ROLL CALL Present: Mayor Steven Leonardis, Vice Mayor Marcia Jensen, Council Member Rob Rennie, Council Member Marico Sayoc, Council Member Barbara Spector. Absent: None PLEDGE OF ALLEGIANCE Julia and Olivia Leonardis led the Pledge of Allegiance. The audience was invited to participate. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Approve Council Special Meeting Minutes of June 18, 2019. 2. Approve Council Meeting Minutes of June 18, 2019. 3. Accept Report on Town Manager Approved Actions During the 2019 Town Council Legislative Recess. 4. Appoint Council Member Marico Sayoc as the Town’s Voting Delegate and Town Attorney Robert Schultz as the Town’s Alternate for the League of California Cities Annual Conference Scheduled for October 16-18, 2019 in Long Beach, California. 5. Authorize the Town Manager to Negotiate and Execute a Memorandum of Understanding (MOU) with the City of Monte Sereno for a Cost Sharing Agreement for a Part-time Emergency Services Coordinator Position. 6. Town Code Amendment Application A-19-001. Project Location: Town Wide. Applicant: Town of Los Gatos. Adopt an Ordinance to amend Chapter 29 (Zoning Regulations) of the Town Code regarding fences, hedges, and walls, including regulations for the hillside area of Town. ORDINANCE 2286 7. Adoption of Revised Enabling Resolutions for the Sales Tax Oversight Committee and Finance Committee Respectively to Allow for Finance Committee Members to Serve as Sales Tax Oversight Committee Members when Vacancies exist, and Rescission of Resolutions 2018-056 and 2017-008. RESOLUTIONS 2019-041 and 2019-042 8. Authorize the Town Manager to Purchase a Replacement Computer Aided Dispatch and Records Management System from Sun Ridge Systems, Inc. in the amount of $525,000. 9. Authorize the Town Manager to execute a five-year agreement with Lynx Technologies for a total contract amount not to exceed $400,000. Authorize the Town Manager to Execute a Sixth Amendment to the Professional Services Agreement with Innovative Claims Solutions, Inc. to Extend the Contract for Four Months to Perform Workers’ Compensation Claims Administration MOTION: Motion by Vice Mayor Jensen to approve the Consent Items, inclusive of the Desk Item for Item 7. Seconded by Council Member Rennie. VOTE: Motion passed unanimously. VERBAL COMMUNICATIONS Roseanne Quenneville - Commented on the traffic on Highway 17 and the closing businesses in Los Gatos. Dale Miller - Commented on the pedestrian safety and parking on Newell Avenue and Newell Court. Rick Potter - Commented on the pedestrian safety and parking on Newell Avenue and Newell Court. Kim Dang did not come forward. Khalil - Commented on the pedestrian safety and parking on Newell Avenue and Newell Court. PUBLIC HEARINGS 11. Planned Development Application PD-17-002 and Negative Declaration ND-19-002. Project Location: 16212 Los Gatos Boulevard. Property Owner/ Applicant: 16212 Los Gatos Blvd. LLC. Requesting approval of a Planned Development to re-zone two properties zoned CH to CH:PD to allow for construction of a new commercial building. APN 523-06-010 and -011. Ryan Safty, Associate Planner, presented the staff report. Opened Public Comment. Eugene Sakai, Studio S; Scott Schork, BkF Engineers; and Gary Black, Hexagon Traffic Consultants, applicant representatives - Provided information on the application. Jeffrey Barnett - Commented in opposition of the project. Marlon Smith - Commented in opposition of the project. Maria Ristow on behalf of Dan Snyder - Commented in support of the project. Joseph Prang, Artisan Wine Depot - Commented in support of the project. Maria Ristow - Commented in support of the project. Lee Fagot - Commented in support of the project. Eugene Sakai, applicant representative - Addressed comments. Closed Public Comment. Council discussed the matter. MOTION: Motion by Mayor Leonardis to overturn the Planning Commission’s recommendation for denial and approve the project as submitted. Seconded by Council Member Sayoc. VOTE: Motion failed 2/3. Vice Mayor Jensen and Council Members Rennie and Spector voting no. MOTION: Motion by Council Member Spector to approve the project with conditions as proposed by staff, that the planned development exception be for reducing parking spaces by three and not the reduced setback. AMENDED: the construction management plan to include working around school hours and minimizing the second story roof deck impact. AMENDED: to reduce the parking spaces up to five. Seconded by Council Member Sayoc. VOTE: Motion passed unanimously. PAGE 4 OF 6 SUBJECT: Minutes of the Town Council Meeting of August 6, 2019 DATE: August 7, 2019 Public Hearing Item #12 – continued MOTION: Motion by Council Member Spector to make the required finding that the zone change is internally consistent with the General Plan and its elements (Attachment 2, Exhibit 3) and approve the PD application (PD-17-002) subject to the performance standards and development plans included in the Planned Development Ordinance (Attachment 7); waive the reading of the ordinance and have the Town Clerk read the title of the proposed ordinance; and introduce the ordinance effecting the zone change. Seconded by Council Member Sayoc. VOTE: Motion passed unanimously. The Town Clerk read the title of the ordinance. Recess at 8:55 p.m. Reconvene at 9:04 12. a. Adopt a Resolution of Intention between the Board of Administration California Public Employees’ Retirement System and the Town Council of the Town of Los Gatos to add Government Code Section 20516, Employees Sharing Additional Cost, for Classic Local Police Members in the Los Gatos Police Officers’ Association. RESOLUTION 2019- 043 b. Introduce an Ordinance by title only between the Board of Administration California Public Employees’ Retirement System and the Town Council to add Government Code Section 20516, Employees Sharing Additional Cost, for Classic Local Police Members in the Los Gatos Police Officers’ Association. Lisa Velasco, Human Resources Director, presented the staff report. Opened and closed Public Comment. Council discussed the matter. MOTION: Motion by Vice Mayor Jensen to adopt the recommendations contained in the staff report. Seconded by Council Member Rennie. VOTE: Motion passed unanimously. Open and Close a Public Hearing to Consider Objections to the 2019 Weed Abatement Program Assessment Report and Adopt a Resolution Confirming the Report and Authorizing Collection of the Assessment Charges. RESOLUTION 2019-044 Stefanie Hockemeyer, Executive Assistant, presented the staff report. Public Hearing Item #13 – continued Opened and closed Public Comment. Council discussed the matter. MOTION: Motion by Vice Mayor Jensen to adopt the resolution (Attachment 2) with the changes on parcel numbers 527-16-016 and 409-15-022 noted by staff. Seconded by Council Member Sayoc. VOTE: Motion passed unanimously. COUNCIL/TOWN MANAGER REPORTS Mayor Leonardis commented on the loss of former Town Manager David Knapp and stated the meeting would be adjourned in Mr. Knapp’s honor. All Council Members shared condolences and memories. Council Matters - Council Member Sayoc stated she had nothing to report and thanked staff for their work during the recess. - Council Member Spector stated she attended two General Plan Advisory Committee meetings, the Almond Grove Street Rehabilitation project ribbon cutting, two Council Policy Committee meetings, several Business Improvement District (BID) meetings, the Town’s 4th of July celebration, several Music in the Park sessions, spoke at Len Pacheco’s memorial service, and met with community members. - Mayor Leonardis stated he attended the following events: Agree Fitness, Seniors of Distinction, the Almond Grove Street Rehabilitation ribbon cutting, the West Valley Mayors and Managers meeting, the Town’s 4th of July celebration, Channel 2 and Channel 5 news, all the Music in the Park sessions, Youth Park, Kiwanis club, Silicon Valley Water District, and Len’s memorial - Vice Mayor Jensen stated she General Plan Advisory Committee and Policy Committee meetings, and the West Valley Mayors and Managers meeting on behalf of the Mayor. - Council Member Rennie stated he attended the following events: BID meetings, Music in the Park, the Almond Grove Ribbon Cutting, Los Gatos Recreation Senior Barbeque, SVCEA Risk Oversight, Silicon Valley Bike Summit, VTA Board meeting, and the Silicon Valley Clean Energy Finance Committee meeting.
