AUGUST 7, 2018
The Town Council of the Town of Los Gatos conducted a Regular Meeting on Tuesday, August 7,
2018, at 7:00 p.m.
MEETING CALLED TO ORDER AT 7:00 P.M.
ROLL CALL
Present: Mayor Rob Rennie, Vice Mayor Steve Leonardis, Council Member Marcia Jensen,
Council Member Marico Sayoc, Council Member Barbara Spector.
Absent: None

BOARD/COMMISSION/COMMITTEE APPOINTMENTS
Council appointed the following applicants to Town Boards, Commissions, and Committees:
• Bicycle and Pedestrian Advisory Commission
o Jeff Thompson was appointed.
• Community and Senior Services Commission
o No appointments were made; applicant was unable to attend the interview.
• General Plan Advisory Committee

Robert Schultz, Town Attorney, stated Council met in Closed Session as duly noted on the
agenda and there is no report.

COUNCIL/TOWN MANAGER REPORTS
Council Matters
- Council Member Spector stated she attended two Council Finance Committee meetings,
the Town’s July 4th celebration, the Santa Clara Valley Water District meeting, and met with
members of the community.
- Council Member Sayoc stated she attended several Cities Association and League of
California Cities board meetings, she unofficially attended the Los Gatos Music in the Park
concerts and the Chamber of Commerce block parties, and she met with community
members.
- Mayor Rennie stated he visited the Town’s Sister City of Listowel, Ireland and read a poem
written by the Town’s Poet Laureate Stan Garber; he attended several Silicon Valley Clean
Energy Authority (SVCEA) Board, Legislative Action Committee, and Finance &
Administration Committee meetings; he attended the Council Policy Committee and the
Council Finance Committee meetings; he performed ribbon cuttings for On Purpose
Chiropractic and Thread Up; he attended the West Valley Mayors and Managers meetings;
he threw out the first pitch at the Los Gatos All Star Tournament game; he served lunch for
the Los Gatos Recreation Senior barbecue; he attended the Los Gatos-Monte Sereno Police
Department promotional ceremony; he did an interview with KCAT-TV; he attended the
Valley Transportation Authority (VTA) Board Meeting as an alternate for the West Valley
Cities; he attended the Silicon Valley @ Home lunch; he met with Town Manager Prevetti
and the new LGUSD superintendent Paul Johnson; and he attended the Los Gatos Music in
the Park concerts.
- Vice Mayor Leonardis stated he attended the Los Gatos Music in the Park concerts, and the
West Valley Clean Water Program Authority Board meeting.
- Council Member Jensen stated she attended a Council Policy Committee meeting and met
with members of the community.
Manager Matters
- Recognized the photographs in the Council Chambers are from the Chamber of Commerce
“Best of Los Gatos” photo contest and thanked all the participants.
- Announced Leadership Los Gatos applications are being accepted now through August 31st
and may be found on the Chamber of Commerce website.
CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION)
1. Approve Council meeting minutes of June 19, 2018.
2. Approve Closed Session meeting minutes of August 1, 2018.
3. Accept report on Town Manager approved actions during Council recess.
4. Continue the adoption of an ordinance of the Town Council of the Town of Los Gatos
amending Chapter 4 of the Los Gatos Town Code entitled Animals and Fowl to September 4,
2018.

5. A. Approve a labor agreement between the Town of Los Gatos and the American Federation
of State, County and Municipal Employees and authorize the Town Manager to execute the
Memorandum of Understanding.
B. Authorize salary and benefits budget adjustments in the amount of $53,417 from
estimated available FY 2018/19 operating revenues.
6. Authorize the Town Manager to execute a five-year agreement for consultant services for
map check review and surveying services with Kier & Wright Civil Engineers & Surveyors,
Inc. in amount not to exceed $125,000.
7. Authorize the Town Manager to execute a four-year Agreement for Services with Universal
Site Services for enhanced downtown garbage and recycling receptacle collection and
cleaning services in an amount not to exceed $38,247 for Fiscal Year 2018/19, plus
adjustments annually thereafter for a total agreement amount not to exceed $187,737.
8. Authorize the Town Manager to execute an agreement with Superion LLC. to upgrade, cloud
host, and provide annual maintenance services for the Town’s financial /human resource
management information system in an amount not to exceed $95,759.
9. Property Location: 201-225 Los Gatos-Saratoga Road.
Consider a request for approval of an exception to the Story Pole Policy to allow an
alternative to standard story pole installation to illustrate and provide notice of the
proposed project. APNS 510-14-08 and 510-14-009.
MOTION: Motion by Council Member Jensen to approve the Consent Items. Seconded by
Council Member Sayoc.
VOTE: Motion passed unanimously.
VERBAL COMMUNICATIONS
Catherine Somers, Los Gatos Chamber of Commerce Executive Director
- Thanked the Council and staff for turning on the Civic Center fountain; announced the start
of Leadership Los Gatos, the last downtown block party is August 19th, and the Chamber
Annual Awards Dinner will be held on October 4th.
Mary Roach
- Commented on the condition of the magnolia trees behind the proposed CVS location on
Los Gatos Blvd. and the memorial oak tree in the median on Los Gatos-Almaden Road at
Los Gatos Blvd.; and stated she would like to see the Tree City USA designation brought
back to Los Gatos.
Linda Caplinger
- Commented on the proposed changes to the animals and fowl ordinance.

10. Consider the 2018 Weed Abatement Program Assessment Report from the County of Santa
Clara Consumer and Environmental Protection Agency and adopt a resolution confirming
the report and authorizing collection of the assessment charges. RESOLUTION 2018-040

- Commented on the reasons for her protest of the fees.

Council discussed the matter.
MOTION: Motion by Council Member Jensen to adopt a resolution (Attachment 2)
confirming the report (Attachment 1) and authorizing collection of the
assessment charges, and direct Director Morley to work with the County and the
property owners to resolve the protests that were brought forward and to work
with the County in the future to resolve any protests before bringing the report
to Council. Seconded by Council Member Sayoc.
VOTE: Motion passed unanimously.
OTHER BUSINESS
11. Discuss the dynamics of the Summer of 2018 cut through traffic and direct staff to continue
the current efforts.

- Requested that the mapping apps be told not to direct traffic onto Ridgecrest because it is
a safety issue.

- Commented on the results of the survey the Chamber conducted of the effect of the traffic
to the businesses.

- Commented on the setback increase requirement at Los Gatos Blvd. and Lark Avenue and
the impacts to his business.

- Markene Smith read a statement on behalf of Diane Dreher in support of an extension of
the moratorium.
Markene Smith
- Commented on the traffic impacts and requested an extension of the moratorium until
after the construction has started for phase one.

- Commented in support of senior housing in the second phase.

- Commented in support of a park at least the size of Bachman Park or larger that is not a
ball park, in favor of housing units and limiting the size, and not in favor of increasing the
height limit unless it is for mechanical units or pitched roofs.

- Commented on the proposal they provided at the June 5th meeting.
Sandy Decker
- Commented in opposition of the Grosvenor proposal and in favor of a moratorium
extension.
Chris Chapman
- Commented on the need to widen Los Gatos Blvd.
Lee Quintana
- Commented on the need to discuss whether an extension is needed, more objective
standards, and what the community wants to have.
Brent Ventura
- Commented on the impact of the moratorium to the remaining property owners and
requested that if the moratorium was extended that the three property owners be
exempted.

MOTION: Motion by Council Member Spector to continue the item to August 15, 2018, to
include as a separate agenda item a consideration of whether to continue the
moratorium, and any Council Members that are not available in person be
allowed to participate remotely. Seconded by Vice Mayor Leonardis.
VOTE: Motion passed 4/1. Council Member Jensen voting no.

• An explanation of the equity distribution that was requested.
• Identification of residential design controls available to the Town to ensure that the
Town achieves its affordable housing target.
• Ownership options (Town or Homeowners Association) of future parks to ensure public
access to these lands.
13. Town Code amendment application A-18-001. Project location: Town wide. Applicant:
Town of Los Gatos.
Consider amendments to Article VIII, Division 5 of Chapter 29 (Zoning Regulations) of the
Town Code regarding Affordable Housing Overlay Zones.

MOTION: Motion by Council Member Jensen to introduce an Ordinance (Attachment 3),
by title only, effecting amendments to Article VIII, Chapter 5 of Chapter 29
(Zoning Regulations) of the Town Code regarding Affordable Housing Overlay
Zones. Seconded by Council Member Sayoc.
VOTE: Motion passed unanimously.
The Town Clerk Administrator read the title of the ordinance.

Location: 223 Massol Avenue. Appellant: Tyler Atkinson, Esq. Property Owner/Applicant:

Consider an appeal of a Planning Commission decision approving a request for exterior
alternations and an addition to a non-contributing sing-family residence (HS-18-018); and
an appeal of a Planning Commission decision approving a request for an addition to a
residential accessory structure less than 450 square feet which is visible from the street (HS-
18-031) on property located in the Almond Grove Historic District zoned R1-D:LHP. APN
510-16-020. RESOLUTIONS 2018-041 and 2018-042
Mayor Rennie recused himself due to proximity to the p roject. Vice Mayor Leonardis assumed
chair of the meeting.

MOTION: Motion by Council Member Spector to deny the appeal for both
applications with a new condition of approval that the garage wall and eave are
not modified, or alternatively, that the garage wall and eave are modified so that
the wall and eave are entirely on the applicant's property. Seconded by Council
Member Jensen.
VOTE: Motion passed 4/1. Mayor Rennie recused.
