TOWN COUNCIL
The Town Council of the Town of Los Gatos met in the Council Chambers of the
Town Hall at 7:40 p.m., in continued regular session.
ROLL CALL
PRESENT:Eric D. Carlson, Terrence J. Daily, Thomas J. Ferrito, Brent
N. Ventura, and Mayor Joanne Benjamin.
ABSENT:None.
SECONDARY DWELLING UNITS ORDINANCE
Mr. Carlson moved to adopt Ordinance No. 1654 entitled, AN ORDINANCE OF
THE TOWN OF LOS GATOS AMENDING THE ZONING ORDINANCE TO ADD
PROVISIONS FOR SECONDARY DWELLING UNITS. Mayor Benjamin
seconded. Carried by a vote of three ayes. Mr. Ferrito and Mr. Ventura voted
no.
Council discussion was held on Section 5.30.010 regarding the appeals process
of the Ordinance. It was decided by Council consensus motion that any permits
issued for existing secondary dwelling units be posted on a daily basis in the
Planning Department and upper level lobby in the Town Hall. The notice to show
the name of applicant, address, date permit applied for, and the date of issuance.
Mr. Ferrito moved this be referred to the Planning Commission for their review
and recommendation in 40 days for a General Plan Amendment and Ordinance
Amendment which would prohibit all secondary units in the R-1 Zone and would
do so without indicating either way the Councils preference, as to the
recommendation. Mr. Ventura seconded. Carried by a vote of three ayes. Mr.
Carlson and Mayor Benjamin voted no. Mr. Ferrito's intention is only to preserve
the character of the R-1 single family residential zoning as single family zoning.
Mr. Daily supported the motion because it is consistent with his position that this
is a weighty and unique issue and that the more information gathered the better.
Mr. Carlson does not feel anything different will be found. Mr. Ventura would
have to see new information to change his mind to legalize existing units, his
concerns have been with the new units. Mayor Benjamin is not in favor of
abating the legal existing units or existing units that come up to the health and
safety codes because she feels you can not tell what is legal and what is illegal.
EX-AGENDA ITEM LOGGING ISSUE
Kirk Anslinger, representing the Lexington Hills association, requested that
Council write to Cal Trans requesting an E.I.R. study of the logging trucks use of
Route 17 and their impact on the Town of Los Gatos. Mr. Ferrito moved to write
to Cal Trans requesting an E.I.R. study be done on the impact of the logging
trucks to the Town of Los Gatos and Route 17. Mr. Ventura seconded. Carried
unanimously.
ADJOURNMENT
Mr. Ferrito moved the meeting of April 22, 1985 be adjourned at 8:05 p.m. Mr.
Ventura seconded. Carried unanimously. Council will meet at 7:30 p.m., April
29, 1985 in Executive Session regarding personnel and study session
concerning Town goals. Mayor Benjamin declared the meeting adjourned to the
Budget Study Session.
