBILITY -COMMERICAL: For any proposed Tenant Improvements,
on-site parking and general path of travel shall comply with the latest California Title 24
Accessibility Standards. Work shall include, but not be limited to, accessibility to building
entrances from parking facilities and sidewalks. The building shall be upgraded to comply
with the latest California Title 24 Accessibility Standards. Necessary work shall be first
investigated by the design Architect and then confirmed by Town staff. See Advisory
Comment 1 O.b.
20. TITLE 24-RESTAURANT USE: Proper size grease trap shall be required for any
restaurant use. The following agencies will review the grease interceptor requirements
before issuance of the building permit:
a. West Valley Sanitation District (WVSD): (408) 378-2407
b. San Jose/Santa Clara County Water Pollution Control Plant: (408) 945-3000
c. Santa Clara County Environmental Health Department: (408) 918-3479
d. Town Public Works Department: (408) 399-7530
21. WATER POLLUTION CONTROL PLANT PRETREATMENT LETTER: This restaurant
requires certification and approval from the Environmental Services Department of the San
Jose/Santa Clara County Water Pollution Control Plant. Please contact the agency directly
at (408) 945-3000 to obtain application and certification requirements. Provide a copy of
the pretreatment letter for this project from the Environmental Services Department to the
Town Building Official, prior to permit issuance for the Tenant Improvements. The
Environmental Services Department will forward a copy of the certification to the West
Valley Sanitation District for verification of the grease interceptor si z ing.
22. APPROVALS REQUIRED: The project requires the following departments and agencies
approval before issuing a building permit:

23. ADVISORY COMMENTS for TENANT IMPROVEMENTS:
a. In addition to all new work complying with the Code for accessibility, when existing
Buildings are altered or remodeled they must be made accessible to persons with
physical disabilities in accordance with the CBC Section llB-202, "Accessibility for
Exi sting Buildings". Existing accessibility features and/or elements required to be
accessible in order of priority include: (a) Accessible main entrance with required
signage and proper door hardware that does not require tight grasping; (b)
Accessible route to altered area (including parking space and path of travel from
public way); (c) Accessible Restrooms; (d) Accessible indoor and outdoor seating
b. Where the cost of alterations or remodeling is less than a threshold amount
(currently at $150,244.00) and the cost to provide all those features listed above is
disproportionate to the improvement costs (i .e . more than 20% of the budget), then
the Owner is only required to provide disabled access upgrades to 20% of the budget
cost for alterations with the approval of the Building Official. Please obtain the
Town 20% Rule Form from the Town Permit Counter or download from the Town
of Los Gatos website at www.losgato sca .go v and completely fill it out showing all
the required upgrades that will be provided and their costs . This form must be
permanently affixed (i .e. blue-lined, sticky-backed) to the plans .
TO THE SATISFACTION OF THE DIRECTOR OF PARKS AND PUBLIC WORKS:
Engin eering Division
24 . GENERAL: All public improvements shall be made according to the latest adopted Town
Standard Drawings and the Town Standard Specifications. All work shall conform to the
applicable Town ordinances. The adjacent public right-of-way shall be kept clear of all job
related dirt and debris at the end of the day . Dirt and debris shall not be washed into storm
drainage facilities. The storing of goods and materials on the sidewalk and/or the street
will not be allowed unless an encroachment permit is issued . The developer's
representative in charge shall be at the job site during all working hours . Failure to
maintain the public right-of-way according to this condition may result in the Town
performing the required maintenance at the developer's expense.
25. CHANGE OF OCCUPANCY: Prior to initial occupancy and any subsequent change in use
or occupancy of any non-residential condominium space, the buyer or the new or existing
occupant shall apply to the Community Development Department and obtain approval for
use determination and building permit and obtain inspection approval for any necessary
work to establish the use and/or occupancy consistent with that intended .
26. PARKING: Any proposed parking restriction must be approved by The Town of Los
Gatos, Community Development Department.
27 . TRAFFIC IMPACT MITIGATION FEE : The developer shall pay the project's
proportional share of transportation improvements needed to serve cumulative development
within the Town of Los Gatos. The fee amount will be based upon the Town Council
resolution in effect at the time the building permit is issued. The fee shall be paid before
issuance of a building permit. The traffic impact mitigation fee for this project shall be
calculated from the final plans using the current fee and rate schedules in effect at the time
the building permit is issued, using a trip generation rate based on the comparison of
existing and proposed uses.
28 . CONSTRUCTION STREET PARKING: No vehicle having a manufacture's rated gross
vehicle weight exceeding ten thousand (10,000) pounds shall be allowed to park on the
portion of a street which abuts property in a residential zone without prior to approval from
the Town Engineer.
29. CONSTRUCTION NOISE: Between the hours of8:00 a.m. to 8:00p.m., weekdays and
9:00a.m. to 7:00p.m. weekends and holidays , construction, alteration or repair activities
shall be allowed. No individual piece of equipment shall produce a noise level exceeding
eighty-five (85) dBA at twenty-five (25) feet from the source. If the device is located
within a structure on the property, the measurement shall be made at distances as close to
twenty-five (25) feet from the device as possible. The noise level at any point outside of
the property plane shall not exceed eighty-five (85) dBA.
30. CONSTRUCTION MANAGEMENT PLAN: The Applicant shall submit a construction
management plan that shall incorporate at a minimum the Earth Movement Plan, Traffic
Control Plan, Project Schedule, site security fencing, employee parking, construction
stagi ng area, materials storage area(s), construction trailer(s), and proposed outhouse
locations.
31. WVSD (West Valley Sanitation District): Sanitary sewer laterals are televised by West
Valley Sanitation District and approved by the Town of Los Gatos before they are used or
reused. Sanitary Sewer Clean-out is required for each property at the property line or
location specify by the Town.
32. SANITARY SEWER BACKWATER VALVE: Drainage piping serving fixtures which
have flood level rims less than twelve (12) inches (304.8 mm) above the elevation of the
next upstream manhole and/or flushing inlet cover at the public or private sewer system
serving such drainage piping shall be protected from backflow of sewage by installing an
approved type backwater valve. Fixtures above such elevation shall not discharge through
the backwater valve, unless first approved by the Building Official. The Town shall not
incur any liability or responsibility for damage resulting from a sewer overflow where the
property owner or other person has failed to install a backwater valve as defined in the
Uniform Plumbing Code adopted by the Town and maintain such device in a functional
operation condition. Evidence of Wes t Sanitation District's deci sion on whether a
backwater device is needed shall be provided prior to issuance of a building permit.
33. GREASE TRAPS: Meet all requirements of the Santa Clara County Health Department
and West Valley Sanitation District for the interception, separation or pretreatment of
effluent.
34. GOOD HOUSEKEEPING: Good housekeeping practices shall be observed at all times
during the course of construction. All construction shall be diligently supervised by a
person or persons authorized to do so at all times during working hours. The storing of
goods and/or materials on the sidewalk and/or the street will not be allowed unless an
encroachment permit is issued by the Engineering Division. The adjacent public right-of-
way shall be kept clear of all job related dirt and debris at the end of the day. Dirt and
debris shall not be washed into storm drainage facilities. The storing of goods and
materials on the sidewalk and/or the street will not be allowed unl ess an encroachment
permit is issued. The developer's representative in charge shall be at the job site during all
working hours. Failure to maintain the public right-of-way according to this condition may
result in the Town performing the required maintenance at the developer's expense.
35. COVERED TRUCKS: All trucks transporting materials to and from the site shall be
covered .
TO THE SATISFACTION OF THE SANTA CLARA COUNTY FIRE DEPARTMENT:
36. SPRINKLERS: The suite in question must be inspected by a qualified fire sprinkler
contractor to determine if modifications need to be made to the fire sprinkler system. A
State of California licensed (C-16) Fire Protection Contractor shall submit plans,
calculations, a completed permit application and appropriate fees to this department for

37. WATER SUPPLY REQUIREMENTS : Potable water supplies shall be protected from
contamination caused by fire protection water supplies. It is the responsibility of the
applicant and any contractors and subcontractors to contact the water purveyor supplying
the site of such project, and to comply with the requirements ofthat purveyor. Such
requirements shall be incorporated into the design of any water-based fire protection
systems, and/or fire suppression water supply systems or storage containers that may be
physically connected in any manner to an applicant capable of causing contamination of the
potable water supply of the purveyor of record. Final approval of the system(s) under
consideration will not be granted by this office until compliance with the requirements of
the water purveyor of record are documented by that purveyor as having been met by the
applicant(s). 2010 CFC Sec. 903.35 and Health and Safety Code 13114.7.
38 . CONSTRUCTION SITE FIRE SAFETY: All construction sites must comply with
applicable provisions of the CFC Chapter 33 and our Standard Detail and Specification SI-
7. Provide appropriate notations on subsequent plan submittals, as appropriate to the
project. CFC Chapter 33.
39. ADDRESS IDENTIFICATION: New and existing buildings shall have approved address
numbers, building numbers or approved building identification placed in a position that is
plainly legible and visible from the street or road fronting the property. These numbers
shall contrast with their background. Where required by the fire code official, address
numbers shall be provided in additional approved locations to facilitate emergency
response. Address numbers shall be Arabic numbers of alphabetical letters. Numbers shall
be a minimum of 4 inches (101 .6 mm) high with a minimum stroke width of0.5 inch (12.7
mm). Where access is by means of a private road and the building cannot be viewed from
the public way, a monument, pole, or other sign or means shall be used to identify the

Starbucks Coffee opened its first store in Los Gatos in 1996 and created its first outlet for the
highest quality espresso , coffee and tea as well as what we've since been credited with
creating-our Country's third place where we gather between home and work.
The Starbucks Mission Statement is at the core of everything we do:
"To inspire the human spirit-one person , one cup, and one neighborhood at a time."
Every Starbucks store is company-owned and designed; each store is unique and is planned to
serve the local community. Los Gatos customers have been making Starbucks their own since
we opened our first store in the Town in 1996.
I. We are requesting the approval for a Conditional Use Permit to operate a Starbucks
Coffee establishment at 15567-15569 Union Avenue, Los Gatos (The Downing Center)
based on the following justifications:
A. Starbucks Coffee offers the following to the local community:
1. The proposed use o f this property is desirable to the public as Starbucks
provides a safe and inclusive "third place" for the community to gather. Our
stores are used by a wide-variety of customers to gather socially, use our free
Wi-Fi for work or studying , and grab food and beverages en route to work or
school. Downing Center is central to the East Los Gatos community and
beyond that it serves , and encompasses a diverse group of tenants such as
grocery, restaurant, bank, medicaL and retail components; Starbucks Coffee
would be a great fit to complete the offerings at this complex.
2. The proposed use will not impair the integrity or character of the zone.
3. The proposed use will not be detrimental to public health, safety or general
welfare.
4 . The Proposed use of the property is in harmony with the various elements and
objectives of the Town's General Plan and the purpose of the Chapter.
B. Breakdown of Starbucks Coffee St o re areas:
1. Total Store area is 2,176 (net) SF
2. Back of house (storage area) is 298 SF
3. C afe and Retail area (public seating) is 1 ,203 SF
4. Beverage/Prep is 290 SF
5. We have also provided a flo o r plan identifying the proposed layout of t he 2,300
(gross) SF space, with o ther noted areas such as res trooms and exterior sea ting,
with other information rel evant for your approv a l.
C. Our Hours of Operation:
1 . Opening at 4:30 am and closing at 11 :00 pm, daily.
2. Operating Hours are consistent with our existing stor es in the Town of Los Gatos.
3. Various other Downing Center tenants have similar late closing hours as well as
Sa feway being open 24 hours which can offer continuity in serving late evening
patro ns t o the shopping Center, and offering a greater sense of security
throughout the Cent er during th e later hours.
D. Deliveries and Food Preparati on:
1. Deliveries will be received between 7:00am and 10:00 pm.
2. Deliveries will occur through our fro nt door store entrance and the trucks will
safely utilize the parking lot , driveway, and ingress/egress points of Downing
Center. Our delivery method has been c arefully structured to minimize a ny
impact on the existing residents living to the So uth of the shopping center and
to the overall traffic within the shopping center.
3. Our food is prepared in an off-site commissary. Heated food will o nly be
prepared within a convection oven within the sto re which does not require
kitchen hoods for ventilation or other kit chen related equipme nt for food
preparation.
E. Employees:
1. We anticipate that o ur store will employ 20 partners and they will represent a
mixture of full-and part-time employees.

F. Parking:
1 . Dow ning Cente r has approximately 352 available parking spaces as
refere nced on our provided si t e plan.
2. Downing Center existing parking w ill be sufficient to meet the parking needs of
o ur cus tomers.
3. Our store locatio n is situated at the furthest so uth-east end corner of the
Downing Cente r property parking lo t away from other tenants with g reat er
parking needs. Th e re fore o ur c ustomers will be able t o utilize nearby/adjacent
parking spaces, lessenin g the use o f other spaces in m o re impacted locations.
G. Customers:
1 . Th e provided design within our 2,300 gross SF space efficiently utilizes a ll areas
and provides our c ustomers w ith up to 54 interior and 1 0 exterior seats.
2. The design allows free movement througho ut t he space from entry t o exit with
plenty of natural and e ffi cient lighting during operating hours.
H. Proj ect Location :
1 . There are currently a limited numbe r o f Coffee establishment locations in the
vicinity of Downing Center whic h provides a void for local customers.
2. G iven the centra l location and catchme nt o f Downing Cent er wit h it s several
diverse t e nants, we believe our p roposed project location wi ll better serve Los
Gat os res id e nts than the two o ther St arbucks locations which serve
residents/cust omers from o utsid e th e Town of Los Gatos limits.
11. Project Description:
A. Project Summary:
1 . Project located at So uth-East corner of the Downing Center property at 15567-
15569 Union Avenue, los Gatos, 95032. APN # 523-41-036 and CUP Application
# U-15-012 within Zone C-1 (Neighborhood Commercial).
2. Project encompasses a 2,300 gross SF space and 2,176 net SF within an existing
wood framed structure with exterior storefront, high ceilings, utilization of existing
entry/exits, and with interior and exterior table seating.
3. Previous use of space was a furniture Consignment Store, and space has been
unoccupied for some time since that business closure . Existing space is mainly
open resulting in minimal demolition impact as shown on provided floor plan.
4. Project proposes 54 interior seats and 1 0 exterior seats for a total of 64 seats for
Starbucks customers.
B. Plans provided include the following :
1. TR-000 (General Information -Cover Sheet): Noting Project location, Type,
Area, Code references and values, Project Contacts, and proposed interior
rendering.
2. TR-001 (Site Plan): Noting Project location within Downing Center Property,
vehicular circulation, existing parking space counts, and current-proposed
building tenant names and suite numbers 1 SF areas.
3 . TR-002 (Floor Plan): Noting existing and proposed floor plans. Proposed Plan
showing layout of Retail, Cafe/Seating, Beverage Prep, Storage, Restrooms,
and exterior seating areas .
4. TR-003 , TR-004 , TR -005 (Exterior Elevations): Noting minor proposed improvements
to existing building (i.e., lighting improvements) and location of store signage
and exterior seating with tables.
