AUTHORIZE A BUDGET REVENUE ADJUSTMENT RECOGNIZING $134,620.68 FROM THE WEST VALLEY SANITATION DISTRICT AS EXCESS FUNDS COLLECTED ON BEHALF OF THE WEST VALLEY CLEAN WATER PROGRAM. B. AUTHORIZE A BUDGET EXPENDITURE ADJUSTMENT OF $134,620.68 TO TRANSFER THE FUNDS TO THE CITY OF SARATOGA AS THE FISCAL AGENT FOR THE WEST VALLEY CLEAN WATER PROGRAM. RECOMMENDATION: Staff recommends that the Town Council: 1. Authorize a budget revenue adjustment recognizing $134,620.68 from the West Valley Sanitation District (WVSD) as excess funds collected on behalf of the West Valley Clean Water Program (WVCWP). 2. Authorize a budget expenditure adjustment of $134,620.68 to transfer the funds to the City of Saratoga as the fiscal agent for the WVCWP. BACKGROUND: The WVCWP consists of a partnership between the Town and the cities of Monte Sereno, Saratoga, and Campbell to manage regulatory compliance with State and Federal clean water regulations. The WVSD has historically provided management services to the WVCWP, most specifically acting as the fiscal agent for the WVCWPs operating budget. The WVSD has decided to move out of this role and will no longer provide any services to the WVCWP. The WVCWP has been set up as a new Joint Powers Authority (JPA) and the City of Saratoga will now act as the new fiscal agent for the WVCWP. The West Valley Sanitation District has returned the balance of the operating funds held for the WVCWP to the participating cities and the Town. DISCUSSION: To allow for ongoing operations of the WVCWP, it is necessary to continue to utilize the funds in the operating budget. Because the WVSD returned the funds to the Town and the other cities, it is necessary to acknowledge those funds as revenue to the Town and to budget them as an expenditure to the City of Saratoga as the fiscal agent. CONCLUSION: Approval of the recommended budget adjustments will allow for the continued operation of the WVCWP. FISCAL IMPACT: The recommended budget adjustments will have no net fiscal impact to the Town.
