VERBAL Ray Beadle, 17770 Tourney Road, presented a petitio n
COMMUNICATIONS signed by 33 property owner's of Foster, Tourney and Kil -
kenny Roads, re violation of the Hillside Plan by Ken Mille r
and Associates, who have been doing grading and roa d
improvement, across private sections of Tourney Road, with -
out issuance of necessary grading permits . Mr . Bowma n
stated he has notified the County of this violation, as i t
is in their jurisdiction . After further discussion, Mrs .
Cannon moved staff write Board of Supervisors, statin g
Council opposed any development on the hillside, part-
iculary on Tourney Road and Town believes it's in violatio n
of the County Ordinance . Mrs . Rasmussen seconded . Unanim -
ously carried . Council asked for report from Mr . Warnic k
documenting the potential problems which may occur in th e
future (when the rains begin) from this illegal grading .
Nelle Handley, 107 Oak Rim Court, asked that Council tak e
agenda item IX-E as soon as possible . Mayor stated the y
would take this item up right after the consent items .
Dave Ristroph, 204 Carlester, referred to his letter o f
complaint and asked what action is to be taken . He aske d
that his letter be noted as a formal complaint . Mr .
Ristroph was informed that an investigation would be mad e
and results would be sent to him .'

APPEAL ON Mr . Ed Stollery, requested this matter be heard at . this time .
FENCE AT 15545 Mr . Warnick presented documents relating to fence at 1554 5
CAMINO DEL Camino del Cerro and what has transpired before at previou s
CERRO meetings, when Council adopted an urgency ordinance and sub -
sequently adopted this as a permanent ordinance which states .
the fence is illegal . Mr . Warnick acknowledged that item s
set forth in his report are true . Mr . Steinbock stated h e
had reviewed Mr . Warnick's report and stated he did not hav e
a lot of problems with the report as it is . Mr . Warnic k
stated hearing had been held and the following conclusio n
had been reached : the fence as presently constructed on Mr .
Hobbs' property constitutes a traffic hazard ; the fenc e
must be removed or modified . immediately . Necessary modifi -
cations are : move the fence back, so it is south of a
triangular line through the following points : (1) a poin t
on the westerly line of Camino del Cerro 15 feet south o f
the southerly line of Los Gatos-Almaden Road ; (2) a poin t
on the southerly line of Los Gatos-Almaden Road 150 fee t
westerly from the northerly extension of the westerly lin e
of Camino del Cerro, and the area north of the line describe d
above shall be kept free of plant materials and any othe r
site distance obstructions more than three feet above th e
height of the top of the curb . Mr . Steinbock, stated he

APPEAL ON felt the best solution would be for the Town to buy tha t
FENCE AT 15545 area of property from Mr . Hobbs and move the fence bac k
CAMINO DEL at the Town's expense and be required to maintain th e
CERRO distance outside the fence . He also, stated that at th e
(CONTINUED)time the fence was build it was not in violation, no w
Town has decided it is in violation and Mr . Hobbs' i s
not willing to accept the Town's proposal and referred t o
cost that would be incurred by him . After further discus -
sion on suggestions as made by Mr . Steinbock, Mr . Warnic kstated in his professional opinion the fence has to b e
relocated . Mr . Siemens moved Council accept the determin -
ation of staff under Ordinance No . 1469 . This would b e
to deny the appeal of Mr . Hobbs, based on findings in th e
engineer's letter dated May 30,1980 . Mr . Ventura seconded .

ANTIQUE Mayor Ferrito stated this was the time and place duly note d
RESTAURANT for the continued public hearing to consider the appeal o f
APPEAL Planning Commission's approval to enclose an existing out -
door patio : for the Antique Restaurant at 50 University Avenue .
Letter was received from Rosalie Lincoln, opposing th e
enclosing of the patio . Barbara Spector, appellant spok e
on the appe>.. stating the enclosure of the patio is no t
essential o desirable, but is instead a detriment to th e
welfare of the people . The enclosure would intensify th e
use of the bar and restaurant, which would in turn,tensif y
traffic and parking . Linda Lee Barnett and Lois Chapso n
also spoke against the enclosure . Mr . Tankersly, owner o f
the restaurant, stated it was his intension to improve th e
business, but it was not his purpose to increase traffi c
flow . There being no one else in the audience wishing t o
speak on this subject, Mrs . Cannon moved hearing be closed .

Resolution No . 1980-73 be adopted, A RESOLUTION REVERSIN G
A DECISION OF THE TOWN PLANNING COMMISSION with the finding s
that the Planning Commission erred in not finding that th e
expansion of this use is not essential or desirable to th e
public welfare because any increase of activities at thi s
location would cause an unexceptable further impact on traffic ,
parking and law enforcement problems ; and the benefit s
of proposal do not warrant the risk that would be involve d

TOWN GENERAL Mayor Ferrito stated this was the time and place duly note d

report were Bruce Kelley and Mr . Lambert . Albert Blake ,
resident of Pine Avenue stated he is against any access roa d
through to Pine . I .W . Lloyd spoke against condominiums .
Oscar Sohns, spoke on buffering designated in proposed project .
Mayor stated the only question before the Council tonigh t
is the amendments to the Land Use Plan of the General Pla n
and not approving any project . After some discussion an d
there being no one else in audience wishing to speak o n

Mr . Siemens moved for adoption of Resolution No .1980-74
entitled, A RESOLUTION AFFIRMING A DECISION OF THE TOW N
