TOWN COUNCIL
The Town Council/Parking Authority of the Town of Los Gatos met in the Council Chambers
of the Town Hall, 100 East Main Street, at 7:40 p.m., Monday, June 25, 1990, in regular
adjourned session.
ROLL CALL
Present:Joanne Benjamin, Eric D. Carlson, Robert L. Hamilton,
Brent N. Ventura and Mayor Thomas J. Ferrito.
Absent:None.
CLOSED SESSION
Mary Jo Levinger, Town Attorney, reported that prior to this evening's meeting Council had
met in Closed Session pursuant to Government Code Section 54957 to discuss a Personnel
matter. There is no report from that discussion at this time.
TAIT AVE 110/EARTHQUAKE DAMAGE/DEMOLITION REQUEST
Mayor Ferrito announced that Council would address report on request of approval of plans
to demolish a pre-1900 single family residence significantly damaged by the earthquake on
property in the Almond Grove Historic District. Property located at 110 Tait avenue in the R-
1D-LHP zone. Property Owner: Muriel T. Williamson.
Motion by Mrs. Benjamin, seconded by Mr. Carlson, that Council approve Architecture
and Site Application ES-90-60 as recommended by the Earthquake Demolition Committee
which includes Council's findings as required by Section 3.65.0125 and 3.65.040 of the
Zoning Ordinance for the demolition of an historic structure and the granting of a Demolition
Permit, and which findings are listed in the staff report, and included in this motion is that the
owners of the property will attempt to retain as many elements of the exterior architectural
features that can be saved and incorporate these elements in the new structure. Town
Building Inspector to make survey prior to the issuance of demolition permit, of any features
he feels can be saved, for the benefit of the owner or for use by the Town, and to include a
photo record. Carried unanimously.
TAIT AVE 119/EARTHQUAKE DAMAGE/DEMOLITION REQUEST

Mayor Ferrito announced that Council would consider request for approval of plans to
demolish a pre-1900 single-family residence significantly damaged by the earthquake on
property in the Almond Grove Historic District. Property located at 119 Tait Avenue in the R-
1D-LHP Zone (ES-90-61). Property Owner: Merle Byrd.
Motion by Mrs. benjamin, seconded by Mr. Ventura, that Council approve Architecture
and Site Application ES-90-61 as recommended by the Earthquake Demolition Committee
which includes Council's findings as required by Section 3.65.0125 and 3.65.040 of the
Zoning Ordinance for the demolition of an historic structure and the granting of a Demolition
Permit, and which findings are listed in the staff report, and included in this motion is that the
owners of the property will

WISSAHICKON AVE 149/EARTHQUAKE DAMAGE/DEMOLITION REQUEST
Mayor Ferrito announced that Council would consider request for approval of plans to
demolish a pre-1900 single-family residence significantly damaged by the earthquake.
Property located at 149 Wissahickon Avenue in the R-1:8 Zone. Property Owners: Alex and
Donna Niemiec.
Motion by Mrs. Benjamin, seconded by Mr. Hamilton, that Council approve Architecture
and Site Application ES-90-62 as recommended by the Earthquake Demolition Committee
which includes Council's findings as required by Section 3.65.0125 and 3.65.040 of the
Zoning Ordinance for the demolition of an historic structure and the granting of a Demolition
Permit, and which findings are listed in the staff report, and included in this motion is
provision to have 3X review by the State. If State raises an issue this item will return to
Council. If State concurs with staff's recommendation the owners may go forward. Carried
unanimously.
Curt Anderson, Architect for the project, 288 West Hamilton, Campbell, requests that
Council move on this item as soon as possible.
SUBDIVISION APPLICATIONS/EARTHQUAKE DAMAGED STRUCTURE/REVIEW PROCESS
Mayor Ferrito announced Council consideration of existing policy determining that
applications not directly related to earthquake damage not be reviewed through the
Restoration Program "Fast Track" process and that applicable fees not be waived. No action
taken.
EARTHQUAKE FUNDS/BASEBALL FUND/ALLOCATION
Mayor Ferrito announced Council consideration of setting Town policy to establish priorities
in spending of private earthquake funds, (Baseball Fund), and recommendation that
residential uses be given priority over commercial.
Motion by Mr. Carlson, seconded by Mr. Hamilton, to request staff return to Council July
2, 1990 with report establishing loan program with available funds from the Baseball Fund
which includes the following policies:
1.Money loaned would be returned to established Town disaster fund for future use.

2.Specific criteria formulated for use in awarding loan including:
a)Income and need of applicant
b)Historic and architectural significance of the residential structure
c)Residential structures to receive first priority
3.Formally announce availability of loan funds through:
a)Press release
b)Community services notification
c)Building department notification to list of earthquake damaged buildings
4.Establish low or very low interest rates
5.Prepare loan repayment schedule

6.Lien will remain on property until:
a)Town is repaid
b)Title has changed hands
c)Refinancing occurs
Carried unanimously.
WILDER 146/EARTHQUAKE DAMAGE/DEMOLITION REQUEST
Mayor Ferrito announced that this request for $4,400 for demolition of a dangerous structure
at 146 Wilder Ave. return to Council as a sub-item to policy for allocation of private
earthquake funds (Baseball Funds) scheduled for Council agenda July 2, 1990. No action
taken.
COMMITTEE REPORT
Mr. Ventura reported on Congestion Management Committee.
ADJOURNMENT
Mayor Ferrito announced adjournment at 8:25 p.m. to an Executive Session. Mary Jo
Levinger, Town Attorney, stated that Council would adjourn to Closed Session pursuant to
Government Code Section 54957 to continue discussion of Personnel matter.
