Main Street Los Gatos, CA 95030 ● 408-354-6832 www.losgatosca.gov TOWN OF LOS GATOS COUNCIL AGENDA REPORT MEETING DATE: 06/06/2017 ITEM NO: 11 DATE: MAY 25, 2017 TO: MAYOR AND TOWN COUNCIL FROM: LAUREL PREVETTI, TOWN MANAGER SUBJECT: ADOPT A RESOLUTION AUTHORIZING THE GRANT OF AN EASEMENT TO PACIFIC GAS & ELECTRIC COMPANY FOR SOULCYCLE/McCARTHY SANTA CRUZ AVE, LLC, LOCATED AT 212-216 NORTH SANTA CRUZ AVENUE (APN 529-04-085) RECOMMENDATION: Adopt a resolution (Attachment 1) authorizing the grant of an easement to Pacific Gas & Electric Company (PG&E) for SoulCycle/McCarthy Santa Cruz Ave, LLC, located at 212-216 North Santa Cruz Avenue (APN 529-04-085). BACKGROUND: On April 27, 2016, the Planning Commission considered both Conditional Use Permit and Architecture and Site Applications at 212-216 North Santa Cruz Avenue. The applications were denied, which the applicant subsequently appealed. The Town Council considered these items at the June 21, 2016 Town Council meeting, during which the Council granted the appeal thereby approving the applications and the proposed project. DISCUSSION: The applicant, SoulCycle, and property owner, McCarthy Santa Cruz Ave, LLC, are now ready to proceed with the necessary easements to PG&E for newly upgraded underground electrical facilities and appurtenances across the McCarthy property to the SoulCycle facility that are required for the operation of the SoulCycle business. In order for the needed PG&E facilities to reach the SoulCycle property, the electrical facilities also need to cross approximately 200 feet of Town property that is currently part of the Town’s Parking Lot 2. Authorizing the grant of easement will allow for this. CONCLUSION: Adopt a resolution authorizing the grant of an easement to Pacific Gas & Electric Company (PG&E) for SoulCycle/McCarthy Santa Cruz Ave, LLC, located at 212 -216 North Santa Cruz Avenue (APN 529-04-085). FISCAL IMPACT: The Town will not incur any ongoing maintenance costs as a result of the grant of easement. The Town already maintains the parking lot through which the easement traverses. ENVIRONMENTAL ASSESSMENT: This is a project as defined under CEQA and it is Categorically Exempt (Section 15302: Replacement or Reconstruction). A Notice of Exemption will not be filed.
