ROLL CALL Present: Chair D. Michael Kane, Vice Chair Matthew Hudes, Commissioner Mary Badame, Commissioner Kendra Burch, Commissioner Melanie Hanssen, Commissioner Kathryn Janoff, and Commissioner Tom O’Donnell Absent: None PLEDGE OF ALLEGIANCE Commissioner O'Donnell led the Pledge of Allegiance. The audience was invited to participate. SUBCOMMITTEE REPORTS/COMMISSION MATTERS None. VERBAL COMMUNICATIONS None. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Approval of Minutes – September 26, 2018 MOTION: Motion by Commissioner Badame to approve adoption of the Consent Calendar. Seconded by Vice Chair Hudes. VOTE: Motion passed unanimously PAGE 2 OF 4 MINUTES OF PLANNING COMMISSION MEETING OF OCTOBER 10, 2018 PUBLIC HEARINGS 2. 15299 Los Gatos Boulevard Architecture and Site Application S-18-027 Conditional Use Permit Application U-18-006 APN 424-19-047 Property Owner/Applicant: David Mordick, Robinson Oil Company Project Planner: Azhar Khan Requesting approval for expansion of retail area in an existing automobile service station (Rotten Robbie) and exterior modifications on property zoned CH. Continued from July 25, 2018, August 22, 2018, and September 12, 2018. Azhar Khan, Assistant Planner, presented the staff report. Opened Public Comment. Tom Robinson - This is a small project that does not change the building footprint. The building was designed for automotive repairs, and the two lube bays have not been used for mechanical work for over 40 years. The primary change is to replace the lube bay doors with a storefront. The building is ADA compliant, but ADA access would be improved. Restroom access will change from outside to the inside. The inside store area will be upgraded. Since the July meeting they have changed the finishes and colors. Closed Public Comment. Commissioners discussed the matter. MOTION: Motion by Commissioner Badame to approve an Architecture and Site Application and Conditional Use Permit for 15299 Los Gatos Boulevard. Seconded by Commissioner Burch. VOTE: Motion passed unanimously. PAGE 3 OF 4 MINUTES OF PLANNING COMMISSION MEETING OF OCTOBER 10, 2018 3. 720 Blossom Hill Road Conditional Use Permit Application U-18-008 APN 523-06-045 Property Owner: Rice Family Living Trust Applicant: Lunardi’s Supermarket, Inc. Project Planner: Sean Mullin Requesting approval for a modification of an existing Conditional Use Permit (Lunardi’s Supermarket) to allow wine and beer tasting on property zoned C-1. Sean Mullin, Associate Planner, presented the staff report. Opened Public Comment. Ken Barone - He is the Wine and Beer Manager at Lunardi’s. They hope to do wine tastings as a way to educate the public and bring in local wineries to their store. The tastings would be a maximum of three one-ounce pours during a two-hour period. Total Wine on Almaden Expressway has wine tastings, but it is a new precedent in Los Gatos. Jesus Vasquez - Safeway on Hamilton and Meridian has spirits, wine, and beer tastings on the weekends. Zanotto’s has a wine day on Wednesdays when patrons can taste wine while they shop. Whole Foods also has wine tastings. Closed Public Comment. Commissioners discussed the matter. MOTION: Motion by Commissioner Hanssen to recommend Town Council approval for modification of an existing Conditional Use Permit for 720 Blossom Hill Road, subject to amended Condition of Approval 5, found in Exhibit 3, that would mandate the maximum amount of tasting time as two hours, but not specifying which hours they are. Report from the Director of Community Development Joel Paulson, Director of Community Development • Director Paulson thanked the Planning Commissioners for attending the joint session with Town Council for the kickoff of the General Plan update; there will be a General Plan update community workshop on 10/17/18.
