FBD VANGUARD CONSTRUCTION, INC. AND AUTHORIZE RECORDING BY
THE CLERK ADMINISTRATOR FOR PPW JOB NUMBER 411-811-0003 –
ALMOND GROVE STREET RECONSTRUCTION PROJECT PHASE I
RECOMMENDATION:
Authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion
(Attachment 1) accepting the work of FBD Vanguard Construction, Inc. (Vanguard), and
authorize recording by the Clerk Administrator for PPW Job Number 411-811-0003 - Almond
Grove Street Reconstruction Project Phase I.
BACKGROUND:
On October 15, 2015, the Town Council approved the plans and specifications for bidding the
Almond Grove Phase I Street Reconstruction Project for the rehabilitation of Broadway and
Bachman Avenue. The bidding included both asphalt and concrete street rehabilitation
options. At the February 16, 2016 Town Council meeting, Council approved the award of the
project and the Town entered an agreement with Vanguard for concrete street reconstruction
in the low bid amount of $2,361,806 plus a 15% construction contingency allocation of
$352,271, for a total construction cost not to exceed $2,716,077 . The Almond Grove Phase I
Street Reconstruction Project has now been completed in accordance with the project plans
and specifications, and within the allocated construction budget as discussed in more detail in
the Fiscal Impact section.

DISCUSSION:
Vanguard has satisfactorily completed all of the work for the project and staff recommends
project acceptance.
Five percent of the faithful performance bond will remain in effect for a period of two years as
guarantee for any needed repair or replacement caused by defective materials and
workmanship. The execution and recordation of the Certificate of Acceptance is now required
to finalize the Town's acceptance of the project.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to execute a Certificate
of Acceptance and Notice of Completion accepting the work of Vanguard and authorize
recording by the Clerk Administrator for PPW Job No. 411-811-0003 - Almond Grove Street
Reconstruction Project Phase I.
FISCAL IMPACT:
The project has been completed within the total allocated construction funding. The final
project construction cost with Vanguard was $2,579,427, resulting in savings of $136,650 or five
percent of the contract and contingency amount. These funds will be returned to the Capital
Budget Reserve for Council appropriation to future capital projects .
The majority of the contingency funds were expended to address unforeseen issues regarding
the existing storm drain facilities. Contingency funds were also allocated to extending the
asphalt conforms at major side streets to provide a smoother transition between the new
concrete streets and existing asphalt streets; modifications to sidewalk, curb, and gutter in
order to accommodate large roots of trees that remain; and the removal and replacement of
additional sidewalk panels as necessary to accommodate necessary changes in grades during
construction or due to advancing deterioration of the walkway.
