RECOMMENDATION:
Authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion
(Attachment 1) accepting the work of Stoloski and Gonzalez and authorize recording by the
Clerk Administrator for PPW Job No. 16-816-0410 Bicknell Road Storm Drain Improvements
Project.
BACKGROUND:
At the June 6, 2017 Town Council meeting, the Town Council approved a Capital Improvement
Program budget for FY 2017/18. The budget included a project scope and budget for the
Bicknell Road Storm Drain Improvements to re-route a Town storm drain line from private
property into the Town’s right-of-way. The original storm drain improvements at this location
were part of a 1967 subdivision on Bicknell Road that included a private residence at 697
Bicknell Road. This storm drain system accepts Town roadway storm water from Montclair
Road and empties the water into Smith Creek through the 697 Bicknell Road property.
The current property owner approached the Town several years ago to request the Town
provide proof that an easement was given to the Town for the storm drain line on 697 Bicknell
Road. After an extensive search for the easement documentation, it was determined that the

BACKGROUND (cont’d):
Town does not have a storm drain easement across the property and the line would need to be
re-routed back onto Town property.
The initial bid for the project, which opened on September 22, 2017, came in over budget. On
November 7, 2017, the Town Council rejected all bids and approved re-bidding the project and
authorized the Town Manager to execute a construction agreement in an amount not to
exceed $125,000. The subsequent bids were opened at the Town Clerks Office on December 1,
2017. Stoloski and Gonzalez was the lowest responsive bidder ($85,505) and was awarded the
project.
DISCUSSION:
Stoloski and Gonzalez has satisfactorily completed the work for this project and staff
recommends project acceptance.
Five percent of the faithful performance bond will remain in effect for a period of two years as
guarantee for any needed repair or replacement caused by defective materials and
workmanship. The execution and recordation of the Certificate of Acceptance is now required
to finalize the Town's acceptance of the project.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to execute a Certificate
of Acceptance and Notice of Completion accepting the work of Stoloski and Gonzalez and
authorize recording by the Clerk Administrator for PPW Job No. 16-816-0410 Bicknell Road
Storm Drain Improvements Project.
FISCAL IMPACT:
The final project cost was $148,037, of which $97,657.35 was direct construction costs paid to
Stoloski and Gonzalez, all within the project budget of $171,500 as demonstrated in the fiscal
table on the following page. As this project completed under budget, savings will return to the
Capital Project Reserve Fund for the Council to program to other projects in future CIP budgets.
