M12-4-061 MINUTES OF THE TOWN COUNCIL/PARKING AUTHORITY/REDEVELOPMENT AGENCY DECEMBER 4, 2006 The Town Council of the Town of Los Gatos conducted a Regular Meeting on Monday, December 4, 2006 at 7:00 P.M. TOWN COUNCIL/PARKING AUTHORITY/REDEVELOPMENT AGENCY MEETING CALLED TO ORDER CERTIFICATION OF MUNICIPAL ELECTION 1. Adopt resolution certifying the November 7, 2006 Los Gatos General Municipal Election and declaring the election results MOTION: Motion by Vice Mayor Barbara Spector adopt resolution to certify the November 7, 2006 Election. Seconded by Council Member Diane McNutt. VOTE: Motion passed unanimously. SWEARING IN NEWLY ELECTED COUNCIL MEMBERS Ms. Rose, Clerk Administrator conducted the swearing in process for Mayor Joe Pirzynski, Council Member Diane McNutt, and Council Member Mike Wasserman. ROLL CALL Present: Mayor Joe Pirzynski, Vice Mayor Barbara Spector, Council Member Steve Glickman, Council Member Diane McNutt, and Council Member Mike Wasserman. Absent: None. PLEDGE OF ALLEGIANCE - LED BY FUTURE LEADER Alec Brasier, Town of Los Gatos Youth Citizen of the Year, Red Cross Volunteer and ASB Representative to the Los Gatos-Saratoga Joint High School District Board led the pledge of Allegiance. The audience was invited to participate. 2 CLOSED SESSION REPORT CONFERENCE WITH LABOR NEGOTIATOR (Government Code Section 54957.6) Town Negotiator (Lead): Rumi Portillo, Human Resources Director Employee Organization: Town Employees’ Association (TEA) Mr. Korb stated direction was given and no action was taken. CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION (Government Code Section 54956.9[b]) Claim of Shirley Smith Mr. Korb stated that direction was given and no action was taken. TOWN COUNCIL CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 2. PPW Job No. 06-07 - Curb, Gutter, and Sidewalk Replacement For Fiscal Year 2006-07 Project 0349 Adopt resolution accepting work of C.B. Construction Company, and authorizing the Town Manager to execute certificate of acceptance and notice of completion for recording by the Clerk Administrator TOWN COUNCIL/REDEVELOPMENT AGENCY 3. Consider adopting a resolution approving the 2005/06 Annual Report for the Los Gatos Redevelopment Agency 4. Approve Council/Agency minutes of November 20, 2006 Mayor Joe Pirzynski requested staff to make minor procedural corrections to the November 20, 2006 minutes. MOTION: Motion by Council Member Steve Glickman adopt Consent Items #1-4 with corrections to the minutes of November 20, 2006. Seconded by Council Member Mike Wasserman. VOTE:Motion passed unanimously. 3 VERBAL COMMUNICATIONS Mr. Davis Commented regarding the re-election of the incumbents. Commented regarding funding of radar signs for the school zones. Commented regarding the De Santis project which was appealed to the Town Council. Ms. Goodson Commented regarding garbage along the Los Gatos Creek Trail, and requested trash cans be placed along the trail. Requested staff to address the leaking drinking faucets along the trail. Closed Verbal Communication PUBLIC HEARINGS None this evening. OTHER BUSINESS 5. Discussion and direction on the use of Segways on the Los Gatos Creek Trail in Los Gatos Staff report made by Mr. Curtis, Parks and Public works Director. Mr. Korb clarified that there is no restrictions along the trail at this time. Council Comments Commented regarding restrictions relating to motorized vehicles along the trail. Clarification regarding regulations relating to the use of Segways along the trail at this time. Clarification regarding the process relating to "special events.” Questioned the discussion and recommendations from the Parks Commission relating to Segways. Questioned the definition of "tours.” Questioned the definition of a Segway verses a mobility enhanced vehicle for people with disabilities. Clarification regarding regulations relating to vehicles used for people with disabilities along the trails. Clarification on the scope of discussion of restrictions relating to use of Segways on the creek trails. 4 Other Business - Item #5 Continued Open Public Comments Mr. Ko Commented on supporting the use of Segways along the Los Gatos Creek Trail. Commented regarding the design of the Segway. Commented on the use of Segways among the disabled community. Mr. Schmidt Commented on supporting the use of Segways along the Los Gatos Creek Trail. Commented on speed regulations along the trail and the footprint of a Segway. Mr. Hanson Requested a ban on Segways along the Los Gatos Trail. Commented regarding the narrow trails and poor visibility along parts of the Los Gatos Creek Trail. Ms. Erikson Commented on supporting a ban on Segways along the Los Gatos trails. Mr. Hall Commented regarding the use of Segways in other cities. Commented regarding the safety issues relating to use of Segways along the trail. Commented on supporting regulations for Segway tours along the trail. Suggested offering a probation period for Segways. Mr. Jenson Commented on supporting a ban relating to use of Segways along the Los Gatos Creek Trail. Mr. Griffin Commented on supporting a ban relating to use of Segways along the Los Gatos Creek Trail. 5 Other Business - Item #5 Continued Public Comments Ms. Weisshalen Commented on supporting a ban on the use of Segways along the Los Gatos Creek Trail. Closed Public Comments Council Discussion Commented regarding the high level of pedestrian and bicycle traffic along the Los Gatos Creek Trails. Questioned the amount of congestion if both bicycles and Segways used the trails. Commented regarding the tight corners along the trails. Commented on potential safety issues relating to Segways and bicycles using the trails. Questioned the use of mechanical devices along the Los Gatos Creek Trail. Commented on supporting a ban for Segways along the Los Gatos Creek Trail. Suggested that staff draft an ordinance restricting Segways, but to allow accommodations for the disabled community along the Los Gatos Creek Trail. Council Matters Council thanked staff and the various service clubs for all the help to make the tree lighting and parade a huge success.
