M11-20-061 MINUTES OF THE TOWN COUNCIL/PARKING AUTHORITY/REDEVELOPMENT AGENCY NOVEMBER 20, 2006 The Town Council of the Town of Los Gatos conducted a Regular Meeting on Monday, November 20, 2006 at 7:00 P.M. TOWN COUNCIL/PARKING AUTHORITY/REDEVELOPMENT AGENCY MEETING CALLED TO ORDER ROLL CALL Present: Council Member Steve Glickman, Vice Mayor Joe Pirzynski, Council Member Barbara Spector, Council Member Mike Wasserman, and Mayor Diane McNutt. Absent: None. PLEDGE OF ALLEGIANCE - LED BY FUTURE LEADERS Former Pledge leaders listed below were asked to recite the pledge of allegiance. CLOSED SESSION REPORT None this evening. PRESENTATION /COMMENDATION Commendation Los Gatos Prepared - Recognition of CERT and host site participants. Mayor Diane McNutt presented Bill Mercer, the Los Gatos CERT Team, and staff with a commendation for the Los Gatos Prepared campaign held in October, 2006. 2 TOWN COUNCIL CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Ratify payroll for the month of October 2006 2. Ratify accounts payable for the month of October 2006 3. Abatement of Hazardous Vegetation (Weeds) a. Adopt resolution declaring hazardous vegetation (weeds) a public nuisance and providing for their abatement and setting a public hearing in order to hear protests. RESOLUTION 2006-118 b. Set January 16, 2007, as a public hearing date on this annual program 4. Oak Meadow Park Retaining Wall Replacement Project (0715) (PPW Job No. 05-16) a. Amend Capital Improvement Program Budget to advance Oak Meadow Park Retaining Wall Replacement Project (0715) from the planned project timeline of Fiscal Year 2008/09 to the current Fiscal Year 2006/07 (PPW Job No. 04-16) b. Authorize budget revenue adjustment of $15,000 from State Proposition 12 Park Bond Funds to Oak Meadow Park Retaining Wall Replacement Project (410-0715) c. Authorize use of $11,500 from reserve for Future Year’s Capital Projects Fund for the Oak Meadow Park Retaining Wall Replacement Project (400-0715) d. Authorize budget expenditure adjustment of $26,500 for the Oak Meadow Park Retaining Wall Replacement Project (0715) REDEVELOPMENT AGENCY 5. Main Street Resurfacing and Streetscape Project (0217) and Los Gatos-Almaden Road Resurfacing Project (0606) (PPW Job No. 04-63) a. Adopt resolution accepting work of Joseph J. Albanese, Incorporated and authorizing the Town Manager/Executive Director to execute Certificate of Acceptance and Notice of Completion for recording by the Clerk Administrator/Secretary of the Redevelopment Agency RESOLUTION 2006-119 b. Authorize transfer of $115,710 STP Grant Funds from Main Street Resurfacing Project (410-0217) to Los Gatos Almaden Road resurfacing Project (410-0606) c. Authorize budget increase and transfer of $42,308 from Street Repair and Resurfacing Program (480-0352) to the Los Gatos Almaden Road Resurfacing Project (480-0606) d. Authorize budget expenditure adjustment of $42,308 for the Los Gatos Almaden Road Resurfacing Project (0606) MOTION: Motion by Council Member Steve Glickman to approve Consent Items #1-7. Seconded by Vice Mayor Barbara Spector. VOTE:Motion passed unanimously. VERBAL COMMUNICATIONS Mr. Davis Congratulated the incumbents on their re-election. Commented regarding the De Santis project which was appealed to the Town Council. Mr. Burke Commented regarding the Los Gatos Creek Trail closing in Vasona Park at 4:30 during the Festival of Lights. 4 Verbal Communications Continued Mr. Arzie Commented regarding the loss of retail to restaurants and professional service shops in the downtown area. Suggested staff look into the process relating to Conditional Use Permits in the downtown area. APPOINTMENT OF MAYOR AND VICE MAYOR Mayor Diane McNutt Commented on her year as a Mayor. Commented regarding the process for nominating a new Mayor and Vice Mayor. MOTION: Motion by Mayor Diane McNutt to appoint Vice Mayor Joe Pirzynski as the 59th Mayor for the Town of Los Gatos. Seconded by Council Member Mike Wasserman. VOTE:Motion passed unanimously. MOTION: Motion by Mayor Joe Pirzynski to appoint Council Member Barbara Spector as Vice Mayor of the Town of Los Gatos. Seconded by Council Member Steve Glickman. VOTE:Motion passed unanimously. 5 Appointment of Mayor and vice Mayor Continued Mayor Joe Pirzynski Commented on Council Member Diane McNutt’s year as the Mayor. Thanked the community, staff and Council Member Diane McNutt for a year of great accomplishments. Commented on his visions for the upcoming year as Mayor. Thanked his fellow Council Members, wife, and the entire community for their support. Vice Mayor Spector Thanked Mayor Pirzynski and Council for giving her the opportunity to serve as Vice Mayor. Commented on her continued stewardship regarding the community of Los Gatos. Mayor Pirzynski Presented Council Member Diane McNutt with the ceremonial Mayors plaque, and a video produced by Town staff in honor of her achievements in the past year. Commented on her help with the Katrina Consortium and her leadership in the Los Gatos Prepared campaign. Council Member McNutt Thanked the Council, staff, her family, and the community for all their support. Mayor Joe Pirzynski introduced Congressman Mike Honda. Congressman Mike Honda administered the ceremonial swearing in for Mayor Joe Pirzynski and Vice Mayor Barbara Spector.
