THE TOWN OF LOS GATOS
AMENDMENT NO. 1
WHEREAS, the Town of Los Gatos, a municipal corporation ("TOWN''), and Department of
Transportation ("STATE"} entered into that certain agreements entitled Agreement for Maintenance of State Highways in the Town of Los Gatos, executed on January 3, 1975 hereinafter referred to as "Original Agreement''; and
WHEREAS, City and State have determined it is in their mutual interest to amend certain terms of the Original Agreement.
NOW, THEREFORE, FOR VALUABLE CONSIDERATION, TiiE PARTIES AGREE AS FOLLOWS:
1.The Original Agreement, Delegation of Maintenance, shail be revised by substituting the attached page, "-14a-", for the like numbered page of Original Agreement, which shall become a part of the Agreement for all purposes.
2.Parties agree that all improvements designated in an Encroachment Pennit shall be maintained byTOWN.
3.This Amendment shall be effective upon execution byboth TOWN and STATE.
4. Except as expressly modified herein, all of the provisions of the Original Agreement shall remain in full force and effect. In the case of any inconsistencies between the Original Agreement and this Amendment, the terms of this Amendment shall control.
S.This Amendment may be executed in counterparts, each of which shall be deemed an original,but all of which together shall constitute one and the same instrunient
IN WITNESS WHEREOF, the parties have caused this Amendment to be executed as of the dates set forth besides their signatures below.
