M11-19-07 1 MINUTES OF THE TOWN COUNCIL/PARKING AUTHORITY/REDEVELOPMENT AGENCY NOVEMBER 19, 2007 The Town Council of the Town of Los Gatos conducted a Regular Meeting on Monday, November 19, 2007 at 7:00 P.M. TOWN COUNCIL/PARKING AUTHORITY/REDEVELOPMENT AGENCY MEETING CALLED TO ORDER ROLL CALL Present: Mayor Joe Pirzynski, Vice Mayor Barbara Spector, Council Member Steve Glickman, Council Member Diane McNutt, and Council Member Mike Wasserman. Absent: None. PLEDGE OF ALLEGIANCE - LED BY 2007 FUTURE LEADERS Mayor Joe Pirzynski invited the future leaders of 2006/07 to lead the Pledge of Allegiance. The audience was invited to participate. Boy Scout Troop #556 performed God Bless America. CLOSED SESSION REPORT CONFERENCE WITH LABOR NEGOTIATOR (Government Code Section 54957.6) Town Negotiator (Lead): Rumi Portillo, Human Resources Director Employee Organization: TEA Mr. Korb, Town Attorney stated that direction was given and no action was taken. PRESENTATIONS Introduction  Greg Larson, appointed as new Town Manager Mayor Joe Pirzynski introduced Greg Larson as the new Town Manager. Mr. Larson spoke about his motivation and his goals for the community as the Town Manager. 2 TOWN COUNCIL CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Ratify payroll for the month of October 2007. 2. Ratify accounts payable for the month of October 2007. 3. Accept Treasurer’s Report for August, September and October 2007. 4. PPW Job No. 08-07 - Bachman Park Irrigation Project (410-0607). a. Adopt resolution declaring B&B Landscape Contractors to be the lowest responsible bidder on the project and award a construction contract in the amount of $94,650. RESOLUTION 2007-119 b. Authorize staff to execute future change orders to the construction contract as necessary up to an amount of $9,400. c. Authorize budget adjustment of $11,700 for Bachman Park Irrigation Project 410-0607. d. Authorize transfer of $11,700 in undesignated State Parks Grant Funds (410) to Bachman Park Irrigation Project 410-0607. 5. PPW Job No. 05-17 - Highway 9 Safety Improvement Project 06-14. a. Adopt resolution declaring HSR, Incorporated to be the lowest responsible bidder on the project and award a construction contract in the amount of $655,720. RESOLUTION 2007-120 b. Authorize staff to execute future change orders to the construction contract as necessary up to an amount of $100,000. 6. Adopt resolution authorizing the Interim Town Manager to execute a professional services agreement with CSG, Consultants, Incorporated to provide construction management and inspection services in an amount not to exceed $119,000 funded from Project 0614. RESOLUTION 2007-121 7. Hazardous Vegetation Abatement (Weeds) a. Adopt resolution declaring hazardous vegetation (weeds) a public nuisance, providing for their abatement and setting a public hearing in order to hear protests. RESOLUTION 2007-122 b. Set January 22, 2008 as a public hearing date on this annual program. 3 Consent Items – Continued 8. Adopt an ordinance of the Town of Los Gatos amending Chapter 14 of the Town Code regarding the regulation of massage therapy establishments and massage therapy practitioners. ORDINANCE 2155 9. New Building and Fire Codes. a. Adopt an ordinance of the Town of Los Gatos replacing Chapters 6 and 9 of the Town of Los Gatos Municipal Code, adopting new building and fire codes. ORDINANCE 2156 b. Adopt resolution making findings for modifying uniform building and fire codes. RESOLUTION 2007-123 10. Adopt a resolution authorizing the disposition of surplus property - Police Canines. RESOLUTION 2007-124 REDEVELOPMENT AGENCY 11. Ratify accounts payable for the month of October 2007. TOWN COUNCIL/REDEVELOPMENT AGENCY 12. Approve Meeting Minutes of: a. Approve Council/Agency minutes of November 5, 2007. b. Approve Council/Agency minutes of November 10, 2007. Council Member Diane McNutt pulled Consent Item #10. Mr. Davis pulled Consent Items #3, #5, and #12a. MOTION: Motion by Council Member Mike Wasserman to approve Consent Items #1, #2, #4, and #6-9, #11 and #12b. Seconded by Vice Mayor Barbara Spector. VOTE: Motion passed unanimously. 4 Consent Items – Continued Mr. Davis  Commented that the Treasurer's report as of August 31, 2007, states an earned interest of $610,046.  Commented that the Town earns $3.5 million dollars a year in interest.  Commented that the Highway 9 improvement project was completed using only half of the designated funding.  Commented that his statement regarding bonding for the new library was not quoted correctly. MOTION: Motion by Council Member Steve Glickman to adopt Consent Items #3, #5 and #12a. Seconded by Vice Mayor Barbara Spector. VOTE: Motion passed unanimously. Council Member Diane McNutt  Recommended to change the resolution to reflect that both retired police dogs, Eddy and Quarz be purchased by the Town’s K9 Officers for $1. MOTION: Motion by Council Member Diane McNutt to adopt Consent Item #10 with the change that both retired police dogs, Eddy and Quarz be purchased by the Town’s K9 Officers for $1. Seconded by Council Member Mike Wasserman. VOTE: Motion passed unanimously. VERBAL COMMUNICATIONS Mr. Davis received a warning for disrupting the meeting. Mr. Davis  Welcomed Greg Larson, Town Manager to the Town and suggested that Mr. Larson bring honesty and integrity to the community.  Commented about a decision made by the Plan ning Commission to approve a home on the hillside. Mr. Davis disrupted the meeting again. Mayor Joe Pirzynski asked Mr. Davis to leave the Chambers. Closed Verbal Communication 5 PUBLIC HEARINGS None. OTHER BUSINESS None. APPOINTMENT OF MAYOR AND VICE MAYOR Mayor Joe Pirzynski  Commented about the appointment process and role of the mayor and vice mayor in Los Gatos. MOTION: Motion by Mayor Joe Pirzynski to appoint Council Member Barbara Spector as Mayor of the Town of Los Gatos. Seconded by Council Member Diane McNutt. VOTE: Motion passed unanimously. Mayor Barbara Spector  Thanked her fellow council members for their support and shared her vision for 2008.  Commented on preserving the hillsides, working to update the general plan, and serving as Mayor of Los Gatos. MOTION: Motion by Mayor Barbara Spector to appoint Council Member Mike Wasserman as Vice Mayor of the Town of Los Gatos. Seconded by Council Member Diane McNutt. VOTE: Motion passed unanimously. Vice Mayor Mike Wasserman  Thanked former Mayor Joe Pirzynski for his outstanding service to the Town and community.  Commented about working with Mayor Barbara Spector and thanked Council for their support. 6 Appointment of Mayor and Vice Mayor – Continued Mayor Barbara Spector  Presented former Mayor Joe Pirzynski with a plaque and commented on his contributions to the community. Town Staff presented former Mayor Member Joe Pirzynski with a video of his year as Mayor. Former Mayor Joe Pirzynski  Thanked Council and staff for the great year.  Spoke about his accomplishments as Mayor.  Commented on the thriving downtown, Hillside Plan, environmental activities, and new police station and library.  Commented on the success of the Los Gatos Prepared and CERT programs and the upcoming General Plan update. Mayor Barbara Spector introduced Honorable Mary Jo Levinger and Honorable Diane Northway. The Judges were invited to conduct the swearing in of Mayor Barbara Spector and Vice Mayor Mike Wasserman.
