RESOLUTION OF THE TOWN OF LOS GATOS DENYING THE APPEAL OF
PLANNING COMMISSION DECISION TO UPHOLD A DECISION OF THE
PLANNING DIRECTOR IN DENYING AN APPLICATION TO REMOVE A
TOWN PROTECTED TREE ON PROPERTY IN THE R- 1:8000 ZONE
(155 LESTER LANE - WALTER E. WADE)
WHEREAS:
1. Walter E. Wade has appealed a decision of the Planning Commission as follows:
upholding a decision of the Planning Director in denying an application to remove a Town
protected tree on property in the R- 1:8000 zone on property located at 155 Lester Lane and
owned by Walter E. Wade (Architecture and Site Application 5- 90 -25); and
2. A public hearing was held by the Town Council on July 2, 1990.
BE IT RESOLVED:
1. The Town Council hereby finds that no evidence or testimony was presented that
the decision of either the Planning Commission or the Planning Director was in error.
2. Based on the foregoing finding, the appeal is denied, the decision of the Planning
Commission is upheld and Architecture and Site Application 5 -90 -25 is denied.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 16th day of July, 1990 by the following vote.
