M11-16-09 1 MINUTES OF THE TOWN COUNCIL/PARKING AUTHORITY/REDEVELOPMENT AGENCY NOVEMBER 16, 2009 The Town Council of the Town of Los Gatos conducted a Regular Meeting on Monday, November 16, 2009 at 7:00 P.M. TOWN COUNCIL/PARKING AUTHORITY/REDEVELOPMENT AGENCY CLOSED SESSION BEGAN AT 5:30 P.M. MEETING CALLED TO ORDER ROLL CALL Present: Mayor Mike Wasserman, Vice Mayor Diane McNutt, Council Member Joe Pirzynski, Council Member Steve Rice, Council Member Barbara Spector Absent: None. PLEDGE OF ALLEGIANCE Thomas Culwell, Trevor Salom, Raffi Demirijan, Michael Shusterman, Austin Donald, Nick Savage, and Ryan Heath from Cub Scout Pack 556, Den 4 led the Pledge of Allegiance and performed "God Bless America" in sign language. CLOSED SESSION REPORT CONFERENCE WITH REAL PROPERTY NEGOTIATORS (Government Code Section 54956.8) Properties: 20 Dittos Lane (Assessor Parcel Number 529-29-034) Negotiating parties: Town of Los Gatos (Negotiator: Bud Lortz, Deputy Town Manager) Under Negotiation: Price and terms of payment Mr. Korb stated that direction was given and that no final reportable action was taken. 2 TOWN COUNCIL COUNCIL/TOWN MANAGER REPORTS Council Matters There were no Council Matters for this meeting. Manager Matters Mr. Larson • Commented that the Town reopened the Main Street parking lot a week earlier than expected due to an accelerated construction schedule that was managed by Parks and Public Works. • Commented that the Town accepted the keys for the new future community sports and recreation facility at 930 University Avenue. • Commented that the Town will be hosting a community day at the new Police Operations Building on November 21, 2009 from 10-4 p.m. • Commented that the entire community is invited to attend. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Tract No. 9537 - Cornerstone at Los Gatos Adopt resolution approving final map for Tract No. 9537 - Cornerstone at Los Gatos (300 Calle Marguerita) and accepting the dedications. RESOLUTION 2009-121 2. Hazardous Vegetation Abatement (Weeds) a. Adopt resolution declaring hazardous vegetation (weeds) a public nuisance and providing for their abatement and setting a public hearing in order to hear protests. RESOLUTION 2009-122 b. Set January 19, 2010 as a public hearing date on this annual program. 3 Consent Items – Continued TOWN COUNCIL/REDEVELOPMENT AGENCY 3. Approve Council/Agency minutes of November 2, 2009. Mr. Davis Pulled Consent Item #3. Mayor Mike Wasserman stated that the pulled Consent Item would be heard prior to Verbal Communications. MOTION: Motion by Council Member Barbara Spector to approve Consent Items #1 and #2. Seconded by Council Member Steve Rice. VOTE: Motion passed unanimously. PULLED CONSENT ITEM #3 Mr. Davis • Expressed concerns that he was not acknowledged by Council when he requested an administrative correction to the minutes of October 19, 2009 and would like it to be known that he was correct. MOTION: Motion by Council Member Joe Pirzynski to approve Consent Item #3. Seconded by Council Member Barbara Spector. VOTE: Motion passed unanimously. VERBAL COMMUNICATIONS Mr. Davis • Commented about a letter written by the City of Saratoga to the Bay Area Air Quality District complaining about the re-issuance of a five year permit to poison the air from the cement plant in the Cupertino hills. • Commended Mr. Capurso, Parks and Public Works Director for adding reflectors on Los Gatos Boulevard between Blossom Hill Road and Lark Avenue and for the crosswalks that have been painted near the schools. • Commented that his definition of democracy in action is to serve “we the people.” 4 Verbal Communications - Continued Mr. Joyner • Requested that the Town consider adopting an ordinance to require smoke free parks in Los Gatos. • Commented that this will cut down on litter and second hand smoke within the designated parks. Mayor Curtis, Monte Sereno • Commended Mayor Mike Wasserman on his year as Mayor for the Town of Los Gatos. • Commented that he could not stay for the appointment of the new Mayor because of another engagement, but would like to congratulate the new Mayor prior to the appointments. Mr. Bryon • Introduced himself as the new station manager for KCAT and stated that he is looking forward to working with the Town and Community. Closed Verbal Communications PRESENTATIONS Proclamation - Mary P. Curtis - Pancreatic Cancer Awareness Month • Mayor Mike Wasserman proclaimed the month of November as Pancreatic Awareness Month. • Ms. Curtis accepted the proclamation on behalf of the Pancreatic Cancer Action Network and thanked the Town for the proclamation. Certificate of Achievement for Excellence in Financial Reporting (CAFR) (Fiscal Year Ending 2008) • Mayor Mike Wasserman presented a Certificate of Achievement for Excellence in Financial Reporting (CAFR) to the Town of Los Gatos. • Steve Conway, Director of Finance accepted the award on behalf of the Town. • Mr. Conway thanked the Town and the community for their support. 5 Presentations - Continued Council Member Joe Pirzynski and Greg Larson, Town Manager • Presented the Mayor’s gavel as a gift to Mayor Mike Wasserman for an excellent year serving the community. • Staff presented a video of Mayor Mike Wasserman’s year as Mayor. • Commended Mayor Mike Wasserman on a job well done. Mayor Mike Wasserman • Thanked the Town and the community for all their support. • Commented on the Town Town’s many accomplishments for the year, which included: • Completion of the new Police Operations Center. • Design of the new Library. • Expansion of downtown parking. • Purchase of land for a community recreation facility. • Engagement of 68 organizations in Project Cornerstone committed to valuing youth. • Many other large and small accomplishments. APPOINTMENT OF MAYOR AND VICE MAYOR MOTION: Motion by Mayor Mike Wasserman to nominate Council Member Diane McNutt as Mayor of the Town of Los Gatos. Seconded by Council Member Joe Pirzynski. VOTE: Motion passed unanimously. New Mayor Diane McNutt • Thanked the Council and community for their support. • Commented on her goals for the upcoming year which included: • Balancing the budget for 2010. • Breaking ground for the new Library. • Beginning the design phase for the recreation facility on University Avenue. • Keeping the Town’s residents safe and invited the community to attend the Community Day at the new Police Operations Building. • Expanding Los Gatos Prepared. • Preserving the asset called the Town of Los Gatos. 6 Appointment of Mayor and Vice Mayor – Continued MOTION: Motion by Vice Mayor Diane McNutt to nominate Council Member Joe Pirzynski as Vice Mayor of the Town of Los Gatos. Seconded by Mayor Mike Wasserman. VOTE: Motion passed unanimously. Vice Mayor Joe Pirzynski • Commented that he is committed to the community and to supporting the Mayor and Council. Mayor Diane McNutt • Introduced Ann Ravel, Deputy Assistant Attorney General of the United States. • Ms. Ravel requested that Council join her at the ceremonial area to assist her in administering the Oath of Office to the Mayor and Vice Mayor. Mayor Diane McNutt invited the community to attend the Democracy in Action reception sponsored by the Chamber of Commerce in the Town Council Chamber Lobby.
