ROLL CALL Present:Randy Attaway, Joanne Benjamin, Steven Blanton, and Mayor Brent N. Ventura. Absent:Eric D. Carlson PLEDGE OF ALLEGIANCE Given by all in attendance. COUNCIL ON AGING/APPOINTMENT Mayor Ventura announced that one application had been received for the vacancy on the Council on Aging Commission. Voting was held and Betty Nash was appointed to a three year term on the Council. ARTS COMMISSION/COMMENDATION/ETHEL WORN Mayor Ventura made a presentation to Ethel Worn for her years of service and exemplary work on the Arts Commission. 9201 PROJECT/ANNUAL STREET RESURFACING/BID AWARD Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council award the bid to Jennings Contracting for Annual Street Resurfacing, in the total amount of $176,200. TC:D1:MM080591 August 5, 1991 Los Gatos, California VERBAL COMMUNICATIONS Norm Mateoni, requested that the council reconsider the adoption of Resolution 1991-165, so the language can be reexamined. He asked the council to agendize this request at the council meeting of August 19, 1991. Motion by Mr. Blanton, seconded by Mrs. Benjamin to modify the wording of the Resolution, according to the motions made at the time the Resolution was passed. Carried by a vote of 4 ayes. PUBLIC HEARINGS LOMA ALTA/PETITION/TRAFFIC STUDY/HEARING Mayor Ventura stated that this was the time and the place duly noted for public hearing for consideration of petition by residents of Loma Alta Avenue for implementation of added traffic measures. The following people from the audience spoke to this issue: Suzanne Allayaud, 180 Loma Alta Avenue, stated she believes that the staff report prepared for the Council is not acceptable to the residents of Loma Alta Avenue, for the reason that the survey conducted should have been conducted only on Loma Alta Avenue and not on surrounding streets. She beleives two (2) stop signs are needed at the crossroads of Alta Heights and Cross. Dick Gains, 340 Johnson Avenue, expressed his concern for the Loma Alta problems because those problems also affect Johnson Avenue. He suggested using speed bumps to solve the problems on Loma Alta Avenue, and Johnson Avenue. Barbara McMurray, 211 Loma Alta, questioned the Council about how much more building is going to be allowed in this area, and stated her support for the idea of using planter boxes as brought up by Mr. Attaway. Ted Scurose, 188 Loma Alta Avenue, stated that he believes that most of the violations occur during non radar enforced hours. He recommends that a stop sign be placed at the Alta Heights crossroad. Gloria Edwards, 256 Loma Alta, agrees that stop signs are needed to guarantee the safety of the residents, but does not agree with Mr. Scurose's comment that most of the violations occur during the night time hours. She believes the problem is at all hours of the day. There was no one else from the audience wishing to speak to this issue. Motion by Mrs. Benjamin, seconded by Mr. Blanton, that two (2) stop signs be placed at the crossroads of Alta Heights and Cross, and that the issue come back to Council in nine (9) months to see if the stop signs are working effectively. TC:D1:MM080591 August 5, 1991 Los Gatos, California HEARINGS CONTINUED WEED ABATEMENT/ASSESSMENT CHARGES/RESOLUTION 1991-173/HEARING Mayor Ventura stated that this was the time and the place duly noted for public hearing for the consideration and confirmation of report and assessment on abatement of weeds within Los Gatos, and adoption of Resolution approving report describing parcels of real property, and showing amount of weed abatement charges to be collected on the tax roll of the Town of Los Gatos. Motion by Mrs. Benjamin, seconded by Mr. Blanton, to close the public hearing for the consideration and confirmation of report and assessment on abatement of weeds within Los Gatos. Motion by Mrs. Benjamin, seconded by Mr. Blanton, that Council adopt Resolution 1991- 173 entitled, RESOLUTION OF THE TOWN OF LOS GATOS ADOPTING REPORT DESCRIBING PARCELS OF REAL PROPERTY, AND SHOWING AMOUNT OF WEED ABATEMENT ASSESSMENTS TO BE COLLECTED ON THE TAX ROLL OF THE TOWN OF LOS GATOS IN THE COUNTY OF SANTA CLARA, FOR THE FISCAL YEAR 1991- 1991. PINE AVE 17161/APPEAL/NIELSEN/MEYERS/HEARING Mayor Ventura stated that this was the time and the place duly noted for the public hearing for the appeal of the Planning Commission decision at 17161 Pine Avenue. The following people from the audience spoke to this issue: Steven Meyers, 108 Calfhill Court, appellant, stated he believes the Planning Commission decision should be reversed because the neighbors and nearby residents of Mr. & Mrs. Nielsen were not notified that the construction at 17161 Pine Avenue included the installation of a lighted tennis court. He believes the issues of neighborhood compatibility were not adequately addressed. Jim Nielsen, 17161 Pine Avenue, owner, believes the Planning Commission sufficiently covered all of the issues of the demolition and construction. He would like to have lights on his tennis court to use during the prime hours of the winter season, and would probably not proceed in installing a tennis court if the council grants the appeal and doesn't let him also install lights for that court. Mr. Nielsen assured the Council that the tennis court is not for use in the late hours of the night and the noise level will not violate the Town Noise Ordinance. Charles Stewart, 100 Calfhill Court, expressed his concern about the tennis court lighting. TC:D1:MM080591 August 5, 1991 Los Gatos, California He stated that if the lights are allowed to remain, more pine trees should be added for screening on the Nielsen property at the fence line. Mrs. Benjamin added her request that the maker and the second send the plans to the Parks Forestry and Maintenance Department to have them provide additional screening out for the tennis courts, including evergreen landscaping materials. TRAFFIC IMPACT/ZONING ORDINANCE AMENDMENT A-91-3 INTRODUCTION OF ORDINANCE/RESOLUTION 1991-174/HEARING Mayor Ventura stated that this was the time and the place duly noted for public hearing to consider an amendment to the Town Zoning Ordinance. Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council adopt Resolution 1991- 174 entitled, RESOLUTION OF THE TOWN OF LOS GATOS CONCERNING THE TRAFFIC IMPACT POLICY. Mayor Ventura voted no because he feels that by adopting this Resolution the council will loose the ability to regulate, consider, and mitigate the cumulative impacts of small projects. TC:D1:MM080591 August 5, 1991 Los Gatos, California HANDICAPPED ACCESSIBILITY/GENERAL PLAN AMENDMENT/RESOLUTION 1991-175 ENHANCED LIVABILITY/RESIDENTIAL DEVELOPMENTS/RESOLUTION 1991-176/HEARING Mayor Ventura stated that this was the time and the place duly noted for public hearing for the public hearing of an amendment of the Town's Housing Element of the General Plan, (section GP-91-1), and adaptability and accessibility requirements for enhanced livability features for residential developments. The following person from the audience spoke to this issue: Jim Lewis, 156 Vista Del Monte, asked the Council to take into consideration a previous Resolution 1981-216 encouraging the elimination of barriers to the physically handicapped persons, and suggested that the Town include a list of possible requirements submitted by him, in the Resolution before the Council tonight. Motion by Mrs. Benjamin, seconded by Mr. Blanton, to close the public hearing of the of the Amendment of the Housing Element of the General Plan, and enhanced livability features for residential developments. TC:D1:MM080591 August 5, 1991 Los Gatos, California SOLID WASTE MANAGEMENT/RESOLUTIONS 1991-182 & 1991-183 Motion by Mrs. Benjamin, seconded by Mr. Blanton, that Council adopt Resolution 1991- 182 entitled, RESOLUTION OF THE TOWN OF LOS GATOS MODIFYING RATES FOR SOLID WASTE MANAGEMENT SERVICES, approving residential rates at $5.86 per can per month effective November 1, 1991, to include collection of HDPE plastic. Carried by a vote of 4 ayes. Mr. Carlson absent. Phil Couche, a representative from Green Valley, explained the different proposals for mixed paper recycling to the Council. Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council adopt Resolution 1991- 183 entitled, RESOLUTION OF THE TOWN OF LOS GATOS MODIFYING RATES FOR SOLID WASTE MANAGEMENT SERVICES, approving commercial rates at 10.5 percent as proposed, and to institute white paper recycling in all the schools and look at providing a white paper bin at the recycling center for commercial use. Carried by a vote of 3 ayes. Mayor Ventura voted no because he would like to see the mixed paper proposal implemented as soon as possible. Mr. Carlson absent. Dennis Varni, representative of Green Valley, stated that by changing the current 10 month spread increase it will be difficult to remain competitive. A PLACE FOR TEENS/CONCEPTUAL DESIGN/REFERRAL OF LEASE John Lien, 196 College Avenue, architect for the Teen Center, spoke to the Council about the proposed height of the building, and how significant it is that the building remain that height. He took the Council through the process that helped him arrive at the proposed design. He submitted several drawings to the Council in attempt to show how tall the building will look and how much of it will be seen from New York Avenue. Motion by consensus, to bring this item back to Council on the meeting of August 19, 1991, and to plan a field trip for the Council, to the site of the proposed building. Motion by Mrs. Benjamin, seconded by Mr. Attaway, that Council refer the lease agreement to the closed session of August 19, 1991. Carried by a vote of 4 ayes. LOS GATOS CREEK TRAIL Motion by Mrs. Benjamin, seconded by Mr. Attaway, for conceptual approval of the Los Gatos Creek Trail. Carried by a vote of 4 ayes. Mr. Carlson absent. COUNCIL REPORTS VASONA CORRIDOR Mayor Ventura expressed his desire for a light rail station in Los Gatos. He asked for the support of the Council to take this idea to the Committee meeting.
