M 03-22-82TOWN COUNCIL MEETING MARCH 22, 1982 TOWN COUNCIL The Town Council of the Town of Los Gatos met in the Council Chambers of the Town Hall at 7:33 p.m., in an adjourned regular meeting. ROLL CALL PRESENT: Ruth Cannon, Marlyn J. Rasmussen, Brent N. Ventura and Peter J. Siemens. ABSENT: Thomas J. Ferrito APPOINTMENT RENTAL MEDIATION REVIEW COMMITTEE Mayor Siemens appointed Council members Thomas J. Ferrito and Ruth Cannon to the Rental Mediation Review Committee. APPOINTMENT JPA TRANSIT PROGRAM Mayor Siemens appointed Council member Marlyn J. Rasmussen as representative to the Joint Powers Agency for the Transit Program. JOINT POWERS AGENCY TRANSIT PROGRAM Mr. Ventura moved Resolution No. 1982-69 entitled, A RESOLUTION AUTHORIZING THE TOWN MANAGER TO EXECUTE A JOINT POWERS AGREEMENT WITH THE CITIES OF MONTE SERENO AND SARATOGA PROVIDING FOR THE FORMATION OF A COMMUNITY TRANSIT SERVICES AGENCY be adopted. Mrs. Rasmussen seconded. Unanimously carried. Mr. Ferrito arrived at 7:36 p.m. EX-AGENDA ITEMS Mrs. Rasmussen moved to add extra agenda item at the end of the meeting regarding petition to the Public Utilities Commission for removal of testimony by General Telephone. Mr. Ventura seconded. Unanimously carried. Mr. Hays, Town Attorney, requested an Executive Session be held at the end of the meeting to discuss various litigations. It was consensus of Council to add this to the agenda. DOWNTOWN SPECIFIC PLAN Mayor Siemens stated this was the time and place duly published to consider the Downtown Specific Plan. Speaking on this issue: Philip Vlamis, 123 University Avenue; Judy Corliss, League of Women Voters representative, read letter regarding the League's comments and policies on Downtown Specific Plan; Jo Bartlett, representing the Community Services and Development Commission, made the following recommendation: 1) Town Council should consider higher residential densities with the commercial zone; 2) Land use diagram figure 11-1 should be tightened to reflect strong boundries between the CBD and adjacent residential neighborhood similar to figure 11-2 and; 3) In order to encourage the preservation of existing residential units and the construction of new residential units within the downtown, the land use plan should include a mixed use category and it should be applied to specific developed properties such as the Foothill and Penthouse Apartments and vacant lands such as the Toll House site; Lois Chapon Planning Commissioner, feels an advisory committee (non-political) of qualified people should be recommended to Planning; Mrs. Alice Thorsby, Crescent Drive, spoke on non-conforming lot on Bachman and requested consideration of commercial zoning and be developed as small businesses; and Roger Donnelly, San Benito Avenue, questioned whether zone changes can be requested and land use should be consistent with zoning. Mr. Ventura moved hearing be continued to March 29, 1982, at 7:30 p.m. Mrs. Rasmussen seconded. Unanimously carried. There were several suggestions made by the members of the Council regarding potential amendments to the Planning Commission's Downtown Specific Plan. Staff to report back to Council on the 29th of March with a report. GENERAL TELEPHONE RATE INCREASE Mr. Ventura reported on the General Telephone rate increase and felt it worth while to file a petition with the Public Utilities Commission. Mr. Ventura moved to authorize the Town Attorney to petition the Public Utilities Commission for the removal of testimony by General Telephone requesting a rate increase, (inasmuch as other parties including the Town) were not also allowed to provide testimony. Mrs. Rasmussen seconded. Carried by a vote of four ayes, Mrs. Cannon voting no. ADJOURNED TO EXECUTIVE SESSION Mayor Siemens declared the meeting adjourned to an Executive Session. Meeting reconvened at 10:30 p.m. Mayor Siemens reported the following items were discussed in the Executive Session: 1. Villa Vasona litigation 2. Hamilton litigation 3. Town's Rental mediation Ordinance litigation and authorize the Town Attorney to defend the Mediation ordinance. ADJOURNMENT Mrs. Rasmussen moved the meeting be adjourned at 10:35 p.m., to be continued at 7:30 p.m., on Monday the 29th day of March, 1982. Mr. Ferrito seconded. Unanimously carried.
