M 07-23-90TOWN OF LOS GATOS CALIFORNIA TOWN COUNCIL/PARKING AUTHORITY July 23, 1990 Minutes TOWN COUNCIL The Town Council/Parking Authority of the Town of Los Gatos met in the Council Chambers of the Town Hall, 100 East Main Street, at 7:05 p.m., Monday, July 23, 1990, in adjourned regular session. ROLL CALL Present:Joanne Benjamin, Robert L. Hamilton, and Mayor Thomas J. Ferrito. Absent:Eric D. Carlson, and Brent N. Ventura. PLEDGE OF ALLEGIANCE Given by all in attendance. CLOSED SESSION Mary Jo Levinger, Town Attorney, reported that Council had met prior to this evening's meeting in Closed Session pursuant to Government Code Section 54956.9(c) to discuss Institution of Litigation regarding Route 85. There is no report from that discussion at this time. After this evening's meeting Council will adjourn to Closed Session to discuss a personnel matter pursuant to Government Code Section 54957. PRESENTATION Mayor Ferrito presented the keys to the Town and Town Proclamations to exchange students from Saint George, Belgium. Lea Fry, French teacher at Fisher Junior High, organized the exchange between Los Gatos French students and students of St. George, with the cooperation of Mr. George Younger, Superintendent of Schools, Saint George. The hosts and guests came forward for the presentations. PATROL VEHICLES/POLICE DEPARTMENT/INFORMATION Motion by Mrs. Benjamin, seconded by Mr. Hamilton, that Council authorize the acquisition of ten (10) 1991 Police Patrol Vehicles through the State of California Department of General Services, Cooperative Purchasing Agreement or a Local Dealership, in order to support local businesses who meet the State bid price or may offer a more competitive price, including a trade in at the best possible value, and a three (3) year, 85,000 mile warranty. TC:D1:MM072390 That Council also amend the vehicle and equipment acquisition and replacement policy for the Town of Los Gatos as delineated in the staff report of March 3, 1989 to include a three (3) year, 85,000 mile warranty or best offer of extended warranty. Carried by a vote of 3 ayes. Mr. Carlson and Mr. Ventura absent. 16900 CYPRESS WAY/COUCHEE/DEMOLITION REQUEST Motion by Mrs. Benjamin, seconded by Mr. Hamilton, that Council approve Architecture and Site Application ES-90-71 as recommended by the Earthquake Demolition Committee and citing those findings as required by Section 3.65.040 of the Zoning Ordinance for the granting of a demolition permit. Carried by a vote of 3 ayes. Mr. Carlson and Mr. Ventura absent. TC:D1:MM072390 July 23, 1990 Los Gatos, California 55 HERNANDEZ/TAYLOR/REQUEST FOR EMERGENCY LOAN Although not a formal hearing the following person was invited to speak to the issue: Tim Lantz, Restoration Contractor for Kay Taylor, 14715 Uvas Road, Morgan Hill, asked for deferral and opportunity to return to Council with an alternate proposal. Motion by Mrs. Benjamin, seconded by Mr. Hamilton, that Council deny the request for an emergency loan without prejudice. Carried by a vote of 3 ayes. Mr. Carlson and Mr. Ventura absent. OKA-MOZART NEIGHBORHOOD/ACCESS/HIGHWAY 85 & 17 INTERCHANGE AT LARK Mayor Ferrito announced the public presentation by the Traffic Authority for Council and public information at this time regarding Oka Road-Mozart access, integrated flood control and riparian mitigation plan, and Mozart Ave. pedestrian overpass. Will Kempton, Executive Director, Santa Clara County Traffic Authority, addressed access to Oka-Mozart community at Route 85 & 17 interchange. Mr. Kempton introduced staff and consultants working on Route 85 and made reference to the following negotiations: a)Town's adoption of the freeway agreement incorporating northerly ramps at Winchester and Traffic Authority's inclusion of funding for the full Bascom interchange. b)Maria's Berry Farm relocation occurring within a November time frame. Proceeding with presentation Mr. Kempton updated on following developments: 1.Full freeway to freeway interchange providing for all movements in both directions on 17 and 85. 2.Bascom interchange incorporating ramps both to and from the south as well as ramps braiding in to and from the north. 3.Winchester having northerly access ramps included. 4.Realignment of 85 to the north to avoid impacting the Los Gatos industrial park. 5.Minimization of visual impact of interchange by elevating Highway 17 by 15 feet, lowering Route 85 and tucking connector roadways between the two freeways. 6.Oka undercrossing, approximately 1,000 feet of reconstruction, becoming viable alternative due to hydraulic studies permitting integrated flood control riparian mitigation plan increasing the capacity of the creek channel to carry flood waters and removing this area from the flood plain district. 7.Cal Trans and Federal Highway Administration giving final review this month and Transit Authority could approving by August or September. 8.Due to cost perspective and environmental impact, none of the previously considered alternatives are acceptable to the Traffic Authority at this time. Riparian Mitigation Plan: TC:D1:MM072390 July 23, 1990 Los Gatos, California a)For the 2 acres impacted by the freeway, 9½ acres of mitigation will be offered within the Town limits. b)Berm structure along creek will convert to a flood control wall at the Mobile Park. c)Improvement to dam and flood control area. d)Improved channelization of creek. e)Habitat replacement developed in compatible areas. Mozart Ave Pedestrian/Bicycle Overcrossing Presentation describing overcrossing provided in conjunction with the Route 85 project in the vicinity of the corridor which will enhance pedestrian and bicycle access from the east side of Route 17 to the Los Gatos Creek Trail County Park System. Mayor Ferrito commented that since the time of the Town's acceptance of one of the Traffic Authority's conceptual designs March 1989 and a request for environmental assessment was made by the Town, that the Town has not received this assessment nor has it been informed or made a part of the process which has such a direct impact on this specific neighborhood. The Town has only received generalized letters relating to possible problems. The second reevaluation addendum, having not been received by the Town at this time, can not be given input or comment on it until it has been reviewed. Mrs. Benjamin requested further information on the new proposal and stated the need for a new neighborhood survey for input on alternates 4, 6, the new proposal, and opinions on other options. She reiterated that Council has not chosen a particular alternative but has asked and will continue to ask the impacted neighborhood what their conserns and wishes are relating to these proposals. Through the democratic process Council would like to see these views expressed. Council consensus is for the following action: a)Town to initiate a second community survey. b)Regarding choice of access; 1)Current proposal 2)Alternate #4 3)Alternate #6 4)Other options c)Regarding pedestrian/bike overpass d)Public Hearing to be held August 20, 1990 ADJOURNMENT Mayor Ferrito announced that Council would adjourn to Closed Session to discuss a personnel matter as stated at the beginning of this evening's meeting.
