RECOMMENDATION:
Authorize the Town Manager to Execute a Certificate of Acceptance and Notices of Completion
(Attachment 1) accepting the work of Ecological Concerns, Inc. and authorize the recording by
the Town Clerk for PPW Job No. 17-831-3104 Bachman Park Rehabilitation Project Landscape
Upgrades.
BACKGROUND:
The Town’s adopted FY 2018/19-2022/23 Capital Improvement Program (CIP) Budget
designated funding for the Bachman Park project.
At the March 20, 2018 Town Council meeting, Council approved the plans and specifications for
three separate component projects (Bachman Park Pathway Upgrades, Bachman Park Lighting
Upgrades, and Bachman Park Landscape Upgrades), and authorized the Town Manager to
advertise the projects for bid and to award the projects in an amount not to exceed the
available construction budget of $461,604, including contingencies, to the lowest responsible
bidders. The project was broken into three separate component projects to allow
subcontractors to bid directly on each project, eliminating contractor markups and providing
better pricing to the Town. All three contracts, the Bachman Park Pathway Upgrades, the

BACKGROUND (continued):
Bachman Park Lighting Upgrades, and the Bachman Park Landscape Upgrades are now
complete.
DISCUSSION:
The Town’s contractor, Ecological Concerns, Inc., completed the work for the landscape
upgrades. Their work meets the requirements of the contact and staff recommends accepting
the project.
Five percent of the faithful performance bonds will remain in effect for a period of two years as
a guarantee for any needed repair or replacement caused by defective materials and
workmanship. The execution and recordation of the Certificates of Acceptance is now required
to finalize the Town's acceptance of these projects.
CONCLUSION:
Staff recommends the Council authorize the Town Manager to execute a Certificate of
Acceptance and Notice of Completion accepting the work of Ecological Concerns, Inc. and
authorize recording by the Town Clerk for PPW Job No. 17-831-3104 Bachman Park
Rehabilitation Project Landscape Upgrades.
