1. New Town Entertainment Policy is formally adopted on June 21st 2016. Part of the verbiage
states: "please note some businesses may require a CUP modification" under the policy.
2. On June 30th the Toll House files for a CUP Modification allowing entertainment in our outdoor
courtyard, falling in line with the newly adopted policy.
3. Toll House has first technical review of the application on Wednesday July 27th @ 9am .
4 . After addressing technical questions, Toll House is placed on the September 14th Planning
Commission agenda.
5. Ahead of the September meeting, Town staff recommends outreach .
6. Prior to September Meeting, Toll House begins planning an open house on October 6th, inviting
neighboring apartments, businesses, Meadows residents and Broadway Residents (Up to a
predetermined spot thought to be inclusive of impacted area.)
7. At September 14th meeting, Toll House is ask~d to conduct a sound study to determine impact.
8. At September planning department meeting, outreach is questioned by the commissio ners, and
we gladly agree to perform add ition outreach. Toll House reaches out th rough mail and
available emails to all Broadway neighbors that attended the planning meeting, or submitted
letters to the Planning Commission prior to September 14th. In addition, invitations to the event
are handed out personally to businesses on S. Santa Cruz, an invitation is posted on
Nextdoor.com, notices are sent out to local Jazz on the Plazz database, and through the Los
Gatos Chamber of Commerce weekly E -blast. Our desire was to be inclusive of the entire
community, and I believe we accomplished that.
9. At the request ofthe planning commission, a professional sound study and analysis is conducted
by an unbiased 3rd party. The study takes place September 22nd-September 2ih. On
September 2ih, Jim, Jason, members of town staff, and two sound engineers walked the
neighborhood, speaking with and taking measurements at Jillian and Mike Verga's home at 46
Broadway, Lori and Brad Forcier's@ 45 Broadway, Patti and Tim Perry's at 37 Broadway, Anne
Louise Heigho@ the Meadows #B-210 (in addition to members of the Meadow's executive
team.) Measurements were also taken at 6 additional points that reflected a cross section of
residences that cou ld be possibly affected . The results were prepared to be shared and were
posted during the community event on October 6th.
A. The sound study now provides scientific data that supports a constant "de lta" or
difference that can be expected and measured to determine allowable courtyard
volume that will have no effect on the Broadway neighborhood.
B. One point to note is that during the study, music was louder than we wou ld ever
consider in our courtyard, and was disruptive to our hotel guests. All at the same
time, not discernable from ambient noise on Broadway.
10. At the November 9th Planning Commission meeting, the sound study and our outreach efforts
were shared. We were asked at that time to perform additional outreach.
11. On Monday, December 5th, we begin the process of emailing those neighbors which we had
email addressed for, requesting that we might get together individually to discuss options with
the CUP. On Tuesday, December 61h we received a reply back from Larry Lenhart (#30
Broadway) say ing that he had spoken to a number of the Broadway neighbors and they would
like to get together as a group. He suggested his house on Wednesday December 14th @
530pm.
12. On December 14th, Jim, Jason, and Monica Renn met with Larry (#30 Broadway), Gillian (#46
Broadway,) Tom (#62 Broadway,) Gail (#42 Broadway), Lori (#45 Broadway)for approximately 1
hour. The conversation was respectful on both sides, but we were unable to elicit any
conditions that our neighbors would be interested in seeing in an amended CUP. We (Toll
House) was tasked with coming up with suggestions and reporting back to the neighborhood.
13 . On Friday December 15th, an email was sent to all those in attendance (sub one email address
we did not have) at the December 14th meeting, containing 3 recommendations we felt
comfortable would r educe impact of the pending CUP change to the Broadway neighborhood
down to zero. (Sound Monitoring, Location of Speakers, and No live Percussion.) In this email,
we also requested from our neighbors any additional condition s that they might wish to be
considered.
14. We received a reply back from Larry on January 4th stating that many of the neighbors had been
out of town, and that he would follow up shortly.
15. We received a second email on the evening of Monday January 9th alerting us to the letter from
the residents to be included in the January 11th Planning Commission Agenda.

This letter summarizes the results of our entertainment noise ass ess ment for proposed outdoor events
at the Toll House Hotel in Los Gatos. The purpose of this study was to measure typical entertainment
(music) noise at nearby residential properties and determine a music operating level necessary to meet
the City standards. This letter summarizes our findings and recommendations.
ACOUSTICAL CRITERIA
Town of Los Gatos Code of Ordinances
The Town of Los Gatos Code of Ordinances addresses Noise in Chapter 16. According to
Section 16.20.015:
No person shall cause/ make/ suffer or allow to be made by any machine/ animal, device or
any combination of same in a residential zone/ a noise level more than six (6) dB above the
noise level specified for that particular noise zone/ as shown on the Noise Zone Map/ during
that particular time frame/ at any point outside of the property plane.
Additionally, the Noise Zone Map specifies the subtraction of 5 dB for weekends and holidays. The
noise levels specified for the zone in which the Toll House Hotel and surrounding properties are located
are listed in Table 1.

We understand that entertainment noise from events would stop at 10 pm. Therefore, the allowable
noise limits vary between 57 and 62 dBA, depending on the day of the week.

We visited the site to measure entertainment noi se on 27 Septe mber 20 16. On e DJ was set up on the
north end of the courtyard with two speakers faci ng south (i.e., inwards towards the hotel). One noise
monitor remain ed stationary in t he courtyard of the hotel at a pros pective lo cation for a future
perm anent noi se monitor (Cl). Spo t meas urem ents were taken at surrounding locations, in cludi ng the
prop erties of concerned residents (Ll-10). Th e nearest residen tial property line is show n as location
L6. The tim e periods of the spot meas ureme nts were synchronized wit h the stationary no ise monitor to
determine the amount of noise reduction at each receiver lo cation .
Table 2 shows the measured noise leve ls at ea ch rece iver location. The source (courtyard) nois e level
varies as differe nt types of music were played. See Figure 1 for measurement location s.

An addition al measurement was mad e near the ce nter of the co urtyard, labeled C2 in Figure 1, and
may offer an alternative future noise monitoring location fo r the owners. Th is measurement shows th at
simultaneous no ise levels at C2 are 8 dB higher than at location Cl.
Th e amo unt of attenuation at eac h receiver lo cation should remain constant. The re ceiver noise level
at each lo ca tion is directly proportional to the courtyard noise level.
ANALYSIS
As shown in Table 2, all of the measured entertainment noise level s meet the allowabl e weekday Noise
Zone Limits from 1 pm to 10 pm (i.e ., 62 dBA). We understand the hotel will monitor noise levels
during events and adjust t he vo lume as needed so as not to exceed the Town Noise Zone Limits.

Therefore, the enterta in ment noise may operate as high as 74 dBA at the Cl meter location (or 82 dBA
at the C2 location) while meeting the Noise Zone Limits at the most noise -sensitive location (LS).
However, with the subtractio n of 5 dB for weekends and holidays, as stated in the Town of Los Gatos
Noise Zone Limits, events occurring from 1 pm to 10 pm on weekends and holidays shou ld operate at
a maximum level of 69 dBA at the Cl location (or 77 dBA at the C2 location) to meet the required
Noi se Zone Limits .
If events are sched ule d to occur outside of the 1 pm to 10 pm time frame on either weekdays or
weekends/holidays, entertainm ent noise leve ls should be adjusted accordingly, as shown in Table 3.
