Main Street Los Gatos, CA 95030 ● 408-354-6832 www.losgatosca.gov TOWN OF LOS GATOS COUNCIL AGENDA REPORT MEETING DATE: 12/18/2018 ITEM NO: 3 DRAFT MINUTES OF THE TOWN COUNCIL MEETING DECEMBER 4, 2018 The Town Council of the Town of Los Gatos conducted a Regular Meeting on Tuesday, December 4, 2018, at 7:00 p.m. MEETING CALLED TO ORDER AT 7:00 P.M. ROLL CALL Present: Mayor Steven Leonardis, Vice Mayor Marcia Jensen, Council Member Rob Rennie, Council Member Marico Sayoc, Council Member Barbara Spector. Absent: None PLEDGE OF ALLEGIANCE Isabella Burlinson led the Pledge of Allegiance. The audience was invited to participate. CLOSED SESSION REPORT Robert Schultz, Town Attorney, stated Council met in Closed Session as duly noted on the agenda and there is no report. COUNCIL/TOWN MANAGER REPORTS Heard at the end of the meeting. Council Matters - Council Member Sayoc stated she wanted to raise awareness about several bills that will be coming forward; particularly SB 50 which is a reiteration of SB 827 that proposes allowing high density housing by right around transit stations. - Council Member Spector commented on the proposed legislation and stated she attended the holiday parade and tree lighting, and met with members of the community on a variety of topics. - Vice Mayor Jensen stated she will be attending an upcoming Association of Bay Area Governments meeting regarding the Metropolitan Transportation Commission’s CASA initiative and its recommendations to increase housing productions and address other housing issues. - Council Member Rennie stated he has attended several meetings with the public and city of Morgan Hill regarding a proposed annexation in Morgan Hill to be discussed at the next Local Agency Formation Commission meeting; Assembly Member Low’s Council appreciation lunch, VTA Board Subcommittee Meeting on capital programs, and Silicon Valley Clean Energy Authority Legislative Ad Hoc Committee; and participated in a phone call regarding a grand jury inquiry. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Approve Council minutes of November 20, 2018. 2. Accept Fiscal Year (FY) 2017/18 Status Report on Receipt and Use of Development Impact Fees. 3. Hazardous Vegetation Abatement (Weeds) A. Adopt a resolution declaring hazardous vegetation (weeds) a public nuisance and providing for their abatement. 2018-053 B. Set January 15, 2019 as the public hearing date for this annual program. 4. Review and approve the scope of services for a Request for Proposals (RFP) for a comprehensive parking study. MOTION: Motion by Vice Mayor Jensen to approve the Consent Items. Seconded by Council Member Spector. VOTE: Motion passed unanimously. VERBAL COMMUNICATIONS Michael Silva - Commented on the interest of American Legion Post 99 to use the Town’s Tait Avenue property as a meeting place. Stu Lavatai - Commented on how the American Legion Post 99 would benefit the Town. Chris Wiley - Commented on the need to work together as a Town. Mark Trout - Read a prayer and commented on the Bible. OTHER BUSINESS 5. Approve an Amendment to the Employment Agreement between the Town of Los Gatos and the Town Attorney, and authorize salary and benefits budget adjustments in the amount of $10,859 from estimates available FY 2018/19 operating revenues. Opened and closed Public Comment. Council discussed the matter. MOTION: Motion by Vice Mayor Jensen to approve the recommendation contained in the staff report. Seconded by Council Member Sayoc. VOTE: Motion passed unanimously. 6. Consider proposed revisions to Council Policy 2-01: Town Agenda Format and Rules. Laurel Prevetti, Town Manager, presented the staff report. Opened and closed Public Comment. Maria Ristow - Commented on the proposed changes. Council discussed the matter. MOTION: Motion by Council Member Spector to modify Policy 2-01 moving Council Matters and Manager Matters to the end of the agenda and note that the Mayor has the discretion to move any item on the agenda. Seconded by Council Member Sayoc. VOTE: Motion passed unanimously. PUBLIC HEARINGS 7. Town Code Amendment Application A-17-002. Project Location: Town Wide. Applicant: Town of Los Gatos Consider amendments to Chapter 6 (Buildings and Building Regulations) and Chapter 29 (Zoning Regulations) of the Town Code regarding fences, hedges, and walls. Fence Ordinance(s) continued from 10/16/18. Sean Mullin, Associate Planner, presented the staff report. Opened Public Comment. Ed Lambing, San Jose Water Company - Commented on the proposed ordinance and suggested a compromise for utility companies. Closed Public Comment. Council discussed the matter. MOTION: Motion by Council Member Sayoc to introduce the ordinance by title only to amend chapter 6 and include provisions as discussed for specific emergency precautions that are needed. Seconded by Vice Mayor Jensen. VOTE: Motion passed unanimously. The Town Clerk read the title of the ordinance.
