M 06-13-94 JTTOWN OF LOS GATOS CALIFORNIA JOINT TOWN COUNCIL/PARKING AUTHORITY REDEVELOPMENT AGENCY June 13, 1994 Minutes TOWN COUNCIL/REDEVELOPMENT AGENCY The Town Council/Parking Authority/Redevelopment Agency of the Town of Los Gatos met in the Council Chambers of the Town Hall, 110 East Main Street, at 7:38 p.m., Monday, June 13, 1994, in regular session. ROLL CALL Present:Joanne Benjamin, Steven Blanton, Linda Lubeck, Patrick O'Laughlin and Mayor/Chairman Attaway. Absent:None. PLEDGE OF ALLEGIANCE Given by all in attendance. CLOSED SESSION Larry Anderson, Town Attorney, stated that Council had met in Closed Session prior to this evening's meeting pursuant to Government Code Section 54956.9(a), to discuss Pending Litigation regarding O'Shea's Bar & Grill, et al. v. Town of Los Gatos, et al., Santa Clara County Superior Court Case No. CV738010. Further proceedings in the case were discussed and Council gave directions for pursuing the case. Pursuant to Government Code Section 54957, Council met to discuss a Personnel matter concerning the Town Attorney Evaluation. Pursuant to Government Code Section 54957.6, Council met to discuss Labor Relations with Town negotiator concerning Town Employees' Association, AFSCME, Police Officer's Association, Confidential Employees, and Management Staff regarding negotiating strategies. BELOW MARKET RATE UNIT/HENNING COURT 122/BMP LOAN (01.19) Motion by Mr. Blanton, seconded by Mrs. Lubeck, that Council approve a Town loan of $21,900 to BMP unit purchaser in the form of a Second Trust Deed at 6% interest for a 15-year term from the Below Market Price (BMP) Program Fund for purchase of a Below Market Price unit at 122 Henning Court, which loan shall be subject to the conditions included in this report. Carried unanimously. HEARING OPERATING BUDGET 1994-95/COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS (05.06) Mayor Attaway stated that this was the time and place duly noted for public hearing to consider the TC:D6:MM061394 1994-95 Operating Budget for the Town and Redevelopment Agency and use of Community Development Block Grant Funding. The following people from the audience addressed this issue: Lane Davis, President of LGPOA, asked for Council's continued financial support for the police department and public safety services of the Town. Tony Silvera, 16470 Matilla, requested that the motorcycle officers be retained. Kevin Smith, Wilder Ave, asked that the motorcycle and community service officers be retained. Debra Harrison, Oak Rim Crt, spoke for the motorcycle officers. Pete Seimens, Ellenwood Ave, representing Mid Peninsula Regional Open Space District, spoke on St. Joseph's Hill Open Space Preserve and suggested a joint project on the opening of Jones Trail. Del Woods, 407 W Seacliff, Aptos, spoke of reopening the historic Jones Road Trail and the request for financial support from the Town of $30,000. John Snellham, 207 Old Adobe Rd, Silicon Valley Art Fund request for seed money of $1,000. Preston Hill, 33 Peralta Ave, expressed opinions regarding the upcoming financial forums and suggested some methods in reducing Town's budget and concentrating on Town's infrastructure. Tim Morgan, addressed the issue of the Town's need for motorcycle officers particularly for emergencies during special events or restricted traffic conditions. Randy Vallata, spoke in favor of retaining motorcycle officers. No one else from the audience addressed this issue. Motion by Mr. Blanton, seconded by Mrs. Benjamin, to close the public hearing. Carried unanimously. Motion by Mr. Blanton, seconded by Mr. O'Laughlin, to fund $1,000 from unfunded balance to the Silicon Valley Art Fund. Carried unanimously. Motion by Mr. Blanton, seconded by Mrs. Lubeck, to fund $2,500 from unfunded balance to Joint Ventures Silicon Valley Network. Carried unanimously. Motion by Mr. Blanton, seconded by Mrs. Benjamin, to fund $10,000 from unfunded balance and reestablish the motorcycle officers. Carried by a vote of 4 ayes. Mayor Attaway voted no due to various underlying financial issues involved with the use of motorcycles. STREET BANNERS/PUBLIC RIGHT-OF-WAY/SIGNS/RESOLUTION 1994-79 (06.46) Motion by Mrs. Benjamin, seconded by Mr. O'Laughlin, that Council adopt Resolution 1994-79 entitled, RESOLUTION OF THE TOWN OF LOS GATOS ADOPTING A TOWN-WIDE POLICY REGARDING THE PLACEMENT OF BANNERS ON LIGHT STANDARDS IN THE PUBLIC RIGHT-OF-WAY, and includes the desk item Exhibit A and photographs submitted for the record. Carried unanimously. Council consensus that Mrs. Lubeck review the banner policy with the banner committee, and return to Council with a proposal. STREET BANNER/CELEBRATING BRAZILIAN SOCCER TEAM/AMERICAN SAVINGS (07.46) Motion by Mrs. Benjamin, seconded by Mrs. Lubeck, that Council approve the request from American Savings Bank to display a street banner in the public right-of-way celebrating the Brazilian Soccer Team and directing the applicant to work with the Director of Parks Forestry and Maintenance to install the banner and thanking the applicant for the work involved in accomplishing this. Carried unanimously. TC:D6:MM061394 June 13, 1994 Los Gatos, California BLACKWELL DRIVE BENEFIT ZONE/LANDSCAPING AND LIGHTING DISTRICT #1 FILING ANNUAL REPORT/RESOLUTION 1994-80 (02.04) Motion by Mr. Blanton, seconded by Mrs. Lubeck, that Council adopt Resolution 1994-80 entitled, RESOLUTION OF THE TOWN OF LOS GATOS ORDERING THE DISTRICT ENGINEER TO PREPARE AND FILE AN ANNUAL REPORT IN ACCORDANCE WITH STREETS & HIGHWAYS CODE SECTION 22565 AND FOLLOWING REGARDING LANDSCAPING AND LIGHTING ASSESSMENT DISTRICT NO. 1 -- BLACKWELL DRIVE BENEFIT ZONE OF THE TOWN OF LOS GATOS. Carried unanimously. GEMINI COURT/LANDSCAPING AND LIGHTING DISTRICT #2 FILING ANNUAL REPORT/RESOLUTION 1994-81 (03.04) Motion by Mr. Blanton, seconded by Mrs. Lubeck, that Council adopt Resolution 1994-81 entitled, RESOLUTION OF THE TOWN OF LOS GATOS ORDERING THE DISTRICT ENGINEER TO PREPARE AND FILE AN ANNUAL REPORT IN ACCORDANCE WITH STREETS & HIGHWAYS CODE SECTION 22565 AND FOLLOWING REGARDING LANDSCAPING AND LIGHTING ASSESSMENT DISTRICT NO. 2 -- GEMINI COURT OF THE TOWN OF LOS GATOS. Carried unanimously. CRIMINAL APPREHENSION PROGRAM/OCJP GRANT/RESOLUTION 1994-82 (04.09) Motion by Mrs. Lubeck, seconded by Mr. Blanton, that Council adopt Resolution 1994-82 entitled, RESOLUTION OF THE TOWN OF LOS GATOS AUTHORIZING THE TOWN MANAGER TO SUBMIT A PROPOSAL TO THE OFFICE OF CRIMINAL JUSTICE PLANNING FOR A CAREER CRIMINAL APPREHENSION PROGRAM GRANT. Carried unanimously. COMMISSION APPOINTMENTS/COUNCIL POLICY (08.10) Motion by Mrs. Lubeck, seconded by Mrs. Benjamin, that Council approve amendment of Council policy on Commission appointments. Carried unanimously. COUNCIL MEETING SCHEDULE/1994-95 (09.10) Motion by Mrs. Lubeck, seconded by Mrs. Benjamin, that Council approve the Town Council Meeting Schedule for Fiscal Year 1994-95.
