Commission's denial of Conditional Use Permit and Archit -

stating he is concerned about Council's recent action s
pertaining to a proposed low to moderate income housin g
development and is requesting an accounting of all monie s
expanded to date for the initiation and development of thi s
new. housing project, and information concerning the HU D
requirements and qualifications for potential occupant s
and general information on the complete project . Mr .

5.Letter from Carl Norwood, of the Optimist Club of Los Gato s
requesting Council permission to hold first annual Los Gato s
Chili Cookoff, to be held at Oak Meadow Park on Septembe r
21, 1980 . Mr . Norwood explained the proceeds from thi s
event would facilitate funds to help underprivileged 1

6.Letter from Ming Quong Children's Center thanking Counci l
and staff for allowing them to use the Civic Center an d
Neighborhood Center-to hold their 20th annual Strawberr y
Festival . It was consensus of Council that letters o f
commendation be prepared for Lt . Robert Schuster and Par k
Superintendent, Robert Bryant for the work on this project .

significant change in the traffic circulation of the Tow n
and should go through the normal channels of Plannin g
Commission hearings . Vicki Powell, President of. the
Lexington Hills Assoc ., stated the Transit Commission wil l
hear their request for bus route through the mountain s
and that bus route is predicated on the bus using tha t
ramp . She stated the Transit District has not bee n
informed of the closure and it will certainly have a majo r
impact on their plans . After further discussion, Mr .
Ventura moved this item be discussed right after the publi c
hearings . Mr . Siemens seconded . Unanimously carried .

Tahoe re the Council's adoption of Resolution 1979-16 1
endorsing the proposal to make Tahoe Basin a Nationa l
Recreation area .. The City of South Lake Tahoe is concerne d
that they were not notified that this action was bein g
considered, were not given the opportunity to present thei r
position on the subject . Mayor Cefalu invites Council t o
come and see this area and learn first hand what the situa -
tion really is like and what has been done to protect an d
enhance the resource, Lake Tahoe . Note and filed .

20.Letter from A .Peri Frantz, 16345 Englewood Avenue, refer -
ring to a zone change from R-1 :8,000 to R-1 :20,000 fo r
properties located in a county pocket, subject to Los Gato s
Town Services Zoning and requesting Council's support o f
this application . Ms . Frantz, spoke on this issue, statin g
the County had misinterpreted the Town's letter . Afte r
further discussion, Mr . Ventura moved staff notify Boar d
of Supervisors that the Planning Director's letter date d
March 14, 1980, not be taken as recommendation for approva l
of the (referred to) project (County referral 993-30-52 -
8OP-80S) but, Town's position is neutral . Also, sen d
Planning Commission a consideration to prezoning in thi s
area, so that it will be consistent with the size of th e
lots as they currently exist . Mr . Siemens seconded .

FENCE AT CAMINO Town Attorney, Preston Hill, reported on lawsuit pending r e
DEL CERRO AND the removal of the fence at the corner of Camino del Cerr o
LOS'GATOS-ALMADEN and Los Gatos-Almaden Road . Mr . Hill stated he has receive d
ROAD a proposal for settlement, and the proposal is that the Town ,
using it's crew, move the fence back to straight line a s
previously described and Town landscape the area that, then ,
will exist between the fence and the sidewalk . If the Tow n
will enter into an agreement like this, Mr . Hobbs will consent
to the entry of judgement that provides that the fence has t o
be moved back . Mr . Hobbs spoke to Council and stated he i s
in agreement . Mr . Siemens moved Attorney be instructed t o
prepare necessary agreement . Mrs . Cannon seconded . Unanimousl y
carried .
VERBAL Sandy Louthian, spoke to Council re the discontent that exist s
COMMUNICATIONS in the community regarding the functioning of Town busines s
and presented petitions signed by 165 taxpayers opposing an y
change to Town Ordinance that woula take away the Manager's
authority .
Mr . J . D . Vanderlaan, 17380 Bruce Avenue, stated if anyon e
deserved a wage increase, it is Park Superintendent, Rober t -
Bryant .
Mr . John Lochner, 150 Creffield Heights, spoke on the concern s
of the public on the action taken by the majority of Council ,
in denying the department heads an increase . Mr . Lochner
urged Council to reconsider .
Police Officer, James Scaletta, representing the Police Officer's
Association, spoke on the excellent job performed by the Polic e
Chief and the Town Manager and questioned Council discontent .
Mr . David McKay, 205 Bacigalupe Drive, extended an invitatio n
to Council, Engineers and Police to go on a bike tour aroun d
Los Gatos to see some of the hazards of bikers . The Tour will
be held July 19 ; 1980 at 9 :00 a .m .
Mr . Cutright, from audience, spoke in favor of Council's actio n
in not approving department heads wage increases, statin g
Council was elected and are the ones who must take care of th e
economic interests of the Town . Also, speaking in favor o f
Council's action were Frank Jones, Rex Burbank and Dom Salitto .
Others speaking in opposition were Sue LaForge, Warren Bisbee ,
Art Snyder, Sam Yablonsky and Bob Hamilton .

NOISE ORDINANCE Attorney Preston Hill, stated the consultant hired for stud y
of the Noise Ordinance is in audience and requested tha t
Council take up this matter now, as Mr . Shelly,the Consultant ,
has another appointment . It was consensus of Council that the y
would like a demonstration . Mrs . Rasmussen moved this b e
continued to August 18, 1980, to allow for a possible fiel d

BID AWARD CIVIC Mr . Warnick reported that engineers estimated cost for th e
CENTER HANDI-proposed project was $33,000 and on June 26, 1980, only one bi d
CAPPED ACCESS was received in the amount of $91,856 .79 from Atom Constructio n
Co ., Inc . The architect and engineers feels the amount of th e
bid for this work to be excessive . Tony Rizutto of Ato m
Construction Co ., Inc ., spoke on expense of the project . Afte r
further discussion, Mr . Siemens moved staff be directed t o
revise the plans and specifications and present to Council fo r

Mayor Ferrito stated this is the time to hear from the publi c
on the closure of the north bound off-ramp . Speaking agains t
the closure were John Panighetti, Postmaster of Los Gatos ;
Vicki Powell, President of the Lexington Hills Association ;
Nigra Cervenca, owner or a business in Los Gatos but lives i n
Santa Cruz County ; Bob Hamilton ; warren Bisbee ; Sue LaForge ;
Joe Valverde, stating Council should examine problems o f
emergency services that need to be able to protect the hillsid e
areas of the south west section of Los Gatos . Mr . Bisbe e
spoke of people not being informed of issues on the agend a
so they could speak before Council takes action . Police Chief ,
Johnson, spoke on his report to Council as why he recommende d
the closure as did Mr . Warnick . After further discussion, Mr .
Siemens moved this issue be continued to next meeting t o
consider report from emergency services and staff direct Cal -
trans of the town's decision . Mr . Ventura seconded . Unanim -
ously carried .
Speaking on the issue of banning parking on N .Santa Cru z
Avenue on saturdays and sundays were Mike Kane, Linda Barnet t
Sam Yablonsky . Stating if there is no parking on N . Santa .
Cruz Avenue then parkers will spill over into the residentia l
areas . Police Chief Johnson spoke on the no parking durin g
certain hours and Mr . Warnick spoke of the postcard surve y
made to the businesses and the property owners . Sue LaForg e
stated she had spoke to businesses and wondered if Counci l
would consider the no parking ban on sundays for a beginning .
After further discussion, Mr . Ventura moved for consensu s
motion to ban parking on N . Santa Cruz Avenue on sundays only .
Mrs . Rasmussen seconded . Unanimously carried . Mr . Ventur a
stated the hours forthe no parking would be 2p .m . to 7p .m .
Mr . Siemens seconded . Unanimously carried . Mrs . Cannon move d
on consensus motion to ask for an Environmental assessmen t
for both saturday and sunday and then at a later date th e
final decision can be made whether both saturday and sunday shoul d
have the no parking from 2p .m . to 7p .m . Mr . Siemens seconded .

On .consensus motion, Mr . Ventura moved to accept staff recom -
mendation but it is necessary to have an environmental asses -
sment of this project therefore, it be continued to July 21 ,

Mrs . Cannon moved Council accept staff recommendation an d
approve the concept of an interim median island for Wincheste r
Boulevard at Villa Felice, and direct staff to seek approva l
from Monte Sereno . Mr . Siemens seconded . Unanimously carrie d
Attorney Wright, representing Mr .c Mrs . Moehlman, stated th e
Moehlman's agree that alternate #3 as described by the engin -
eers is acceptable . Mr . Ventura on consensus motion move d
Council accept alternate #3 and approve Mr . Moehlman's reques t
to modify the Council's previous decision by directin g
construction of a cul-de-sac at National Avenue and retainin g
existing turn restrictions at Camino del Sol and Los Gato s
Boulevard with new island construction by Mr . Moehiman a s
previously approved by the Planning Commission . This will b e
brought back to Council at their July 2i, 1980 meeting for a n

the $7,000 cash payment to San Jose Water Works) approve a
Quitclaim Deed given to San Jose Water Works, the Wate r
System Easements in Tract 3907 . Authorize Mayor to sign th e

was quite high . Mr . Ventura moved that a letter be sent t o
Mr . Slutman asking if he can effectively serve as a Commissioner ,
with all do respect and appreciation of his ten year s
dedicated service to the Town . Many citizens are anxiou s
to serve on the Commission and the Mayor should communicat e
with Mr . Slutman personally to see whether its Mr . Slutman's
business committments or what that is making him miss s o
many meetings and if it will continue to do so in the future .
