M 10-12-85TOWN OF LOS GATOS CALIFORNIA TOWN COUNCIL/PARKING AUTHORITY AGENDA OCTOBER 12, 1985 TOWN COUNCIL The Town Council/Parking Authority met in a joint meeting in the Council Chambers of the Town Hall at 8:45 a.m., in a special called session. ROLL CALL PRESENT:Eric D. Carlson, Terrence J. Daily,Thomas J. Ferrito, Brent N. Ventura and Mayor Joanne Benjamin. ABSENT:None. PLEDGE OF ALLEGIANCE Given by all in attendance. REQUEST FROM YOUTH SCIENCE INSTITUTE TO USE TOWN PROPERTY Town Manager referred to request from the Youth Science Institute to use Town property at the intersection of Lark Avenue and Winchester Boulevard for the sale of pumpkins from October 19th to November 1st, 1985. Discussion was held re liability insurance. David Johnston, YSI spoke on the issue stating YSI has A 2 1/2 million dollar umbrella coverage and insurance Co. stated they would be willing to give YSI a rider or certificate, but usually that would be only for a million dollars. After further discussion Mr. Carlson moved request be granted contingent upon YSI's agreement to the following condition: 1. To obtain a temporary use permit from the Planning Dept. 2. To restore the property to the same condition it was in before the YSI use. 3. Any clean-up necessitated by Town staff will be billed to YSI. 4. To obtain liability insurance in the amount of 2 million dollars, naming the Town, its employees, officers, and agents as an insured. (If they are unable to furnish this, they should contact Town staff re lowering the liability to 1 million dollar coverage); and 5. Execute Town hold-harmless agreement. Mr. Daily seconded. Carried unanimously. CONTRACT FOR EIR PREPARATION FOR OLD TOWN PARKING STRUCTURE Discussion was held re contract for preparation of Environmental Impact Report for the Old Town Shopping Center parking structure. Mr. Ferrito stated he would not favor approving this without including all the options in advance. Council concurred with Mr. Ferrito. It was noted this cost, for all options, would be $25,170.00. It was consensus of Council that no time limit be set for the preparation of said EIR. Discussion was held whether this plan complies with Downtown Specific Plan, discussed the option list, and whether to add "that the scale of project should be looked into". After further discussion Mr. Carlson moved to Council's choice of consultants, add to the option list the scale of project should be investigated and no time limit be set for preparation of the EIR, and check with Mr. Kreines on the time schedule for the preparation of the EIR. Resolution to be prepared for Council consideration at the next meeting. Mr. Ferrito seconded. Carried unanimously. SUNDAY PARKING BAN LIFTED Mr. Daily moved for adoption of Resolution No. 1985-147 entitled, PARKING RESTRICTION - NORTH SANTA CRUZ AVENUE. (This removes the Sunday parking restrictions on N. Santa Cruz Avenue effective October 12, 1985). Mr.Ventura seconded. Carried unanimously. ADJOURNMENT At 9:15 a.m. Mayor Benjamin declared the meeting adjourned to executive session to be held at 7:00 p.m. on Monday, October 14th, 1985 and study session to be held at 7:30 p.m. ATTEST: Rose E.
