RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
INITIATING STREAMLINED ANNEXATION PROCEEDINGS PURSUANT TO SECTIONS
56757 AND 56375.3 OF THE CALIFORNIA GOVERNMENT CODE WITHOUT PROTEST
OR ELECTION PROCEEDINGS

WHEREAS, California Government Code Section 56375.3 provides for a streamlined
process for cities /towns to initiate changes of organization or reorganization for pockets of
unincorporated territory that meet specified criteria; and
WHEREAS, on February 5, 2019 the Town Council directed staff to initiate the
streamlined annexation process for multiple urban unincorporated islands within the Town's
Urban Service Area (USA); and
WHEREAS, Section 56757 of the California Government Code states that the Local
Agency Formation Commission shall not review an annexation proposal to any city in Santa
Clara County of unincorporated territory which is within the Urban Service Area of the city if
initiated by resolution of the legislative body and therefore the Town Council of the Town of
Los Gatos is now the conducting authority of said annexation; and
WHEREAS, the County Surveyor of Santa Clara County has found the territory proposed
for annexation to the Town is in accordance with Government Code Section 56757(c)(2), and
said territories are completely surrounded by the Town and are definite and certain, and the
proposal to be in compliance with the County's Local Agency Formation Commission's road
annexation policies; and
WHEREAS, the subject territories include 24 pockets covering approximately 116.1 acres
on property pre -zoned R -1:8, R -1:12, R -1:20, and HR -1; and
WHEREAS, the project is exempt from the California Environmental Quality Act (CEQA)
under Title 14 Code of Regulations, Chapter 3: Guidelines for the Implementation of CEQA
Section 15061(b)(3): Review of Exemption; and

WHEREAS, the Town provided public noticing per Local Area Formation Commission
LAFCO) hearing guidelines of a public hearing on June 4, 2019, to initiate annexation by
resolution and set a date for second public hearing.
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Los Gatos as
follows:
That the Town Council of the Town of Los Gatos hereby initiates proceedings for the
proposed annexation of 24 pockets pursuant to Sections 56757 and 56375.3 of the
California Government Code without protest or election proceedings and sets June 18,
2019 as the second public hearing date for consideration of such reorganization.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos,
California, held on the 4th day of June 2019, by the following vote:
