M 04-29 91TOWN OF LOS GATOS CALIFORNIA TOWN COUNCIL/PARKING AUTHORITY April 29, 1991 Minutes TOWN COUNCIL The Town Council/Parking Authority of the Town of Los Gatos met in the Council Chambers of the Town Hall, 110 East Main Street, at 7:40 p.m., Monday, April 29, 1991, in special session. ROLL CALL Present:Randy Attaway, Joanne Benjamin, Steven Blanton, and Vice-Mayor Eric D. Carlson. Absent:Mayor Brent N. Ventura. PLEDGE OF ALLEGIANCE Given by all in attendance. CLOSED SESSION Natalie West, Acting Town Attorney, reported that Council had met in Closed Session prior to this evening's meeting pursuant to Government Code Section 54956.9(a) to discuss Tallent vs Town of Los Gatos. There was no report from that discussion at this time. Pursuant to Government Code Section 54957, Council met to discuss Personnel matters. There is no report from that discussion at this time. Pursuant to Government Code Section 54957.6, Council met to discuss Labor Relations. There is no report from that discussion at this time. VERBAL COMMUNICATIONS Steve Wagh, 209 Hollywood Ave., requested assistance from the Council in taking care of a neighborhood problem involving a privately owned control box situated on Town property right-of-way on Hollywood Ave. Vice-Mayor Carlson asked for report and recommendation from staff addressing this situation to return to Council May 6, 1991. TC:D1:MM042991 HEARINGS HANDICAPPED ACCESSIBILITY/AMENDMENTS/ZONING ORDINANCE/A-91-1/HEARING RESOLUTION 1991-69 Vice-Mayor Carlson stated that this was the time and place duly noted for public hearing to consider adoption of resolution and introduction of ordinance amending the zoning ordinance concerning handicapped accessibility and adaptability requirements (A-91-1). Applicant: Town of Los Gatos. TC:D1:MM042991 April 29, 1991 Los Gatos, California HANDICAPPED ACCESSIBILITY CONT. The following person addressed Council concerning this issue. Jim Lewis, 156 Vista Del Monte, felt that the ordinance was fine, and he was just in the audience to observe the final process. No one else from the audience addressed this issue. Motion by Mr. Blanton, seconded by Mrs. Benjamin, that Council close the public hearing. Carried by a vote of 4 ayes. Mayor Ventura absent. Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council continue the discussion and adoption of a resolution for adaptability and accessibility requirements for physically disabled persons for residential and nonresidential developments to May 20, 1991. Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council adopt Resolution 1991- 69 entitled, RESOLUTION OF THE TOWN OF LOS GATOS REGARDING HANDICAPPED ADAPTABILITY AND ACCESSIBILITY REQUIREMENTS. Carried by a vote of 4 ayes. Mayor Ventura absent. Motion by Mrs. Benjamin, seconded by Mr. Blanton, that Council waive the reading of the draft ordinance. Carried by a vote of 4 ayes. Mayor Ventura absent. The Town Clerk read the Title of the draft ordinance. Motion by Mr. Blanton, seconded by Mrs. Benjamin, that Council introduce Draft Ordinance entitled, ORDINANCE OF THE TOWN OF LOS GATOS AMENDING THE ZONING ORDINANCE CONCERNING ADAPTABILITY AND ACCESSIBILITY REQUIREMENTS FOR NEW DEVELOPMENTS TO ACCOMMODATE PERSONS WITH PHYSICAL DISABILITIES. Carried by a vote of 4 ayes. Mayor Ventura absent. FEE AND RATE STRUCTURE/INCREASES/HEARING Vice-Mayor Carlson stated that this was the time and place duly noted for public hearing to consider a change in the fee and rate structure for use of Town services. Mrs. Benjamin requested a response to her understanding that all fees proposed were no more that cost recovery. Assistant Town Manager, Mark Linder, (introduced by the Town Manager, David Knapp), explained the cost recovery nature of the fees proposed. Motion by Mr. Blanton, seconded by Mrs. Benjamin, that Council continue the public hearing to May 13, 1991. Carried by a vote of 4 ayes. Mayor Ventura absent. TC:D1:MM042991 April 29, 1991 Los Gatos, California TAX AND LICENSE/BUSINESS LICENSE INCREASES/HEARING Vice-Mayor Carlson stated that this was the time and place duly noted for public hearing to consider an increase in business license fees by amending the Town Code, Chapter 15, Licenses: Article II, Schedule; Section 15-27. Gross Receipts Tax; and Section 15-28. License Taxes for Specified Businesses. TC:D1:MM042991 April 29, 1991 Los Gatos, California TAX AND LICENSE CONT. The following people from the audience spoke to this issue: Loren McRoberts, 493 Burt Ave., feels that increased fees will cause less business to situate here and that Town should be doing things to attract business to the community instead of increasing fees. Joe Hargett, President of Los Gatos Downtown Association, spoke against the raising of fees too high, although a fifty percent increase seemed feasible. He spoke of using these new funds to hire a retail recruitment person on a partnership basis with the downtown community, and to consider the possibility of those who might buy into to a Business Improvement District being supported by the Town with a lower tax and license fee. Ellen Graff, 805 Lilac Way, President of the Chamber of Commerce, spoke regarding strategy to bring shoppers into Town, and requested some time for the Chamber to review the fees and be able to return with some positive suggestions for the Council. Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council submit any increases to the business license tax to Superior Court for a validation action. Carried by a vote of 4 ayes. Mayor Ventura absent. Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council continue this public hearing to May 20, 1991. Carried by a vote of 4 ayes. Mayor Ventura absent.
