RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DENYING APPEAL OF PLANNING COMMISSION DECISION TO DENY
REQUEST FOR APPROVAL OF PLANS TO RECONSTRUCT AN EXISTING
RESIDENCE, CONSTRUCT AN ADDITION TO THE FIRST FLOOR AND
CONSTRUCT A NEW SECOND FLOOR TO A RESIDENCE IN THE R -lD-
LHP ZONE
(255 UNIVERSITY AVENUE - CAROLYN GIVENS)
WHEREAS:
1. Carolyn Givens has appealed a decision of the Planning Commission as follows:
denial of a request for approval of plans to reconstruct an existing residence, construct an
addition to the first floor and construct a new second floor to a residence in the R -1D-
LHP zone on property located at 255 University Avenue and owned by Carolyn Givens
(Architecture and Site Application S- 89 -83); and
2. A public hearing before the Town Council was scheduled for August 20, 1990 and
continued to and held on September 4, 1990.
BE IT RESOLVED:
1. The Town Council hereby finds that no evidence or testimony was presented that
the decision of the Planning Commission was in error.
2. Based on the foregoing finding, the appeal is hereby denied and Architecture and
Site Application A -89 -83 is hereby denied.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 17th day of September, 1990 by the following vote.
