ADOPT A RESOLUTION ADOPTING A COMPLETE STREETS POLICY FOR THE TOWN OF LOS GATOS. B. AUTHORIZE THE TOWN MANAGER TO ENTER INTO ALL MEASURE B FUNDING AGREEMENTS WITH THE SANTA CLARA VALLEY TRANSPORTATION AUTHORITY. RECOMMENDATION: Staff recommends that the Town Council: 1. Adopt a resolution adopting a Complete Streets Policy (Attachment 1) for the Town of Los Gatos. 2. Authorize the Town Manager to enter into all Measure B funding agreements with the Santa Clara Valley Transportation Authority (VTA). BACKGROUND: On November 8, 2016, the voters of Santa Clara County overwhelmingly approved Measure B, a 30-year, half cent sales tax measure supporting transportation projects and se rvices. Measure B lists and describes the following nine program categories: Local Streets and Roads; BART Phase II; Bicycle and Pedestrian; Caltrain Grade Separations; Caltrain Corridor Capacity Improvements; Highway Interchanges; County Expressways; State Route 85 Corridor; and Transit Operations. Measure B requires “the cities and the County [to] apply Complete Streets best practices in order to improve bicycle and pedestrian elements of the street system.” In addition, the VTA approved applying the Complete Streets requirement to all remaining capital program categories. PAGE 2 OF 3 SUBJECT: MEASURE B COMPLETE STREETS REQUIREMENTS AND FUNDING AGREEMENTS DATE: FEBRUARY 13, 2019 S:\COUNCIL REPORTS\2019\02-19-19 Interviews\08 Complete Streets Policy [Reso]\Staff Report.docx 2/13/2019 2:10 PM BACKGROUND (continued): Complete Streets are generally defined as streets that are planned, designed, and operated for safe mobility for all users including pedestrians, bicyclists, motorists, and transit users of all ages and abilities. Measure B initially faced a legal challenge, however most recently the California Supreme Court refused to hear an appeal on the issue. This authorized the lower courts, which also ruled against that challenge, to allow VTA to disburse the tax revenue , which has been accumulating in escrow as of January 30, 2019. The first of several requisite Measure B funding agreements is the Local Streets and Roads Master Funding Agreement. DISCUSSION: The Bicycle and Pedestrian Advisory Commission (BPAC) and Transportation and Parking Commission (TPC) formed a Complete Streets Ad Hoc Committee made up of two BPAC and three TPC Commissioners. The Ad Hoc Committee met five times between August 2018 and January 2019. The Ad Hoc Committee invested significant effort in the process with a goal to meet not only the Measure B requirements, but also to develop a proposed Policy which would become the foundation for complete streets implementation and as a way to meet the needs and requirements for transportation policies in the General Plan update. As envisioned by the Ad Hoc Committee, the proposed Complete Streets Policy is an overarching Policy that guides all relevant Town Departments by formally incorporating complete streets in all transportation projects and funding programs. The proposed Policy is built upon the general language suggested by VTA while fitting within the context of the Los Gatos community. In addition to completing the draft Policy, the Ad Hoc Committee discussed a list of implementation items for the Council’s consideration in the future, such as incorporating the Complete Streets Policy in the General Plan update, continued investments by the Town in complete streets infrastructure, greater focus on all street users in the impact analysis, and enhanced maintenance efforts on bicycle and pedestrian facilities. Building on the Policy foundation, the implementation items are important in advancing complete streets practices. Staff will bring the individual items back to Council for consideration through annual budget processes. The Town will receive formulaic funds in the Local Streets and Roads and Pedestrian and Bicycle Education and Encouragement Program categories. The draft Local Streets and Roads Master Funding Agreement (Attachment 2) is required to receive both formulaic and competitive funds. CONCLUSION: The proposed Complete Streets Policy would allow the Town to meet Complete Streets requirements for future One Bay Area Grant and Measure B funding programs. Staff recommends that the Complete Streets Policy be adopted via resolution. To streamline future funding agreements, staff is recommending that the Town Council authorize the Town Manager to enter into all Measure B funding agreements with the VTA. COORDINATION: This item has been coordinated with the Finance Department and VTA staff. The proposed Complete Streets Policy was developed through the Ad Hoc Committee formed by BPAC and TPC. The BPAC and TPC reviewed this item at the February 7, 2019 and February 14, 2019 meetings respectively, and took action supporting the Ad Hoc Committee and staff recommendations. FISCAL IMPACT: The adoption of the Complete Streets Policy has no fiscal impact. Entering Measure B funding agreements with VTA will allow the Town to receive formulaic funds in the Local Streets and Roads and Pedestrian and Bicycle Education and Encouragement Program categories and potential grant funds in the competitive categories, including the Innovative Transit Service and Bicycle/Pedestrian Capital Projects. ENVIRONMENTAL ASSESSMENT: The actions are not a project as defined under CEQA, and no further action is required. Attachments: 1. Draft Resolution Adopting a Complete Streets Policy 2.
