ROLL CALL Present: Mayor Steven Leonardis, Vice Mayor Marcia Jensen, Council Member Rob Rennie, Council Member Marico Sayoc, Council Member Barbara Spector. Absent: None PLEDGE OF ALLEGIANCE Ted Chin led the Pledge of Allegiance. The audience was invited to participate. PRESENTATIONS Mayor Leonardis presented end of term Commendations to outgoing Youth Commissioners. The Youth Commission presented the Youth Friendly Business of the Year Commendation to Los Gatos Roasting Company. Teri Hope thanked the Youth Commission and the Town. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Approve Council minutes of May 21, 2019. 2. Ratify the Town Council Selection Committee’s recommended Youth Commissioner appointments. 3. A. Adopt a resolution approving the Town of Los Gatos Fiscal Year (FY) 2019/20 Operating Budget and FY 2019/20 – 2023/24 Capital Improvement Program (CIP), new appropriations, other approved adjustments, minor corrections, incorporating AFSCME, TEA, Confidential, and Management Salary Schedules; and carry-forward appropriations. RESOLUTION 2019-029 B. Adopt a resolution approving commitments of Fund Balance under GASB 54 . RESOLUTION 2019-030 C. Adopt an update to the Town’s General Fund Reserve Policy. POLICY 4-03 4. Adopt resolution establishing the Fiscal Year 2019/2020 GANN appropriation limit for the Town of Los Gatos. RESOLUTION 2019-031 5. Approve Town Council Meeting Schedule for Fiscal Year 2019/20. Authorize the Town Manager to execute a five-year Agreement for Services with Bay Area Janitorial Force, Inc., for custodial services in Town facilities in an amount not to exceed $204,048 annually, plus a ten percent contingency for special or unforeseen cleanings for a total annual amount of $224,453, and a total agreement amount of $1,122,265. 7. Authorize the Town Manager to execute an Agreement for Services with Pacific Display, Incorporated to provide ornamental tree and bridge lighting services and repairs in an amount not to exceed $46,521 annually for a total agreement amount not to exceed $232,605. MOTION: Motion by Vice Mayor Jensen to approve the Consent Items exclusive of Item #6. Seconded by Council Member Rob Rennie. VOTE: Motion passed unanimously with Council Member Spector voting no on Project 813-0327 contained in the Capital Improvement Program. VERBAL COMMUNICATIONS Kathleen Willey - Commented on the Green Monday program, and requested Council institute the program by example and include animal agriculture regulations in the 2040 General Plan. Spero Kouloures - Encouraged Council to institute the Mills Act. Lisa Wade - Explained the Green Monday program, requested Council institute the program by example and include animal agriculture regulations in the 2040 General Plan. Jeff Siegel - Requested Council to establish Mills Act provisions. Mark Trout - Read passages from the Bible. David McGregor - Commented in support of the Chamber of Commerce. Council Member Rennie requested the Green Monday program be placed on a future agenda for discussion. Council Member Sayoc seconded the request. Introduction of an ordinance of the Town of Los Gatos amending Chapter 15 of the Los Gatos Town Code entitled Motor Vehicles and Traffic. Lynne Lampros, Deputy Town Attorney, presented the staff report. Opened and closed Public Comment. Council discussed the matter. MOTION: Motion by Vice Mayor Jensen to introduce an ordinance (Attachment 2), by title only, to amend Chapter 15 of the Town Code entitled Motor Vehicles and Traffic. Seconded by Mayor Leonardis. VOTE: Motion passed unanimously. The Town Clerk read the title of the ordinance. 9. Town Code Amendment Application A-19-003. Project Location: Town Wide. Applicant: Town of Los Gatos. Consider amendments to Chapter 29 (Zoning Regulations) of the Town Code regarding Demolition Regulations. Joel Paulson, Community Development Director, presented the staff report. Opened and closed Public Comment. Council discussed the matter. MOTION: Motion by Vice Mayor Jensen to introduce an ordinance (Attachment 6), by title only, to amend Chapter 29 (Zoning Regulations) regarding demolition regulations . Seconded by Council Member Rennie. VOTE: Motion passed unanimously. The Town Clerk read the title of the ordinance. PAGE 4 OF 6 SUBJECT: MINUTES OF THE TOWN COUNCIL MEETING OF JUNE 4, 2019 DATE: JUNE 5, 2019 Public Hearing Item #9 – continued MOTION: Motion by Council Member Sayoc to refer to the Policy Committee the larger issue related to demolitions as stated in the staff report. Seconded by Vice Mayor Jensen. VOTE: Motion passed unanimously. OTHER BUSINESS 10. Authorize the Town Manager to execute an annual agreement for services with the Los Gatos Chamber of Commerce to manage the Town’s Information Center and assist with the coordination of the Leadership Los Gatos program for a total contract amount not to exceed $45,000. Monica Renn, Economic Vitality Manager, presented the staff report. Opened Public Comment. Catherine Somers, Los Gatos Chamber of Commerce Executive Director - Commented on the Chambers proposed scope of services and its request for an additional $15,000 for Visitor Center services. David McGregor spoke under Verbal Communications. Closed Public Comment. Council discussed the matter. MOTION: Motion by Council Member Rennie to increase the Visitor’s Center amount by $15,000 for a total of $55,000. Seconded by Vice Mayor Jensen. VOTE: Motion passed unanimously. Staff to bring the revised agreement to Council on June 18 for final approval. PUBLIC HEARING 11. Adopt a Resolution initiating annexation of certain urban unincorporated islands within the Town of Los Gatos Urban Service Area pursuant to sections 56757 and 56375.3 of the California Government Code. RESOLUTION 2019-032 Arn Andrews, Assistant Town Manager, presented the staff report. Helen Stone - Commented in opposition to the annexation. Paul Graham - Commented in opposition of the annexation and requested a transition time to comply with some of the Los Gatos rules. Mary Pfistor - Commented that if property taxes would be increased because of the annexation , she would be opposed and asked for the Government Code sections that allow the proposed annexation process. Deborah Wagner - Commented on the noise from the construction on her street and the lengthy construction work hours the Town allows in comparison to the County and other jurisdictions. Roy Moses - Commented on the notification process and that he did not receive notification of the proposed annexation. Marshall Smith - Requested clarification of the differences in all the ordinances that would be imposed by incorporating into the Town. Jacquelyn MacDonald - Requested some sort of adjustment period for complying with some Town ordinances. Philip de Louraille - Commented on the bee regulation differences between the Town and County. COUNCIL/TOWN MANAGER REPORTS Council Matters - Council Member Sayoc thanked staff for all the information provided on the budget and requested that the streets that will be paved with the $1.7M be identified in the annual street paving list. - Council Member Spector stated she attended the West Valley Clean Water Authority meeting. - Mayor Leonardis stated he attended the West Valley Mayors and Managers meeting, the Memorial Day ceremony at Los Gatos Memorial Park, the Kiwanis Turn Around Lunch with Council Members Sayoc and Rennie; had lunch with a student he mentors at Alta Vista School; and did a ribbon cutting for Yvette Spa. - Vice Mayor Jensen stated she would be attending the Association of Bay A rea Governments (ABAG) General Assembly meeting. - Council Member Rennie stated he gave a speech at the Hillbrook School graduation ceremony; and attended the Emergency Operating Area Council meeting and the Safe Routes to School breakfast. Manager Matters - Announced the Adult Commissioner application deadline is Friday, June 7, 2019.
