SUBJECT: TOWN CODE AMENDMENT APPLICATION A-17-001. CONSIDER
AMENDMENTS TO CHAPTER 29 (ZONING REGULATIONS) OF THE TOWN
CODE REGARDING CELLARS. PROJECT LOCATION: TOWN WIDE.
APPLICANT: TOWN OF LOS GATOS.
RECOMMENDATION:
Adopt the Ordinance amending Chapter 29 of the Town Code that was introduced by Council
on October 17, 2017 (Attachment 1).
DISCUSSION:
On October 17, 2017, the Council listened to public testimony, considered, and voted to
introduce the Ordinance amending Chapter 29 of the Town Code to simplify and provide clarity
to below grade square footage. The Council introduced the Ordinance as drafted and
recommended by the Planning Commission.
CONCLUSION:
Staff recommends that the Council adopt the proposed Ordinance amending Chapter 29 of the
Town Code to simplify and provide clarity to below grade square footage.
ENVIRONMENTAL ASSESSMENT:
The project is Categorically Exempt pursuant to the adopted Guidelines for the Implementation
of the California Environmental Quality Act, Section 15061(b)(3), in that it can be seen with
certainty that there is no possibility that the proposed amendments to the Town Code would
have a significant effect on the environment.
