APPROVE THE PLANS AND SPECIFICATIONS FOR THE ANNUAL CURB, GUTTER, AND SIDEWALK MAINTENANCE PROJECT INCLUDING CURB RAMP INSTALLATION AND AUTHORIZE THE TOWN MANAGER TO ADVERTISE THE PROJECT FOR BID. B. AUTHORIZE THE TOWN MANAGER TO AWARD AND EXECUTE A CONSTRUCTION AGREEMENT IN AN AMOUNT NOT TO EXCEED $447,260, INCLUDING CONTINGENCIES AND ADDITIVE ALTERNATES. C. AUTHORIZE STAFF TO EXECUTE FUTURE CHANGE ORDERS IN AN AMOUNT NOT TO EXCEED TEN PERCENT OF THE CONTRACT AWARD AMOUNT. RECOMMENDATION: Staff recommends that the Town Council: 1. Approve the plans and specifications for the Annual Curb, Gutter, and Sidewalk Maintenance Project including curb ramp installation and authorize the Town Manager to advertise the project for bid. 2. Authorize the Town Manager to award and execute a Construction Agreement in an amount not to exceed $447,260, including contingencies and additive alternates. 3. Authorize staff to execute future change orders in an amount not to exceed ten percent of the contract award amount. The project is consistent with the Town’s goals to improve public safety and to improve the quality of Town streets. DISCUSSION: The scope of work for this year’s Annual Curb, Gutter and Sidewalk Maintenance project mainly addresses the installation of curb ramps as required by the Americans with Disabilities Act (ADA), many of which are related to the Town’s Annual Street Repair and Rehabilitation project. Title II of the ADA obligates a jurisdiction to provide curb ramps whenever streets are resurfaced from one intersection to another. The United States Department of Justice has determined that many surface treatments, such as the arterial overlay programmed in this year’s Annual Street Repair and Rehabilitation project, trigger the requirement for ADA compliant curb ramps on the associated streets. The slurry seal component of the Annual Street Repair and Rehabilitation project does not trigger the need to upgrade curb ramps. Curb ramps required for the Town’s street repair program are typically bid as part of the Annual Curb, Gutter and Sidewalk project to allow for more competitive pricing. The curb ramps that have been added to this year’s project are either required because of the proposed asphalt overlay on Lark Avenue and Blossom Hill Road or are located near schools. In order to allow flexibility in bidding and award within the allocated budget, ramps at Anne Way and Union Avenue have been included as an additive alternate and may be awarded if favorable bids are received. The base bid and additive alternate new, replacement and modified ramps include:  10 replacement ramps related to the proposed Town asphalt overlay project  16 modified ramps related to the proposed Town asphalt overlay project (installation of yellow domes)  11 new ramps around schools and on school routes  5 new and replacement ramps around Main Street In addition to curb ramps, the project also includes the installation of a missing section of sidewalk by Fisher Middle School that is adjacent to one of the project curb ramps. Sections of broken and lifted sidewalk on Blossom Hill Road between Los Gatos Boulevard and Cherry Blossom Lane and Belgatos Road to Harwood Road will also be removed and replaced as part of the project. Street tree replacements only occur in locations where staff obtained adjacent resident concurrence. The engineer’s estimate for the base bid is $427,983, including a 10% contingency. Should favorable bids be received, the additive alternates may be awarded. The engineer’s estimate for the additive alternate, including a 10% contingency, is $19,277.
