Council Members, Please approve the 405 Alberto Way Project as it currently stands, and do not require the applicant to go ·below 70,000 sf. This Town needs the free shuttle service so that it can support the vitality of the downtown retail community. It was explained to me if the project goes below 70-,000 sf. the CAT shuttle can not be funded. I can not think of a better way to provide a free shuttle service ( funded by a private entity ) to the citizens of the town of Los Gatos to use. Not only is this fiscally respon sible, it also helps support the town of Los Gatos' "age friendly" community designated by the World Health Organization. This shuttle absolutely shows action over concerns of an already congested downtown area by having the option of riding a free shuttle versus putting more cars on the streets. We were founded by the late Daves Avenue teacher, Bob Tezlaff, a 1960 US Olympian and member of the US Bicycle Hall of Fame . Our club will be celebrating the 45th Cat's Hill Classic bike race on April 28 , 2018 in the Almond Grove District of Los Gatos . We have devoted considerable time to the Town of Los Gatos as an Ambassador of the Los Gatos Chamber of Commerce while also supporting several local charitable organizations such as the Los Gatos Education Foundation (LGEF), the Community Against Substance Abuse (CASA) and the Los Gatos High School Band . The design has already b een re-worked, and re-worked, and has hit the bottom rung of eco nomic feasibility. As you all know, intelligent people just do not build multi-million projects for free . A project's economics do play a significant part in making a decision to go or no go. As a four-term city counci lman and mayor of an established mid-penin sul a town of si mil ar demographic as Lo s Gatos, I can share with you the fact that change is part of life, and part of a quality community, even one of hi gh quality, such as Lo s G atos. Lo w I think that this Project would be GREAT for Down Town Los Gatos business in ALL! Next-PARKING during the Daytime can be very unforgiving for those want-to-be- customers, but are having to deal with a parking issue! I say this as a FACT!, since I have been at Steamer's for 32+ years and have seen the change in how thing's have developed in Santa Clara County! Also, the neighbors should be able to have 24 hour parking permits, if they think that extra parking and traffic will be an issue. And-I do not think that this will happen, but you could make it where they have to have a pass to get th rough past the development. I can not remember the parking situation, but their should be NO ISSUES as to having parking for the employees that work their. If so, they will not be able to bring people in by car for So-Called Meetings at the office. I am done for now. I will be at Steamer's this week-end if anyone has a question? NO PHONE CALLS AT WORK! I now urge you to certify the Final EIR and approve the Architecture and Site Plan for the 74,2 60 square feet proposal at the May 1 meeting. In my view, it has been taken way too long to approve this outstanding project. Lets move forward to improve Los Gatos. It seems to me that the developer has take n all the steps nece ss ary and made many accommodations su ch that the project can be approved . I ask the Town Council to approve the 401 Alberto Way Project, as it currently stands, so that the free shuttle servi ce can support the vitality of t he downtown retail community. This project is directly across the street from our property at 53-57 Los Gatos-Saratoga Road (Best Western Inn of Lo s Gatos and Grill 57 property). The use being pursued seems appropriate for the site, and the architecture appears appealing and fitt i ng of Los Gatos . Class A office space near a major freeway w ith on/off ramps in all directions makes sense , and it i s likely that the developer could attract a solid tenant (or tenants) that brings highly-paid employees to Los Gatos. With this type of tenant typically comes employees that are likely to spend money in the Los Gatos community. This could have the multi-faceted effect of increasing revenues at local businesses and increasing tax revenues . Specifically for us, this development could help increase revenue at our property and thus increase the ta xes we pay to the Town of Los Gatos . It would also be nice to see jobs being brought to an area where there is housing. We would greatly look forward to providing services for the new tenants at 401 Alberto Way, and we hope that the community has come to see the project's merits. The 64,000 sq. ft.-80 ft. plan was submitted by the Board of Directors of the Los Gatos Commons on April 16, not by "a neighbor" as the report says. The Board is authorized to represent the 133 residents of The Commons and The Commons is the largest development on Alberto Way. We question how the staff determined that an 80 ft. setback is associated with a 67,870 sq . ft. building and a 95 ft. setback, with a 64,000 sq . ft. building. There is no explanation of how the 74,260 sq . ft . building outlined by story poles would actually be reduced to arrive at either the 64,000 or 68,870 figure . The staff submitted photos of the "visibility impact" of the proposed building adopting the vantage point used by the applicant, namely, the front lawn of Thomas Dunn, not the public view from the west sidewalk. The neighbors have consistently in their petitions and letters stressed that the west sidewalk is the route used by the overwhelming number of pedestrians who walk past the north view corridor. The private view of the Dunn family is from an elevated lot setback significantly from the east sidewalk. Preserving the existing, public view from the west sidewalk does not diminish the existing views from private residences, including Mr. Dunn's. The applicant submitted "renderings," not photographs, purporting to show the view of the hillsides associated with a 70,000 sq. ft. project (4/18). The rendering is a subjective impression . There are not story poles for a 70,000 sq. ft. building and the vantage point is Mr. Dunn's yard, not the west sidewalk view. We are attaching photographs showing the view with an 80 ft. setback, taken from the west sidewalk. These are the same photos we sent 4/16 but the captions are hopefully easier to understand . We are convinced that a fair comparison of the visibility impact of 64,000 and 70,000 sq. ft. buildings can only be made by photographing the view corridor from the same vantage point, the west sidewalk. Please approve Architectural Site Plan the Condition Use Permit. I have also read the many legal memos related to this project. Ple ase also approve the final EIR as this approval has been long overdue. This developer has already proposed mitigation measures which off set then "less than significant" impacts and , as I'm sure you are awa r e, they are not required in anyway to do mitigate this low level of impact but have repeatedly done so as good stewards. After 3 re- designs, years of analysis and financial burden by both the town and developer, a weak Planning Commission that has broken the law by repeatedly moving the "goal line" after the developer has met their subjective requests, etc ... - enough is enough! I live on Belmont Ave in downtown Los Gatos and am an entrepreneur and small business owner. After much analysis and research, I have de ci ded again to whole-heartedly support the 405 Alberto Way proje ct as it is currently proposed and I implore you to do the same. Please remember that it is your job to listen to ALL residents unb iasedly and not let a small but vocal group of "squeaky wheel NIBMYs" (mostly retired with extreme amount of time to spend on efforts to try to stop responsible development that super exc eeds just complying with the zoning and also provides public benefit) diss uade you from a balanced and legally sound decision that meets the overall stated plans and objectives of the entire town/city. Pl eas e remember that th is proposed project defin itely • complies with all the publicly stated town objectives and plans, • more than adequately meets all zoning requirements, • replaces an eye-sore of a building with an attractive & sensitively designed modern yet traditional one, • offers way more than the state-required traffic mitigation measures -including the CAT free shuttle service, • will provide relief to a huge pent-up demand for true Cla ss A office needs, and • w i ll provide lots of revenue to the town's general fund and thus even more public benefits I have looked at the views extensively from every way and , like Caro l Muser, do not see a detraction or elimination of views. The current proposed plans clearly present an attra ctive structure that w ill open up the area with generous set ba cks and lots of curb appeal. Once again this proje ct is on your agenda largely an has become the talk of town due to the gross mistreatment of the developer. Please do not let this turn into yet another legal battle like the North-40 project that the town will ultimately lose after spending & wasting $100,000s of residents' taxpayer monies that could otherwise be directed to public benefits for which you will receive much praise instead of frustrated criticism from residents .
