TOWN COUNCIL
The Town Council/Parking Authority of the Town of Los Gatos met in the Council Chambers
of the Town Hall, 110 East Main Street, at 7:45 p.m., Monday, March 16, 1992, in regular
session.
ROLL CALL
Present:Randy Attaway, Joanne Benjamin, Steven Blanton,

ARTS COMMISSION/APPOINTMENT/KATHY HARLAN/TRACEY INDRA-STEPHENS

Mayor Carlson announced that this was the time for interviews of applicants for the Arts
Commission. Applications were received from Kathy Harlan and Tracy Indra-Stephens.
Voting was held and Kathy Harlan and Tracy Indra-Stephens were appointed to the
Commission. Terms to expire 7/1/92 and 7/1/94.
PARK COMMISSION/APPOINTMENT/PAMELA MC KELL/EMMA VARGO (00.23)
Mayor Carlson announced that this was the time for interviews of applicants for the Park
Commission. Applications were received from Pamela Mc Kell, Paul Seaborn, Norbert Witt
and Emma Vargo. Voting was held and Pamela Mc Kell and Emma Vargo were reappointed
to the Commission. Terms to expire 4/1/96.
COMMUNITY SERVICES/COMMENDATION/CATHERINE KLEIN-FISHER (00.23)
Mayor Carlson presented a commendation from the Town to Catherine Klein-Fisher honoring
her ten years of service and dedication to the Community Services Commission.
ART COMMISSION/COMMENDATION/VALORIE HILL (00.23)
Mayor Carlson presented a commendation from the Town to Valorie Hill noting her years of
service and work on the Arts Commission.

Mayor Carlson presented commendations from the Town to the following people for their
service to the Town in the form of volunteering their time and energy to the Library facilities:

Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council ratify accompanying
check registers for accounts payable invoices in the amount of $330,958.64 paid on
February 28 and March 6, 1992. Carried unanimously.

Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council reject the claim of

TORTOISE & THE HARE/10K FUN RUN (06.20)
Informational item regarding the eighth annual Tortise & The Hare 10/5 kilometer fun run to
be held Sunday, April 29, 1992, was received and filed.
HOLY CITY DASH/10K RACE (07.20)
Informational item regarding the Lion's Club second annual Holy City Dash, 10 kilometer
race to be held Sunday, April 12, 1992, was received and filed.
SUPER CITIES WALK/MULTIPLE SCLEROSIS/BENEFIT (08.20)
Informational item regarding the third annual 15 kilometer Super Cities Walk for Multiple
Sclerosis, to be held on April 5, 1992, by the Santa Clara County Chapter of the National
Multiple Sclerosis Society, was received and filed.

Informational item regarding the 37th annual Lions Club barbecue to be held on Sunday,

BUS STOP/ALBERTO/AUTHORIZATION OF FUNDING (11.38)
Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council approve the location
and funding of $1,500 for the proposed bus stop at Alberto Way, and staff to follow up with
letter to the Transportation Agency concerning change in the bus route in order to make the
best use of this new stop as per the original plan regarding this location. Carried
unanimously.

Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council authorize the Mayor to
execute and the Town Clerk to record a Certificate of Acceptance and Notice of Completion
for Tract 8400. Carried unanimously.
HUMAN SERVICES ELEMENT/REFERRAL TO PLANNING COMMISSION (15.47)
Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council refer the revised
Human Services Element to the Planning Commission for public hearing and
recommendation. Carried unanimously.
JENNINGS/COMMENDATION/20 YEARS OF SERVICE/RESOLUTION 1992-41 (16.43)
Motion by Mrs. Benjamin, seconded by Mr. Attaway, adopting Resolution 1992-41
entitled, RESOLUTION OF THE TOWN OF LOS GATOS COMMENDING JOHN
JENNINGS FOR 20 YEARS OF SERVICE TO THE TOWN OF LOS GATOS . Carried
unanimously.
DOWNTOWN NEIGHBORHOOD CENTER/RESOLUTION 1992-42 (18.44)
Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council adopt Resolution 1992-
42 entitled, RESOLUTION OF THE TOWN OF LOS GATOS ADOPTING POLICIES AND
PROCEDURES FOR THE LOS GATOS NEIGHBORHOOD CENTER, approving an
amendment to the Neighborhood Center policies and procedures regarding insurance
requirements; and guidelines for Town employees' use of the Center. Carried unanimously.
SIERRA AZULE/VACATION/PUBLIC RIGHT-OF-WAY/RESOLUTION 1992-43 (19.08)
Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council adopt Resolution 1992-
43 entitled, RESOLUTION OF THE TOWN OF LOS GATOS ORDERING THE VACATION
OF EXCESS PUBLIC RIGHT-OF-WAY ON SIERRA AZULE, abandoning a strip of excess
public right-of-way along the southerly side of Sierra Azule. Carried unanimously.
HISTORIC PRESERVATION/GRANT APPLICATION/RESOLUTION 1992-44 (20.15)
Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council adopt Resolution 1992-
44 entitled, RESOLUTION OF THE TOWN OF LOS GATOS CONCERNING THE FILING OF
AN HISTORIC PRESERVATION FUND GRANT APPLICATION , authorizing the Town
Manager to submit an application for the Historic Preservation Fund Matching Grant to
establish a public information computer system. Carried unanimously.

45 entitled, RESOLUTION OF THE TOWN OF LOS GATOS DENYING APPEAL OF A
PLANNING COMMISSION DECISION TO DENY A REQUEST FOR PERMISSION TO
OPERATE A FAST FOOD RESTAURANT WITHOUT ALCOHOLIC BEVERAGES ON
PROPERTY IN THE CH ZONE (BURGER KING RESTAURANTS). CONDITIONAL USE
PERMIT APPLICATION U-91-11, which incorporates the Council findings and decision at its
meeting of March 2, 1992. Carried unanimously.

ABATEMENT OF VIOLATIONS/ORDINANCE 1892 (26.47)
Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council adopt Ordinance 1892
entitled, ORDINANCE OF THE TOWN OF LOS GATOS AMENDING SECTION 1.10.100
OF THE TOWN CODE which was introduced on March 2, 1992. Carried unanimously.
HEARINGS
COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS/ALLOCATION/HEARING
RESOLUTION 1992-46 (27.19)
Mayor Carlson stated that this was the time and place duly noted for public hearing to
consider adoption of resolution allocating Community Development Block Grant Funds
granted to the Town for Fiscal Year 1992-93.
The following people from the audience spoke to this issue:
Mary Alice Blice, Community Services Commission Chairman, explained how the
Commission interviewed and worked with the applicants on their requests for funds. The
Commission's priorities were housing, health and food.
Chris Wiley, explained the process of the Adopt an Agency program administered by the
Community Services Commission.
Leita Freelander, Live Oak Adult Day Care Director, thanked Council for previous
generosity and explained the need for funding this year.
Jane Cohen, SJSU Foundation/Health Place Representative, 575 Campbell Ave., Los Altos,
explained the nursing services given by this program to the home bound in Los Gatos.
Mary Ellen Heisling, Second Harvest Food Bank Program Director, 1125 Olive Branch Ln.,
distributors of supplemental foods in the Brown Bag program spoke of the need for funds to
cover shipping costs in order to import additional food supplies for distribution.
Regina Falkner, Community Services Director, reporting for Affordable Housing Fund and
Housing Conservation Program. The Affordable Housing subsidizes affordable housing
developments in Los Gatos. Most recently $300,000 was made available to the Mid
Peninsula Housing Coalition's project on Parr Ave. There is a balance of $13,000 on hand
and the program is not requesting funds at this time. The Housing Conservation program is
requesting funds for loans and administration costs specifically for the housing rehabilitation
program which are revolving loans.
Katherine Brown, Economic and Social Opportunities, provides housing and energy
services which provide handiwork and weatherization in the home access program. Helps
preserve the existing affordable housing in the Town for low income seniors, disabled and
female head of households.
Susan Wilson, suggested that Council communicate with Town's representative, Mike
Honda, on the Board of Supervisors regarding the Live Oak Adult Day Care program.

Mayor Carlson, agreed to having a letter from Council go to Supervisor Honda and
requested the Councilmembers also call him requesting support for Live Oak.

CDBG FUNDS CONT.
Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council adopt Resolution 1992-
46 entitled, RESOLUTION OF THE TOWN OF LOS GATOS ALLOCATING COMMUNITY
DEVELOPMENT BLOCK GRANT FUNDS TO THE TOWN OF LOS GATOS FOR FISCAL
YEAR 1992-93, as recommended by the Community Services Commission. Carried by a
vote of three ayes. Mr. Ventura and Mayor Carlson voting no, feeling that top priority should
be given to food and treatment and administrative costs should be further analyzed.
SOLID WASTE MANAGEMENT PLAN/SANTA CLARA COUNTY/HEARING (28.07)
Mayor Carlson stated that this was the time and place duly noted for public hearing to
consider amending Solid Waste Management Plan for Santa Clara County.

Mary Lou Flynn, 209 Nob Hill Way, supports the staff recommendation.

Motion by Mr. Ventura, seconded by Mr. Blanton, that Council reject the amendment to
the County Solid Waste Management Plan for the County of Santa Clara, 1989 Revision,
which allows importation of limited amounts of nonhazardous treated auto shredder waste
from San Mateo County, and that Council instruct staff to forward a strong recommendation
that all other solid waste disposal sites should carry the same type permit as the one we
have at Guadalupe. Carried unanimously.
KNOWLES DRIVE 555/MEDICAL OFFICE FACILITY/NME HOSPITALS/HEARING (29.09)
Mayor Carlson stated that this was the time and place duly noted for public hearing to
consider an appeal of a decision of the Planning Commission denying a request for approval
of plans to construct a 59,864 sq. ft. medical office facility in the "O" zone. Architecture and
Site Application S-90-9A and Negative Declaration ND-90-9. Property is located at 555
Knowles Drive. Property owner, NME Hospitals. Applicant, Bob Elmore, Elmore Design
Group.

Truman Gates, Los Gatos-Saratoga Community Hospital Chief Executive Officer, analyzed
hospital expansion project and requested a dual tracking exercise for Hospital, Council and
Planning Commission..
Bob Elmore, Architect for proposed project, asked for Council's consideration and explained
the layout on the lot.
Barry Slater, Community Hospital Chief of Staff and Member of the Board, explained the
need for the new facility by the community and the needs of the physicians.

KNOWLES DRIVE CONT.
Mary Lou Flynn, was opposed to the project due to size and increase in traffic.
Dr. Patrick Marroni, 16131 Bachman, on Board of Trustees of Hospital, spoke of the
needs of physicians for office space near the hospital they use for their patient's care.
Dr. Safori, Community Hospital Chief of Medicine, spoke of residency in Los Gatos and
need of offices near the hospital keeping commute time to a minimum and alleviating some
traffic impact concerns.
Susan Wilson, Community Hospital Board Member, requested Council investigate, with
neighboring communities, ways to mitigate the traffic concerns associated with this project.

Motion by Mr. Ventura, seconded by Mrs. Benjamin, to close the public hearing. Carried
unanimously.
Motion by Mrs. Benjamin, seconded by Mr. Ventura, that Council deny the appeal and
return the proposal to the Planning Commission for study of the following considerations:
1. Intensification of use and future use; 2. Traffic Impacts now and future; circulation plan
and signalization; 3. Future development in the area; overall intensification of the
neighborhood; 4. Architectural concerns; height, size, scale, style, materials; 5. Site plan;
total site, and siting of building on the lot; 6. Landscaping; 7. Parking. Carried
unanimously.
ACCESSORY STRUCTURES/ZONING ORDINANCE/A-90-12/HEARING (30.47)
Mayor Carlson stated that this was the time and place duly noted for public hearing to
consider an amendment to the Town Zoning Ordinance to modify the required yards for
accessory structures other than secondary dwelling units and accessory living quarters. This
matter will not have a significant impact on the environment and is, therefore, not subject to
the requirements of the California Environmental Quality Act. Zoning Ordinance Amendment
A-90-12 Applicant: Town of Los Gatos.
The following people from the audience spoke to this issue:
Maggie Parkin, 17100 Crescent Drive, opposed the passage of this ordinance in the
hillside zone.
Walt Korber, 17110 Crescent Drive, would like to see approval of the ordinance due to the
lack of usability of his lot.
Don Barnes, 17120 Crescent Drive, supports the set back ordinance and questioned the

Danny Mander, 226 Vista Del Monte, was concerned about existing structures, conceding
that legally constructed units could remain.

ACCESSORY STRUCTURES CONT.
Motion by Mr. Attaway, seconded by Mr. Ventura, that Council amend the proposed
ordinance by adding, "alternative 2 as recommended by the Planning Commission at its
meeting of Feb. 7, 1992, but excluding the HR and RC zones" and return the proposed
ordinance to Council for action April 6, 1992. Carried unanimously.
ONE AND TWO FAMILY DWELLINGS/ZONING ORDINANCE/A-92-1/HEARING (31.47)
Mayor Carlson stated that this was the time and place duly noted for public hearing to
consider amendment to the Town Zoning Ordinance to permit one and two-family dwellings
with an approved Conditional Use Permit in the "O" (Office) zone. This matter will not have a
significant impact on the environment and is, therefore, not subject to the requirements of the
California Environmental Quality Act. Zoning Ordinance Amendment A-92-1. APPLICANT:
Town of Los Gatos.

Harry Lesh, M.D., 17510 Farley Rd., approves the staff recommendation to permit single
and two family dwellings in the office zone.

Motion by Mr. Ventura, seconded by Mrs. Benjamin, that Council waive the reading of the
proposed ordinance. Carried unanimously. The Town Clerk read the title of the proposed
ordinance.
Motion by Mr. Ventura, seconded by Mrs. Benjamin, that Council introduce Draft
Ordinance entitled, ORDINANCE OF THE TOWN OF LOS GATOS AMENDING THE
ZONING ORDINANCE CONCERNING THE CATEGORIES OF RESIDENTIAL USES
PERMITTED IN VARIOUS ZONES WITH A CONDITIONAL USE PERMIT. Carried

FIREPLACES/WOOD BURNING STOVES (34.13)
Mayor Carlson stated that this was the time and place duly noted to consider the use of
fireplaces and wood burning stoves.

Eric Morely, Legislative Advocate for Board of Realtors, stated that the Board approved the
proposed ordinance.

Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council direct staff to draft a
section to the Zoning Ordinance making it an infraction to: use fireplaces and other wood
burning devices (Environmental Protection Agency - EPA Phase II certified devices
excepted) when the Bay Area Air Quality Management District issues the "Don't Light
Tonight" warning and when an alternate approved heat source is available; burn garbage,
plastics, rubber, waste solvent, paint, oil, painted or treated wood, particle board, plywood,
salt-water driftwood, coal, glossy or colored paper, and any other fuel which produces
noxious, corrosive or toxic smoke and fumes; sell, advertise, transfer, install or replace a
wood burning appliance that does not meet minimum EPA Phase II Certified Standards or
equivalent. Request that realtors voluntarily provide a copy of the "Woodburning Handbook"
to clients that purchase within Town limits and provide 180 day delay in implementing
recommended actions to disseminate information and to allow vendors to deplete existing
non-conforming stock. Carried unanimously.

Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council waive the reading of the

BONNIE VIEW MOBILE HOME PARK/RENT ADVISORY COMMISSION REPORT (12.16)
Informational item regarding a petition signed by Bonnie View Mobile Home Park residents in
regards to their dissatisfaction with the Town's Rent Mediation and Arbitration Ordinance,
was received and filed.
Jack Cole, 14685 Oka Rd. #53, requested Council consider Rent Mediation and Dispute
Ordinance for Mobile Homes.
Jourdan Clish, 14685 Oka Rd. #52, tenant representative to the Rent Advisory
Commission, requested a legal opinion on certain questions from Town Attorney.
Motion by Mr. Ventura, seconded by Mr. Attaway, that Council request RAC to do an
analysis. They should contact both Golden State Mobile Home Assoc. and Tri County
Apartment Assoc. (or a representative with an opposing point of view to the Mobile Home
Assoc.) requesting input regarding the proposed ordinance presented by Mr. Cole and the
questions regarding pass throughs submitted by Mr. Clish and return with a policy
recommendation on the items within sixty days, and to also direct staff to work with the RAC
in compiling this information and submitting an analysis to assist the RAC in making a
decision. Carried unanimously.
MULTIPLE FAMILY DWELLINGS/ZONING ORDINANCE AMENDMENT (13.09)
Motion by Mr. Attaway, seconded by Mrs. Benjamin, that Council direct the Planning
Commission to make recommendations which will include FAR standards and other existing
standards for type of property and its zoning considerations. Where a unit is nonconforming
to setback a second story may be considered. The increase in average market value units
will be considered additional housing stock, but BMP units will be considered unfeasible. A
point to be considered is that add ons to what is presently considered affordable housing
may increase the rents to the point that we eliminate one of our prime sources of affordable
housing. Carried unanimously.

GENERAL PLAN/ENVIRONMENTAL IMPACT REPORT/KREINES AND KREINES
CONSULTANT SERVICES/RESOLUTION 1992-48 (21.39)
Motion by Mr. Ventura, seconded by Mr. Blanton, that Council adopt Resolution 1992-48
entitled, RESOLUTION OF THE TOWN OF LOS GATOS AUTHORIZING THE EXECUTION
OF AN AGREEMENT FOR CONSULTANT SERVICES TO PREPARE GENERAL PLAN
AMENDMENTS AND AN ENVIRONMENTAL IMPACT REPORT FOR THE AREA ALONG
THE ROUTE 85 CORRIDOR, authorizing the Town Manager to sign an agreement with
Kreines and Kreines, Inc, and to direct staff to change future request for proposal
applications to include errors and omissions insurance. Carried unanimously.
Debbie Tanner, was in total approval of staffs recommended action.
Mary Lou Flynn, questioned the availability of the EIR which was noted to be accessible in
the Library.
PARKING LOT 4/CONTAMINATION/REMEDIATION/GEOMATRIX CONSULTANTS INC.
RESOLUTION 1992-49 (23.35)
Motion by Mrs. Benjamin, seconded by Mr. Ventura, that Council adopt Resolution 1992-
49 entitled, RESOLUTION OF THE TOWN OF LOS GATOS AUTHORIZING THE TOWN
MANAGER TO EXECUTE A CONTRACT WITH GEOMATRIX CONSULTANTS,
INCORPORATED TO OVERSEE REMEDIATION OF CONTAMINATION AT PARKING
LOT 4 specifically for the Scope of Services delineated in sections "1.a." and "1.e." with the
rest of the body to return as an addendum to this resolution. Carried by a vote of 4 ayes.
