ROLL CALL Present: Chair D. Michael Kane, Vice Chair Matthew Hudes, Commissioner Mary Badame, Commissioner Kendra Burch, Commissioner Melanie Hanssen, Commissioner Kathryn Janoff, Commissioner Tom O’Donnell Absent: None PLEDGE OF ALLEGIANCE Commissioner Burch led the Pledge of Allegiance. The audience was invited to participate. It was agreed by consensus to hear Item 4 before Item 3 on the agenda. SUBCOMMITTEE REPORTS/COMMISSION MATTERS None. VERBAL COMMUNICATIONS None. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Approval of Minutes – January 24, 2018 2. 16666 Topping Way Architecture and Site Application S-17-11 APN 532-09-018 Property Owner: Arthur Lin Applicant: Dennis Norton Design Project Planner: Sean Mullin PAGE 2 OF 4 MINUTES OF PLANNING COMMISSION MEETING OF FEBRUARY 14, 2018 DATE: FEBRUARY 22, 2018 Requesting approval for demolition of an existing single-family residence and construction of a new single-family residence on property zoned R-1:8. Requested continuance to March 14, 2018 MOTION: Motion by Commissioner Badame to approve adoption of the Consent Calendar. Seconded by Commissioner Burch. VOTE: Motion passed unanimously PUBLIC HEARINGS 3. 401 to 409 Alberto Way Architecture and Site Application S-15-056 Conditional Use Permit Application U-15-009 APN 529-23-018 Property Owner: CWA Realty Applicant: Shane Arters, LP Acquisitions, LLC Project Planner: Jennifer Armer. Requesting approval to demolish three existing office buildings and construct a new, two-story office building with below grade and at grade parking on property zoned CH. It has been determined that this matter may have a significant impact on the environment and an Environmental Impact Report (EIR) has been prepared as required by the California Environmental Quality Act (CEQA). Continued from 1/10/2018. Commissioner Badame indicated that she would recuse herself from participating in the public hearing for 401-409 Alberto Way, because her residence is located within 500 feet of the subject site. Jennifer Armer, Senior Planner, presented the staff report. Commissioners discussed the matter. MOTION: Motion by Commissioner O'Donnell to deny an Architecture and Site Application and a Conditional Use Permit for 401 to 409 Alberto Way. Seconded by Commissioner Burch. Commissioners discussed the matter. PAGE 3 OF 4 MINUTES OF PLANNING COMMISSION MEETING OF FEBRUARY 14, 2018 DATE: FEBRUARY 22, 2018 Vice Chair Hudes requested the motion be amended to include three points the Town Council had directed the Planning Commission to review: square footage reduction, landscaping and use of that land, and Caltrans and traffic issues. The maker of the motion did not accept the amendment to the motion. Commissioners discussed the matter. VOTE: Motion passed unanimously. 4. Town Code Amendment A-17-006 and GP-17-003 Applicant: Town of Los Gatos Project Planner: Jennifer Armer and Ryan Safty Consider amendments to Chapter 29 (Zoning Regulations) of the Town Code, the General Plan, and other policy documents regarding planned development ordinances and the Conditional Use Permit Table. Continued from 1/24/2018. Jennifer Armer, Senior Planner, presented the staff report. Opened Public Comment. Lee Quintana - This process took place over a long period of time, and in that time there have been some changes in the legislative domain that may affect the conclusions in the report. Additionally, Los Gatos will soon be into the General Plan cycle, and some of these issues are really General Plan issues. Closed Public Comment. Commissioners discussed the matter. MOTION: Motion by Vice Chair Hudes to continue Town Code Amendment A-17- 006 and GP-17-003 to the meeting of March 28, 2018, with specific direction from the Planning Commission. Report from the Director of Community Development Joel Paulson, Director of Community Development • Town Council met 2/6/18; adopted the Accessory Dwelling Unit Ordinance; considered the General Plan Update; but were unable to get to the North 40 item, which was continued to March 6, 2018.
